【摘要】：食品是人民群眾日常生活中不可缺少的部分,食品安全與人民的切身利益息息相關(guān),保障食品安全是政府不可推卸的責(zé)任。近十年,我國(guó)發(fā)生了一些影響力很大的食品安全事件,舌尖上的安全已經(jīng)成為了人民群眾最為關(guān)心的問(wèn)題,同時(shí)也成為了人民群眾最為擔(dān)心的一件事情。這一方面體現(xiàn)了我國(guó)人民公民意識(shí)的提升,另一方面也反映了人民群眾對(duì)于我國(guó)食品安全環(huán)境的擔(dān)憂(yōu)。從眾多的事故中我們可以看出,今天的食品安全問(wèn)題已經(jīng)超出了傳統(tǒng)食品安全規(guī)定的范疇,已經(jīng)延伸到了整個(gè)食物鏈的各個(gè)環(huán)節(jié),并且有越來(lái)越多的新的、復(fù)雜的問(wèn)題不斷出現(xiàn),挑戰(zhàn)著我國(guó)對(duì)于食品安全的治理。而如今社會(huì)快速發(fā)展,科技日新月異,如何在尊重社會(huì)主義市場(chǎng)經(jīng)濟(jì)的主體地位和食品安全自身的發(fā)展規(guī)律的情況下,通過(guò)吸收先進(jìn)的治理理念和治理措施,把食品從生產(chǎn)到銷(xiāo)售的整個(gè)食品鏈完全納入科學(xué)的管理中來(lái),考驗(yàn)著我國(guó)各個(gè)食品安全參與主體的智慧。這不僅需要有扎實(shí)的理論研究、政府的有效規(guī)制、完善及有效的法律法規(guī),還需要政府把行業(yè)組織和消費(fèi)者的自治和監(jiān)督功能有效的開(kāi)發(fā)出來(lái)。 本文試圖通過(guò)對(duì)政府在食品安全中的責(zé)任進(jìn)行研究,來(lái)分析政府在食品安全中責(zé)任失范和缺失的問(wèn)題,探索我國(guó)政府如何通過(guò)采取有效的措施來(lái)解決其在食品安全中的責(zé)任失范和缺失現(xiàn)象,以滿(mǎn)足我國(guó)人民對(duì)食品安全的需求。本文主要有七個(gè)方面的內(nèi)容,第一部分為引言,主要介紹食品安全國(guó)內(nèi)外的研究現(xiàn)狀；第二部分為概念界定和理論基礎(chǔ)簡(jiǎn)介,為本文的寫(xiě)作理論基礎(chǔ)；第三部分為中國(guó)食品安全的現(xiàn)狀,對(duì)我國(guó)食品行業(yè)的總體發(fā)展,我國(guó)的食品安全現(xiàn)狀和我國(guó)食品安全的一些特點(diǎn)進(jìn)行總結(jié)和分析；第四部分是對(duì)政府在食品安全中的責(zé)任失范和缺失現(xiàn)象進(jìn)行研究,以期待發(fā)現(xiàn)問(wèn)題；第五部分為在食品安全中我國(guó)政府責(zé)任失范和缺失的原因分析,第六部分為完善我國(guó)政府履行其責(zé)任的對(duì)策,它以第四、五部分為基礎(chǔ),是在對(duì)第四、五部分進(jìn)行分析的基礎(chǔ)上對(duì)它提出合理的解決思路和建議；最后是結(jié)語(yǔ),通過(guò)前面的分析我們可以看出,要想從根本上解決政府在食品安全中責(zé)任失范和缺失的問(wèn)題,國(guó)家必須對(duì)我國(guó)的食品安全管理進(jìn)行一個(gè)全面總體的規(guī)劃,不斷的完善和健全各種政策制度,形成一個(gè)以社會(huì)主義市場(chǎng)經(jīng)濟(jì)信用體系和食品安全法律體系為基礎(chǔ)的,以政府有效監(jiān)管和食品行業(yè)組織的自律及民眾的廣泛參與為支柱的食品安全保障體系。
[Abstract]:Food is an indispensable part of people's daily life. Food safety is closely related to the vital interests of the people. It is the government's unshirkable responsibility to ensure food safety. In the past ten years, some influential food safety incidents have occurred in our country. The safety on the tip of the tongue has become the most concerned issue of the people, and it has also become the most worried thing of the people. On the one hand, it reflects the people's civic awareness, on the other hand, it also reflects the people's concern about our food safety environment. From the numerous accidents, we can see that today's food safety problems have gone beyond the scope of traditional food safety regulations, have extended to all parts of the food chain, and there are more and more new ones. The complex problem appears unceasingly, challenges our country to the food safety management. With the rapid development of society and the rapid development of science and technology, how to absorb advanced governance concepts and measures while respecting the dominant position of the socialist market economy and the development law of food safety itself, The whole food chain from production to sale is brought into the scientific management, which tests the wisdom of each food safety participant in our country. This not only needs solid theoretical research, government effective regulation, perfect and effective laws and regulations, but also needs the government to effectively develop the self-governance and supervision function of industry organizations and consumers. This paper attempts to analyze the problem of the government's responsibility in food safety by studying the responsibility of the government in food safety. This paper explores how our government can take effective measures to solve the problem of loss of responsibility in food safety in order to meet the needs of Chinese people for food safety. The first part is the introduction, which mainly introduces the current situation of food safety research at home and abroad, the second part is the definition of concept and the introduction of theoretical basis, which is the theoretical basis of this paper. The third part is the current situation of China's food safety, the overall development of China's food industry, the current situation of China's food safety and some characteristics of China's food safety are summarized and analyzed. The fourth part is to study the responsibility of the government in food safety and lack of standard phenomenon, in order to look forward to finding problems; The fifth part is the analysis of the reasons why the government responsibility of our country is out of order in the food safety. The sixth part is to perfect the countermeasures of our government to fulfill its responsibility. It is based on the fourth and fifth parts, and it is the fourth part. On the basis of the analysis of the five parts, the author puts forward some reasonable solutions and suggestions. Finally, the conclusion. We can see from the previous analysis that in order to fundamentally solve the problem of the government's loss of responsibility and lack of responsibility in food safety, the state must carry out a comprehensive overall plan for the management of food safety in our country. Constantly perfecting and perfecting various policy systems, forming a socialist market economy credit system and a food safety legal system as the basis, A food safety system supported by effective government regulation and self-regulation of food industry organizations and broad participation of the public.
