【摘要】：2013版《建設(shè)工程工程量清單計(jì)價(jià)規(guī)范》（GB50500-2013）的頒布與實(shí)施，加強(qiáng)了招標(biāo)控制價(jià)編制的強(qiáng)制性，工程量清單計(jì)價(jià)模式對(duì)于“市場(chǎng)”與“價(jià)格”的作用也得到了凸顯。隨著全球化物流的實(shí)現(xiàn)，關(guān)于物流倉(cāng)儲(chǔ)中心的規(guī)劃與設(shè)計(jì)水平正在逐步提高，對(duì)于這一類(lèi)項(xiàng)目的建設(shè)需求也隨之增加。然而在實(shí)際招投標(biāo)過(guò)程中，招標(biāo)人對(duì)招標(biāo)控制價(jià)編制的重視程度不夠，也缺乏科學(xué)合理的指導(dǎo)方法，從而導(dǎo)致招投標(biāo)過(guò)程中不正當(dāng)競(jìng)爭(zhēng)行為的發(fā)生。針對(duì)上述問(wèn)題，本文對(duì)物流倉(cāng)儲(chǔ)中心類(lèi)項(xiàng)目招標(biāo)控制價(jià)編制的合理性進(jìn)行研究，主要研究?jī)?nèi)容包括以下三個(gè)方面： 第一，通過(guò)對(duì)招投標(biāo)本質(zhì)以及清單計(jì)價(jià)模式發(fā)展情況的研究，分析招標(biāo)控制價(jià)產(chǎn)生的原因。根據(jù)文獻(xiàn)研究，，招標(biāo)控制價(jià)的產(chǎn)生是為解決“無(wú)標(biāo)底招標(biāo)”、“設(shè)標(biāo)底招標(biāo)”過(guò)程中產(chǎn)生的圍標(biāo)、串標(biāo)等問(wèn)題，但是對(duì)其深層次的社會(huì)學(xué)、經(jīng)濟(jì)學(xué)原因未給出合理的解釋說(shuō)明。本文結(jié)合招投標(biāo)的基本原理，對(duì)與招標(biāo)控制價(jià)的作用進(jìn)行深入的分析，明確招標(biāo)控制價(jià)產(chǎn)生的社會(huì)意義及經(jīng)濟(jì)學(xué)意義。招標(biāo)控制價(jià)的產(chǎn)生有利于實(shí)現(xiàn)“政府指導(dǎo)價(jià)格、企業(yè)自主報(bào)價(jià)、市場(chǎng)形成價(jià)格”的有序競(jìng)爭(zhēng)模式，從其本質(zhì)上講，具有規(guī)范競(jìng)爭(zhēng)，促進(jìn)市場(chǎng)體制健全的作用。 第二，以招標(biāo)控制價(jià)的作用為研究方向，將建設(shè)工程的主要相關(guān)要素：發(fā)包人、承包人、建設(shè)工程項(xiàng)目本身進(jìn)行關(guān)聯(lián)分析，從而深入剖析招標(biāo)控制價(jià)的作用及其背后的理論指導(dǎo)。首先對(duì)招標(biāo)控制價(jià)對(duì)于承包人與承包人之間競(jìng)爭(zhēng)的影響進(jìn)行分析，基于博弈論、信息不對(duì)稱(chēng)理論的基本原理，闡釋招標(biāo)控制價(jià)的設(shè)置程度對(duì)競(jìng)爭(zhēng)改善的影響及對(duì)信息不對(duì)稱(chēng)現(xiàn)象的緩解。其次對(duì)招標(biāo)控制價(jià)作為發(fā)包人的一種投資控制策略對(duì)承包人行為約束的作用進(jìn)行分析，基于委托代理理論確定招標(biāo)控制價(jià)的編制水平對(duì)于道德風(fēng)險(xiǎn)的預(yù)防和逆向選擇防止。最后對(duì)于招標(biāo)控制價(jià)對(duì)于合同狀態(tài)初始形成的影響及對(duì)于合同狀態(tài)變化的影響作用進(jìn)行分析，基于先合同義務(wù)理論研究招標(biāo)控制價(jià)的效力及其容納規(guī)則與歷史解釋原則適用的可能性。 第三，結(jié)合上述理論分析與物流倉(cāng)儲(chǔ)中心項(xiàng)目的特點(diǎn)，對(duì)同類(lèi)項(xiàng)目的招標(biāo)控制價(jià)決策依據(jù)及編制細(xì)節(jié)進(jìn)行分析，形成對(duì)于此類(lèi)項(xiàng)目招標(biāo)控制價(jià)編制的指導(dǎo)性結(jié)論。 通過(guò)上述研究確定某物流倉(cāng)儲(chǔ)中心招標(biāo)控制價(jià)編制的評(píng)價(jià)二級(jí)準(zhǔn)則，同時(shí)結(jié)合某物流倉(cāng)儲(chǔ)中心項(xiàng)目對(duì)各準(zhǔn)則進(jìn)行權(quán)重賦值，計(jì)算各準(zhǔn)則的綜合權(quán)重，得出該項(xiàng)目的招標(biāo)控制價(jià)的合理區(qū)間。在此區(qū)間內(nèi)對(duì)該項(xiàng)目招標(biāo)控制價(jià)編制過(guò)程中的工程量清單編制、項(xiàng)目特征描述、常規(guī)施工方案擬定及綜合單價(jià)確定等具體工作內(nèi)容進(jìn)行詳細(xì)說(shuō)明。
[Abstract]:The promulgation and implementation of "Construction quantity list valuation Code" (GB50500-2013) of 2013 edition has strengthened the compulsion of bidding control price establishment, and the effect of bill of quantities valuation mode on "market" and "price" has also been highlighted. With the realization of global logistics, the level of planning and design of logistics warehousing center is gradually improving, and the construction demand for this kind of project is also increasing. However, in the actual bidding process, the tenderers do not attach enough importance to the bidding control price preparation and lack of scientific and reasonable guidance methods, which lead to the occurrence of unfair competition in the bidding process. In view of the above problems, this paper studies the rationality of bidding control price of logistics storage center projects. The main contents of the study include the following three aspects: first, Through the study of the nature of bidding and the development of list pricing mode, the causes of bidding control