【摘要】：食品安全關(guān)乎廣大人民群眾的身體健康和生命安全，關(guān)乎經(jīng)濟(jì)健康發(fā)展和社會(huì)穩(wěn)定，關(guān)乎黨和政府形象。當(dāng)前，我國已進(jìn)入全面建成小康社會(huì)的決定性階段，群眾對(duì)食品安全有更高要求和期待。但食品安全工作基礎(chǔ)仍很薄弱，違法違規(guī)行為時(shí)有發(fā)生，重大風(fēng)險(xiǎn)隱患依然存在，制約食品安全的深層次問題尚未得到根本解決，形勢不容樂觀，挑戰(zhàn)十分嚴(yán)峻。 構(gòu)建食品安全誠信監(jiān)管體系主要突出了食品監(jiān)管主客體的誠信倫理約束性，抓住了“誠信為本”的核心地位，體現(xiàn)了社會(huì)治理和食品安全監(jiān)管領(lǐng)域的時(shí)代要求。研究和探索食品安全監(jiān)管領(lǐng)域的誠信監(jiān)管體系機(jī)制是順應(yīng)時(shí)代要求，與時(shí)俱進(jìn)的必然趨勢，是對(duì)既有食品安全監(jiān)管模式的深化和補(bǔ)充，特別是對(duì)當(dāng)前我國面臨的食品安全信任危機(jī)和發(fā)展困境，以及食品安全監(jiān)管中存在的盲區(qū)和薄弱環(huán)節(jié)，具有較強(qiáng)的指導(dǎo)性、現(xiàn)實(shí)性、針對(duì)性和引領(lǐng)性，對(duì)于我們進(jìn)一步完善食品安全監(jiān)管體制，提升食品安全監(jiān)管水平具有十分重要的理論實(shí)踐意義。 食品安全誠信監(jiān)管的關(guān)鍵在于對(duì)食品安全誠信信息的梳理匯總，可以面對(duì)社會(huì)公開誠信信息，監(jiān)管部門以及社會(huì)各界的誠信監(jiān)督、管理是形成市場主體自我約束的重要手段，落實(shí)失信懲戒，，強(qiáng)化守信激勵(lì)等，形成一系列制度機(jī)制，從根本上強(qiáng)化對(duì)食品市場主體及其行為的誠信約束。食品安全事件不僅嚴(yán)重危害人民身體健康，更嚴(yán)重?fù)p害了人們的道德底線和政府的公信力，必須將食品安全誠信體系建立起來，從根本上為食品安全監(jiān)管提供有力保障。本文從食品安全監(jiān)管視角下，以構(gòu)建食品安全誠信監(jiān)管體系為根本目標(biāo)，借鑒銀行、證券、保險(xiǎn)等行業(yè)誠信監(jiān)管經(jīng)驗(yàn)，通過分析不同的監(jiān)管模式、以及由不同的但較為單一的監(jiān)管方式所引發(fā)的各種食品安全問題，進(jìn)一步挖掘誠信監(jiān)管這個(gè)內(nèi)在的治本辦法，并利用信息化條件下的技術(shù)優(yōu)勢，充分整合政府、企業(yè)、公民三者監(jiān)管資源，建設(shè)一個(gè)行政適度、法律完備、制度科學(xué)、標(biāo)準(zhǔn)統(tǒng)一、監(jiān)督有效、多方參與、可操作性較強(qiáng)的食品安全誠信監(jiān)管體系，營造信息化技術(shù)手段支持下的食品安全社會(huì)共治新局面。 本文綜合運(yùn)用馬克思主義政治學(xué)、哲學(xué)以及相關(guān)學(xué)科的原理、經(jīng)濟(jì)學(xué)、管理學(xué)、倫理學(xué)、法學(xué)、心理學(xué)、行為科學(xué)等相關(guān)學(xué)科知識(shí)，立足當(dāng)前食品安全監(jiān)管實(shí)際，以《中華人民共和國食品安全法》、《食品安全法實(shí)施條例》和《產(chǎn)品質(zhì)量法》為法規(guī)依據(jù)，以探索構(gòu)建我國食品安全誠信監(jiān)管體系為出發(fā)點(diǎn)和歸宿點(diǎn)，對(duì)如何構(gòu)設(shè)食品安全誠信監(jiān)管框架問題進(jìn)行了深入的研究探討。 全文共分四部分:第一部分是相關(guān)概念界定，厘清了食品安全、誠信監(jiān)管，食品安全誠信監(jiān)管等有關(guān)概念，分析了食品安全誠信監(jiān)管的基本特性，并對(duì)食品安全誠信監(jiān)管各要素進(jìn)行了較為系統(tǒng)的闡述和概括，形成了食品安全誠信監(jiān)管較為清晰的邏輯架構(gòu)，明確了誠信監(jiān)管的特殊性和一般性，突出其在食品安全監(jiān)管領(lǐng)域中的根本性地位。主要是從長效監(jiān)管機(jī)制、企業(yè)道德建設(shè)、政府監(jiān)管效能和社會(huì)道德風(fēng)尚四個(gè)方面，反映出誠信監(jiān)管是符合食品事業(yè)發(fā)展規(guī)律、順應(yīng)人心向背、完善體制機(jī)制、推動(dòng)行業(yè)發(fā)展的客觀需要和必然選擇，是食品安全監(jiān)管模式轉(zhuǎn)變的方向標(biāo)，具有重大的現(xiàn)實(shí)意義，對(duì)當(dāng)前和今后食品安全監(jiān)管產(chǎn)生深遠(yuǎn)的影響；第二部分主要是調(diào)查分析了我國食品安全誠信監(jiān)管建設(shè)現(xiàn)狀，查找存在的問題，透析問題背后深層次原因，找到問題癥結(jié)之所在；第三部分以誠信監(jiān)管為考察對(duì)象，借鑒其他行業(yè)較為成熟的理論和實(shí)踐，主要是吸收和借鑒銀行業(yè)、證券業(yè)、保險(xiǎn)業(yè)領(lǐng)域誠信監(jiān)管思路和經(jīng)驗(yàn)，探索構(gòu)建食品安全誠信監(jiān)管的運(yùn)行模式和制度機(jī)制；第四部分主要是結(jié)合實(shí)際分析構(gòu)建食品安全誠信監(jiān)管應(yīng)把握好的幾個(gè)問題，主要包括指導(dǎo)思想和監(jiān)管目標(biāo)、基本原則和具體措施，其中最重要的就是通過依靠食品安全誠信監(jiān)管“4G誠信碼”網(wǎng)絡(luò)化全民監(jiān)督系統(tǒng)來實(shí)現(xiàn)監(jiān)管各要素的有機(jī)銜接，真正將其作為一個(gè)有效的誠信監(jiān)管體系平臺(tái)，整合政府、企業(yè)、社會(huì)資源，在形成合力提升監(jiān)管質(zhì)量上有所突破，最終達(dá)到社會(huì)共治格局的形成。
[Abstract]:Food safety concerns people's health and life safety, related to the healthy development of economy and social stability, related to the image of the party and the government. At present, China has entered the decisive stage of building a moderately prosperous society, people have higher requirements and expectations on food safety and food safety work. But the base is still very weak, illegal behavior have occurred, major risks still exist, the deep-seated problems restricting food safety has not been fundamentally resolved, the situation is not optimistic, the challenge is very grim.
The construction of food safety credit supervision system highlights the ethical constraints of food supervision and object, to seize the core of good faith ", embodies the social governance in the field of food safety supervision and the requirements of the times. The integrity of supervision system of mechanism research and exploration in the field of food safety supervision is to comply with the requirements of the times, the inevitable trend of the times. Is to deepen the existing food safety supervision mode and supplement, especially on food safety trust crisis facing our country and the development dilemma, and blind spots exist in food safety supervision and the weak link, with guidance, practical, targeted and guidance, for us to further improve food safety supervision system has very important theoretical and practical significance to enhance the level of food safety regulation.
