【摘要】：商事登記制度改革是我國現(xiàn)階段社會(huì)經(jīng)濟(jì)體制改革的熱點(diǎn)和重點(diǎn)。隨著我國市場經(jīng)濟(jì)的發(fā)展，行政管理體制的創(chuàng)新，以及文化觀念的變化，經(jīng)濟(jì)體制和社會(huì)管理體制改革持續(xù)深入，商事登記在制度設(shè)計(jì)方面的缺陷逐漸顯現(xiàn)。商事登記制度改革的生態(tài)性研究就是指研究既存的商事登記制度及其變革中的制度要素、制度運(yùn)作與社會(huì)環(huán)境及其相互作用關(guān)系，改造并促使商事登記制度自我演化實(shí)現(xiàn)平衡的研究。以商事制度改革社會(huì)生態(tài)研究為基礎(chǔ)和指導(dǎo)，進(jìn)一步推進(jìn)我國商事登記制度改革，構(gòu)建適應(yīng)我國國情的規(guī)范化、程序化、現(xiàn)代化的商事登記法律制度，對完善我國社會(huì)主義市場經(jīng)濟(jì)體制巨有重大的現(xiàn)實(shí)意義。本文的具體內(nèi)容如下： 首先是緒論部分，即關(guān)于本選題的來源、意義、研究現(xiàn)狀和創(chuàng)新點(diǎn)、研究思路、研究方法的綜述。 第一章，商事登記制度改革及其生態(tài)的學(xué)理分析，就現(xiàn)階段的熱點(diǎn)事件，商事登記制度改革及其試點(diǎn)作為切入點(diǎn)，剖析這一改革的背景、內(nèi)容、和意義，考察商事登記的內(nèi)涵、特點(diǎn)、功能，，確定商事登記行為的法律性質(zhì)和以及商事登記制度的價(jià)值取向。 第二章，國外商事登記模式及其社會(huì)生態(tài)比較研究，考察不同登記模式的代表國家社會(huì)生態(tài)方面的差異，以及對我國的啟示。 第三章，我國商事登記制度改革的政治生態(tài)研究，分析我國商事登記制度改革的政治生態(tài)環(huán)境，探討政府、社會(huì)組織、商事主體個(gè)人的權(quán)利，定位其角色，完善商事登記中的相關(guān)行為制度。 第四章，我國商事登記制度改革的經(jīng)濟(jì)生態(tài)研究，探究中國經(jīng)濟(jì)體制改革、市場經(jīng)濟(jì)模式的轉(zhuǎn)型、商主體自由經(jīng)營權(quán)的發(fā)展這些經(jīng)濟(jì)環(huán)境的改變對我國商事登記制度改革的影響以及制度完善。 第五章，我國商事登記制度改革的文化生態(tài)研究，探究傳統(tǒng)文化因素，表現(xiàn)在政府工作中的“官本位”文化、社會(huì)交往中的“關(guān)系”文化、以及商事主體個(gè)人“信用”文化對商事登記制度改革的影響以及制度完善。
[Abstract]:The reform of commercial registration system is the focus and focus of social economic system reform at present . With the development of market economy , the innovation of administrative management system , and the change of cultural idea , the reform of economic system and social management system has gradually appeared . The first is the introduction part , that is , the source , significance , research situation and innovation point , the research thinking and the research method of this topic . The first chapter , the reform of commercial registration system and its ecological theory analysis , analyzes the background , content and significance of the reform , analyzes the background , content and significance of the reform , investigates the connotation , characteristics and functions of the commercial registration , and determines the legal nature of the commercial registration behavior and the value orientation of the commercial registration system . The second chapter , the foreign business registration model and its social ecological comparison research , investigates the differences between the different registration patterns on behalf of the national social ecology , and the inspiration to our country . In the third chapter , we study the political ecology of the reform of commercial registration system in our country , analyze the political ecological environment of the reform of commercial registration system in our country , probe into the rights of the government , the society organization and the commercial subject , locate its role and perfect the relevant behavior system in the commercial registration . The fourth chapter , the economic and ecological study of the reform of the commercial registration system in China , explores the transformation of China ' s economic system , the transformation of the market economy model , the development of the business right of the commercial subject , and the influence of the changes of the economic environment on the reform of the commercial registration system in China and the perfection of the system . The fifth chapter , the cultural ecology research of the reform of the commercial registration system in our country , explores the traditional cultural factors , displays the " relation " culture in the government work , the " relation " culture in the social intercourse , and the influence of the individual " credit " culture on the reform of the commercial registration system and the perfection of the system .
