【摘要】：在產(chǎn)權(quán)制度的界定和規(guī)范引導(dǎo)下,生態(tài)資源經(jīng)濟(jì)才能實(shí)現(xiàn)環(huán)境友好型、可持續(xù)為主題的科學(xué)發(fā)展。歷史上"公有地的悲劇"的啟示不單是對(duì)產(chǎn)權(quán)問題的反思,而是通過(guò)設(shè)立一套巧妙的制度,以達(dá)到"量體裁衣"之功效。生態(tài)資源環(huán)境公共產(chǎn)權(quán)的產(chǎn)生是源于其稀缺性及非排他性的特質(zhì)。但隨著計(jì)量這種產(chǎn)權(quán)成本與收益的難度不斷加深,環(huán)境資源體系的經(jīng)濟(jì)價(jià)值就越來(lái)越大。必須考慮在有效利用的前提下,重新界定產(chǎn)權(quán)來(lái)保證市場(chǎng)與主體效率目標(biāo)的實(shí)現(xiàn)。作為現(xiàn)代產(chǎn)權(quán)制度體系的最重要的組成部分———資源類產(chǎn)權(quán),它有別于企業(yè)產(chǎn)權(quán)制度,且它涉及利益主體的范圍之廣,涵蓋的意義也極其深遠(yuǎn)。本文對(duì)生態(tài)資源環(huán)境這一較為特殊公共物品的產(chǎn)權(quán)問題用產(chǎn)權(quán)經(jīng)濟(jì)學(xué)的思維框架進(jìn)行研究,從政府、企業(yè)、市場(chǎng)、制度四個(gè)層級(jí),相應(yīng)提出構(gòu)建此類公共產(chǎn)權(quán)的四層規(guī)制模式,以求破解在生態(tài)環(huán)境規(guī)制過(guò)程中出現(xiàn)的產(chǎn)權(quán)失靈現(xiàn)象及界定不清的困局。
[Abstract]:Under the guidance of the definition and regulation of the property right system, the eco-resource economy can realize the scientific development with the theme of environment-friendly and sustainable. The enlightenment of the tragedy of the public land in history is not only the reflection on the problem of property rights, but also the establishment of a set of clever systems to achieve the effect of "tailor-made clothes". The emergence of ecological resources and environmental public property rights is due to its scarcity and non-exclusivity. However, with the increasing difficulty of measuring the cost and income of property rights, the economic value of the environmental resources system becomes more and more important. Under the premise of effective utilization, we must redefine the property right to ensure the realization of the goal of market and subject efficiency. As the most important part of the modern property right system-resource property right, it is different from the enterprise property right system, and it involves a wide range of interest subjects, and its significance is extremely far-reaching. This paper studies the property right problem of ecological resources and environment, which is a special public goods, with the thinking frame of property rights economics. From the four levels of government, enterprise, market and system, this paper puts forward the four-layer regulation mode of this kind of public property right. In order to solve the phenomenon of property rights failure in the process of eco-environmental regulation and the difficult situation of unclear definition.