The key lies in the integrity of the food safety supervision on food safety integrity information combing summary, can face the public credit information, supervision departments and the community supervision and management is an important means of market subject form of self restriction, the implementation of punishment, strengthen credit incentive, forming a series of institutional mechanisms, strengthening the integrity constraints on the food market the subject and behavior fundamentally. Food safety accidents not only seriously endanger people's health, more serious damage to the credibility of the government and the people's moral bottom line, must be set up the food safety credit system, fundamentally to provide a strong guarantee for food safety supervision. From the view of food safety supervision, the construction of food safety the integrity of supervision system as the basic goal, from the bank, securities, insurance and other industries credit supervision experience, through the analysis of different supervision mode Well, but caused by different single regulatory approach of various food safety issues, to further tap the supervision of this internal fundamental measures, and taking advantage of the technology under conditions of informatization, the full integration of government, enterprises, citizens of the three regulatory resources, the construction of a complete system of administrative law, moderate, scientific, standard and unified supervision, effective, participatory, strong operational integrity of the food safety supervision system, food security and create social support information technology under the new situation of governance.
This paper uses Marx's politics, principle, philosophy and related disciplines of economics, management, ethics, law, psychology, behavioral science and other related knowledge, based on the current situation of food safety supervision in People's Republic of China "food safety law", "food safety regulations" and "product quality law" as the basis for the implementation of laws and regulations to explore the construction of supervision system, the integrity of the food safety in China is the starting point and end point on how to design the integrity of the food safety regulatory framework discussed in-depth research.
The full text is divided into four parts: the first part is the definition of related concepts, clarify the supervision of food safety, integrity, the integrity of the food safety supervision and other related concepts, analyzes the basic characteristics of the integrity of the food safety supervision, and all elements of the integrity of the food safety supervision carried out a systematic exposition and summary, formed the integrity of the food safety regulatory framework clearly, the particularity and generality of regulatory integrity, outstanding in the field of food safety supervision in the fundamental position. Mainly from the long-term supervision mechanism, the construction of business ethics, four aspects of the effectiveness of government regulation and social morality, reflects the credit regulation is in accordance with the law, the development of food to the public attitude for or against. Improve the institutional mechanisms, the objective need and inevitable choice to promote the development of the industry, is to change the direction of food safety supervision mode, is of great practical significance, for when Have a profound impact and future food safety supervision; the second part is the investigation and analysis of the present situation of the construction of the integrity of the food safety supervision in China, find the problems, analysis about the deep reasons behind, to find the crux of the problem; the third part of the credit supervision as the object of study, learn from other industry theory and practice are more mature, the main is to absorb and draw lessons from the banking industry, securities industry, insurance industry supervision ideas and experience, explore the operation mode and the system mechanism to build the integrity of the food safety supervision; the fourth part is the practical analysis of several problems of building the integrity of the food safety supervision should grasp, mainly including the guiding ideology and regulatory objectives, basic principles and concrete one of the most important measures is to rely on the integrity of the food safety supervision "4G integrity code" network of national supervision system to realize. The organic connection of all elements can really serve as an effective platform for integrity supervision system, integrate government, enterprises and social resources, and break through in the resultant efforts to improve the quality of supervision, and finally achieve the formation of social co governance pattern.
