信息約束與勞動(dòng)關(guān)系的柔性調(diào)節(jié):以勞動(dòng)標(biāo)準(zhǔn)為中心

【摘要】:勞動(dòng)關(guān)系的不平等性決定了公權(quán)主導(dǎo)型的調(diào)節(jié)模式。但我國(guó)面臨著勞動(dòng)者供給變動(dòng)、勞動(dòng)力分層、產(chǎn)業(yè)結(jié)構(gòu)失衡等問(wèn)題,需要層級(jí)化的勞動(dòng)關(guān)系調(diào)節(jié)模式以應(yīng)對(duì)勞動(dòng)關(guān)系的復(fù)雜狀況,而勞動(dòng)標(biāo)準(zhǔn)是實(shí)現(xiàn)勞動(dòng)關(guān)系柔性調(diào)節(jié)的重要機(jī)制。勞動(dòng)標(biāo)準(zhǔn)的制定和執(zhí)行以信息為基礎(chǔ)。信息的可觀察性是勞動(dòng)問(wèn)題上升為勞動(dòng)標(biāo)準(zhǔn)的重要條件,其基本要求是信息的低成本獲取、信息的穩(wěn)定呈現(xiàn)和不同主體對(duì)信息認(rèn)知的一致性。勞動(dòng)標(biāo)準(zhǔn)的執(zhí)行則需要滿足信息可檢驗(yàn)性的要求。應(yīng)當(dāng)回歸勞動(dòng)關(guān)系的契約屬性,發(fā)揮不同主體的信息優(yōu)勢(shì),識(shí)別和回應(yīng)不同層次勞動(dòng)者的利益訴求,分散勞動(dòng)標(biāo)準(zhǔn)的制定主體和執(zhí)行主體,增強(qiáng)勞動(dòng)關(guān)系調(diào)節(jié)的有效性。
[Abstract]:The inequality of labor relations determines the adjustment mode of public power. However, our country is facing some problems, such as the change of labor supply, the stratification of labor force, the imbalance of industrial structure and so on. It is necessary to adjust the labor relations at a hierarchical level in order to cope with the complex situation of labor relations. Labor standard is an important mechanism to realize flexible adjustment of labor relations. The formulation and implementation of labor standards is based on information. The observability of information is an important condition for labor problems to rise to labor standards. Its basic requirements are the low cost of information acquisition, the stable presentation of information and the consistency of different subjects' cognition of information. The implementation of labor standards needs to meet the requirements of information verifiability. We should return to the contractual attribute of labor relations, give full play to the information advantages of different subjects, identify and respond to the interests of workers at different levels, disperse the formulation and implementation of labor standards, and enhance the effectiveness of labor relations regulation.
