昆明市住宅小區(qū)物業(yè)管理研究

【摘要】:物業(yè)管理起源于19世紀(jì)60年代的英國(guó),在西方發(fā)達(dá)國(guó)家已走過(guò)了150多年的歷程。自上世紀(jì)80年代,深圳市成立國(guó)內(nèi)第一家物業(yè)服務(wù)企業(yè)以來(lái),我國(guó)物業(yè)管理行業(yè)經(jīng)歷了從無(wú)到有、從小到大、從混亂到逐步規(guī)范的發(fā)展過(guò)程。作為一個(gè)新興的服務(wù)行業(yè),物業(yè)管理己成為城市管理、社區(qū)建設(shè)不可或缺的組成部分。但是鑒于我國(guó)正處計(jì)劃經(jīng)濟(jì)向市場(chǎng)經(jīng)濟(jì)全面深化改革的階段,住宅小區(qū)物業(yè)管理中政府、物業(yè)服務(wù)企業(yè)及物業(yè)所有人(或物業(yè)使用人)的權(quán)力、責(zé)任、義務(wù)并不明確,物業(yè)管理仍然存在諸多問(wèn)題,這些問(wèn)題能否得到妥善解決,直接影響著物業(yè)管理行業(yè)的健康發(fā)展和社會(huì)和諧穩(wěn)定。因此,本文以政府、企業(yè)、業(yè)主為立足點(diǎn),分析政府與物業(yè)服務(wù)企業(yè)、政府與物業(yè)所有人(或物業(yè)使用人)及業(yè)主委員會(huì)在住宅小區(qū)物業(yè)管理中的現(xiàn)狀及面臨的問(wèn)題。這些問(wèn)題是:政府對(duì)住宅小區(qū)熱點(diǎn)、難點(diǎn)問(wèn)題處置能力不強(qiáng),住宅物業(yè)管理行業(yè)發(fā)展整體水平不高,業(yè)主自治管理效果不理想。導(dǎo)致這些問(wèn)題產(chǎn)生的原因有三個(gè)層面:住宅小區(qū)物業(yè)管理法制建設(shè)不健全,政府對(duì)物業(yè)管理市場(chǎng)的監(jiān)督不完善,政府對(duì)公眾的物業(yè)消費(fèi)觀念缺乏引導(dǎo)。針對(duì)這些問(wèn)題,本文通過(guò)分析國(guó)內(nèi)外先進(jìn)的住宅物業(yè)管理模式、方法,總結(jié)可借鑒的經(jīng)驗(yàn),結(jié)合昆明市住宅小區(qū)物業(yè)管理的實(shí)際情況,提出政府在住宅物業(yè)管理中應(yīng)完善物業(yè)管理的法規(guī)建設(shè),完善物業(yè)服務(wù)企業(yè)資質(zhì)管理,完善物業(yè)管理招投標(biāo)制度,完善物業(yè)服務(wù)收費(fèi)管理辦法,暢通物業(yè)管理糾紛的解決途徑,構(gòu)建完善的監(jiān)督體系,加大物業(yè)管理人才的培養(yǎng)力度,引導(dǎo)公眾樹立正確的物業(yè)消費(fèi)觀念,加強(qiáng)對(duì)業(yè)主委員會(huì)的指導(dǎo)和服務(wù)等建議。以期達(dá)到政府與物業(yè)服務(wù)企業(yè)、業(yè)主共建和諧社區(qū)的最終目標(biāo)。
[Abstract]:Property management originated in England in the 1860s, and has gone through more than 150 years in the western developed countries. Since the establishment of the first domestic property service enterprise in Shenzhen in the 1980s, the property management industry in our country has experienced a process of development from nothing to existence, from small to large, from chaos to gradual standardization. As a new service industry, property management has become an indispensable part of urban management and community construction. However, in view of the stage of deepening the reform from planned economy to market economy, the rights, responsibilities and obligations of the government, property service enterprises and property owners (or property users) in residential property management are not clear. There are still many problems in property management. Whether these problems can be properly solved will directly affect the healthy development of the property management industry and social harmony and stability. Therefore, this article takes the government, the enterprise, the owner as the foothold, analyzes the government and the real estate service enterprise, the government and the property owner (or the property user) and the owner committee in the residential district property management present situation and the question which faces. These problems are: the government to the residential district hot spot, the difficult problem handling ability is not strong, the residential property management profession development overall level is not high, the owner autonomy management effect is not ideal. There are three reasons for these problems: the legal construction of residential district property management is not perfect, the government supervision of the property management market is not perfect, and the government lacks guidance to the public's concept of property consumption. In view of these problems, this paper analyzes the advanced domestic and foreign residential property management models, methods, summarizes the experience that can be used for reference, combined with the real situation of real estate management in residential district of Kunming. It is suggested that the government should perfect the legal construction of the property management, perfect the qualification management of the property service enterprises, perfect the bidding system of the property management, perfect the management method of the charge for the property service, and unblock the ways to resolve the disputes in the property management. To construct a perfect supervision system, to strengthen the training of property management talents, to guide the public to set up a correct concept of property consumption, to strengthen the guidance and service to the owners' committee, and so on. In order to achieve the final goal of the government and property service enterprises, owners to build a harmonious community.
