【摘要】：完善土地承包政策,是深化農(nóng)村土地制度改革的一項(xiàng)重要內(nèi)容,其核心就是穩(wěn)定農(nóng)村承包關(guān)系并保持長久不變。農(nóng)村土地承包經(jīng)營權(quán)是國家賦予農(nóng)民最重要的財(cái)產(chǎn)權(quán)利,也是廣大農(nóng)民關(guān)注的焦點(diǎn)和熱點(diǎn)。因此,順利開展農(nóng)村土地承包經(jīng)營權(quán)確權(quán)登記頒證工作,對(duì)實(shí)現(xiàn)三權(quán)分置及妥善解決農(nóng)戶承包地塊面積不準(zhǔn)、四至不清、厘清權(quán)屬糾紛等問題具有重要意義。在全國深入開展農(nóng)村土地承包經(jīng)營權(quán)確權(quán)頒證工作背景下,本文以廣東省河源市東源縣為個(gè)體研究對(duì)象,采取調(diào)查問卷、實(shí)地訪談、查閱文獻(xiàn)等方法,詳細(xì)了解東源縣農(nóng)村土地承包經(jīng)營權(quán)確權(quán)工作現(xiàn)狀,綜合分析當(dāng)前工作面臨的問題主要有:群眾對(duì)土地確權(quán)認(rèn)識(shí)不足,確權(quán)工作推進(jìn)難;工作難題無政策法規(guī)依據(jù)解決;土地權(quán)屬爭(zhēng)議矛盾調(diào)處難度大;暫緩確權(quán)的土地多,整體推進(jìn)不理想。本文從現(xiàn)實(shí)、歷史、政策法律、政府部門自身等四個(gè)層面分析了問題成因,并根據(jù)現(xiàn)實(shí)工作中面臨的問題和原因,結(jié)合借鑒新會(huì)區(qū)確權(quán)工作經(jīng)驗(yàn),對(duì)東源縣農(nóng)村土地承包經(jīng)營權(quán)確權(quán)登記工作提出了相應(yīng)的工作建議,建議包括提高群眾思想認(rèn)識(shí),強(qiáng)化確權(quán)觀念;政府出臺(tái)文件政策,與現(xiàn)行法律法規(guī)做互補(bǔ);加快建立土地權(quán)屬糾紛仲裁機(jī)構(gòu),提高基層調(diào)處水平;整體統(tǒng)籌有效推進(jìn),借機(jī)解決遺留問題;為其他縣區(qū)推進(jìn)農(nóng)村土地承包經(jīng)營權(quán)確權(quán)工作提供參考。
[Abstract]:Perfecting the policy of land contracting is an important content of deepening the reform of rural land system. Its core is to stabilize the rural contract relationship and keep the long-term unchanged. The rural land contractual management right is the most important property right given by the state, and it is also the focus and hot spot of the majority of farmers. The successful development of the rural land contractual management right registration and certification of the right to achieve the three rights division and the proper resolution of farmers contracted land area is not clear. It is of great significance to clarify the disputes of ownership. Under the background of carrying out the work of confirming the right of rural land contract management, this paper takes Dongyuan County, Heyuan City, Guangdong Province as the individual research object and adopts the questionnaire. Field interviews, literature review and other methods, detailed understanding of the Dongyuan County rural land contractual management right to confirm the status quo, comprehensive analysis of the current work facing the main problems: the masses of the lack of understanding of the right to confirm land. It is difficult to carry out the work of confirming the right; The work difficult problem has no policy and law basis to solve; It is difficult to deal with the disputes of land ownership; This paper analyzes the causes of the problems from four aspects: reality, history, policy and law, and government departments themselves, and according to the problems and reasons in the actual work. Based on the experience of confirming the right in Xinhui District, the author puts forward some suggestions for the registration of the right to the contracted management of rural land in Dongyuan County, including improving the people's ideological understanding and strengthening the concept of confirming the right. The government issued a document policy to complement the existing laws and regulations; Speed up the establishment of land ownership disputes arbitration institutions, improve the level of grass-roots mediation; Overall and effective promotion, take the opportunity to solve the remaining problems; For other counties to promote rural land contractual management right to confirm the work to provide a reference.