price are analyzed. According to the literature research, the production of tender control price is to solve the problems of "bidding without base bidding" and "bidding with base bid", but the reason of economics has not given reasonable explanation for its deep-seated sociological and economic reasons, for example, the problem of besieging and collating bids in the process of "bidding without base bidding" and "setting base tender". Based on the basic principles of bidding, this paper makes a thorough analysis of the role of tender control price, and clarifies the social and economic significance of tender control price. The production of tender control price is conducive to the realization of the orderly competition mode of "government guiding price, enterprise bidding independently, market forming price". In essence, it has the function of standardizing competition and promoting the perfect market system. Secondly, taking the function of bidding control price as the research direction, the main relevant elements of the construction project: the contractor, the contractor and the construction project itself are analyzed by the association analysis. Thus in-depth analysis of the role of tender price control and behind the theoretical guidance. Firstly, the influence of bidding control price on the competition between contractor and contractor is analyzed. Based on the game theory and the basic principle of information asymmetry theory, the paper analyzes the influence of bidding control price on the competition between contractor and contractor. This paper explains the influence of the setting degree of tender control price on competition improvement and the alleviation of information asymmetry. Secondly, the role of bidding control price as an investment control strategy to contractor behavior restriction is analyzed. Based on the principal-agent theory, the preparation level of tender control price is determined to prevent moral hazard and adverse selection. Finally, the influence of tender control price on the initial formation of contract state and the change of contract state is analyzed. Based on the theory of pre-contract obligation, this paper studies the validity of tender control price, the possibility of its accommodation rule and the possibility of application of historical interpretation principle. Thirdly, combining the above-mentioned theoretical analysis and the characteristics of logistics storage center project, this paper analyzes the decision-making basis and compilation details of similar projects, and forms a guiding conclusion for the compilation of tender control price of this kind of project. According to the above-mentioned research, the evaluation criteria of bidding control price of a logistics warehouse center are determined. At the same time, the weight of each criterion is assigned according to the project of a logistics warehouse center, and the comprehensive weight of each criterion is calculated. The reasonable range of the tender control price of the project is obtained. In this section, the detailed work contents, such as drawing up the list of quantities, describing the characteristics of the project, drawing up the routine construction plan and determining the comprehensive unit price, etc. in the process of compiling the tender control price of the project are described in detail.
