公共治理視角下食品安全社會監(jiān)管研究

【摘要】:民以食為天,食以安為先。食品安全不僅關系人民身體健康、經(jīng)濟健康發(fā)展以及社會和諧穩(wěn)定,而且關系國家和政府的形象,食品安全問題己經(jīng)成為公眾關注的社會問題。因此,對食品安全進行科學合理的監(jiān)管非常重要。而以往對食品安全監(jiān)管的研究主要是從政府和法律法規(guī)的角度探討的較多,而從多元主體合作進行社會性監(jiān)管的論述較為缺乏。 當然食品安全的社會監(jiān)管是一個很大的概念,本文主要運用公共治理理論、多中心治理理論及第三部門理論等,首先從法律、體制和主體等角度分析了我國食品安全社會監(jiān)管的現(xiàn)狀,并從現(xiàn)狀的分析中發(fā)現(xiàn)我國食品安全社會監(jiān)管存在一些問題和不足,并針對存在問題的原因進行了較為深入的分析;其次,以三鹿奶粉事件為案例,分析了美國、英國、日本等發(fā)達國家食品安全監(jiān)管的成功經(jīng)驗以及對我國食品安全監(jiān)管的借鑒;然后,本文在公共治理的視角下,,分別研究了政府、第三方力量以及食品生產(chǎn)企業(yè)在食品安全社會監(jiān)管中的具體角色定位。最后,針對社會監(jiān)管,文章從推行食品安全社會監(jiān)管的運作體系和構(gòu)建食品安全社會監(jiān)管的監(jiān)督制約體系兩個方面設計了公共治理視角下的食品安全社會監(jiān)管體系。 本文通過研究主要得出了結(jié)論:(1)我國食品安全社會監(jiān)管存在食品安全監(jiān)管法律不健全和監(jiān)管效率不高、公眾監(jiān)管乏力、社會中間層組織監(jiān)管失靈以及食品安全的輿論監(jiān)督不力等問題。(2)在公共治理的視角下,中央政府與地方政府的角色定位是合理配置地方政府與中央政府的監(jiān)管權(quán),保證各級地方政府權(quán)責一致,破除地方保護主義;第三方力量應當加強食品安全信息的流通和發(fā)布、督促食品企業(yè)進行自我監(jiān)督和約束、組織食品安全的研究、宣傳食品安全文化以及建立獎懲和糾紛解決機制;而食品生產(chǎn)企業(yè)則應當自我約束和自我監(jiān)管。(3)公共治理視角下食品安全社會監(jiān)管體系應當包括推行食品安全社會監(jiān)管的運作體系和構(gòu)建食品安全社會監(jiān)管的監(jiān)督制約體系。
[Abstract]:The people take food as the day, and food takes peace as the first. Food safety is not only related to the health of the people, the healthy development of economy and social harmony and stability, but also related to the image of the state and the government. Food safety has become a social issue of public concern. Therefore, scientific and reasonable supervision of food safety is very important. In the past, the research on food safety supervision is mainly from the angle of government, laws and regulations, but the discussion of social supervision from the cooperation of multiple subjects is relatively lacking. Of course, the social supervision of food safety is a very big concept. This paper mainly uses the theory of public governance, the theory of multi-center governance and the theory of the third sector. This paper analyzes the current situation of social supervision of food safety in China from the angle of system and subject, and finds out that there are some problems and deficiencies in the social supervision of food safety in China from the analysis of the present situation, and makes a deeper analysis of the reasons for the problems. Secondly, taking Sanlu milk powder incident as an example, this paper analyzes the successful experience of food safety supervision in developed countries, such as the United States, Britain, Japan and so on. The roles of government, third party and food production enterprises in the social supervision of food safety are studied. Finally, aiming at the social supervision, the article designs the food safety social supervision system from the perspective of public governance from two aspects: the implementation of the food safety social supervision system and the construction of the food safety social supervision and control system. The main conclusions of this paper are as follows: (1) Food safety supervision law is not perfect, supervision efficiency is not high, and public supervision is weak. In the perspective of public governance, the role of central government and local government is to allocate the supervision power of local government and central government reasonably. To ensure that local governments at all levels are consistent in their powers and responsibilities and to break down local protectionism; third party forces should strengthen the circulation and distribution of food safety information, urge food enterprises to conduct self-supervision and restraint, and organize food safety research. Promoting food safety culture and establishing mechanisms for reward and punishment and dispute resolution; Food production enterprises should self-discipline and self-regulation. (3) the social supervision system of food safety should include the operation system of carrying out social supervision of food safety and the supervision and restriction system of social supervision of food safety.
