低碳經(jīng)濟視角下反補貼法之污染者自擔費用原則

【摘要】：污染者自擔費用原則是發(fā)達國家環(huán)境責任法和反補貼法上的重要原則,發(fā)展中國家曾對該原則批評多多。然而,隨著全球環(huán)境不斷惡化,它逐漸為國際社會所接受,并對WTO的補貼法產(chǎn)生了一定的影響。我國應順應潮流,在制定低碳經(jīng)濟發(fā)展戰(zhàn)略時,慎用政府補貼,以免授人以柄,產(chǎn)生不必要的貿(mào)易爭端。
[Abstract]:The polluter pays principle is an important principle in environmental liability law and countervailing law in developed countries, which has been criticized a lot in developing countries. However, with the deterioration of the global environment, it is gradually accepted by the international community and has a certain impact on the WTO subsidy law. China should conform to the trend and use government subsidies carefully when formulating the development strategy of low-carbon economy so as to avoid giving people a handle and creating unnecessary trade disputes.
