【摘要】：基于農(nóng)地承載的身份性、保障性職能和我國(guó)城鄉(xiāng)區(qū)隔的客觀情勢(shì),將經(jīng)營(yíng)權(quán)物權(quán)化不僅有違法權(quán)邏輯,實(shí)踐試點(diǎn)亦名不符實(shí),而且難以祛除土地承包經(jīng)營(yíng)權(quán)之身份障蔽、難以解決土地依賴性、難以推動(dòng)農(nóng)民身份轉(zhuǎn)型問題。在大陸法系"物權(quán)—債權(quán)"二元區(qū)分模式下,經(jīng)營(yíng)權(quán)兼具二者性質(zhì),但于法權(quán)定性中宜界定為債權(quán)但賦予優(yōu)先效力,強(qiáng)化其物權(quán)化保護(hù)措施。承包經(jīng)營(yíng)權(quán)與承包權(quán)均兼具身份性和財(cái)產(chǎn)性,制度功能和法權(quán)價(jià)值同一,雖在邏輯上可以分離但在實(shí)證法權(quán)層面難以剝離,不宜將承包權(quán)從承包經(jīng)營(yíng)權(quán)中剝離作為獨(dú)立權(quán)利。成員權(quán)內(nèi)容豐富,是連接集體所有和承包經(jīng)營(yíng)權(quán)的必要環(huán)節(jié)。權(quán)利分置應(yīng)采"集體土地所有權(quán)—成員權(quán)—承包經(jīng)營(yíng)權(quán)—經(jīng)營(yíng)權(quán)"之法權(quán)塑造路徑。
[Abstract]:Based on the identity of agricultural land security function and the objective situation of urban and rural areas in China there is not only illegality logic but also the practice of the pilot project is not worthy of the name. Moreover, it is difficult to remove the identity barrier of the land contractual management right, to solve the problem of land dependence, and to promote the transformation of farmers' identity, under the dualistic model of "real right and creditor's rights" in the continental law system. Management right has both nature, but it should be defined as creditor's right but give priority effect in the nature of legal right, and strengthen its protection measures of real right. Both contractual management right and contract right have identity and property. The system function and the value of legal right are identical, although they can be separated logically, but they are difficult to be stripped from the level of positive law right, it is not appropriate to separate the contract right from the contractual management right as an independent right. The content of the member right is rich. It is a necessary link to connect collective ownership and contractual management right. The division of rights should take the path of "collective land ownership-member right-contract management right-management right".
