【摘要】：隨著知識經(jīng)濟時代的到來,知識產(chǎn)權(quán)對經(jīng)濟增長和產(chǎn)業(yè)競爭力提升發(fā)揮著越來越重要的作用,推動知識產(chǎn)權(quán)轉(zhuǎn)化為現(xiàn)實生產(chǎn)力已成為驅(qū)動我國經(jīng)濟發(fā)展的重要任務之一。國防知識產(chǎn)權(quán)是國防科技創(chuàng)新的重要成果,不僅能夠加快轉(zhuǎn)變戰(zhàn)斗力生成模式,還蘊含著巨大的經(jīng)濟潛力。然而,當前我國國防知識產(chǎn)權(quán)交易水平與經(jīng)濟社會發(fā)展需求存在一定差距,大量國防知識產(chǎn)權(quán)停留在一次性任務應用,甚至作為技術(shù)儲備被束之高閣,創(chuàng)新驅(qū)動效應不明顯,還處在從發(fā)展拉動創(chuàng)新向創(chuàng)新驅(qū)動發(fā)展的過渡階段。因此,必須加緊研究推進國防知識產(chǎn)權(quán)交易的方式方法。本文基于交易成本經(jīng)濟學,從治理的角度研究了如何推動國防知識產(chǎn)權(quán)交易的問題。治理的目的在于構(gòu)建合適的體制機制,保障國防知識產(chǎn)權(quán)交易更好地進行。以國防知識產(chǎn)權(quán)交易為分析對象,從交易主體之間的相互關(guān)系入手,逐步構(gòu)建出適用于多樣化國防知識產(chǎn)權(quán)交易治理體系。主要研究內(nèi)容包括:1、國防知識產(chǎn)權(quán)及其交易本質(zhì)研究。首次提出國防知識產(chǎn)權(quán)具有資本屬性,具有保值增值的本質(zhì)特征。推動國防知識產(chǎn)權(quán)交易的重要價值在于讓國防知識產(chǎn)權(quán)在參與生產(chǎn)經(jīng)營的過程中實現(xiàn)保值增值,并激勵創(chuàng)新,最終驅(qū)動經(jīng)濟社會發(fā)展。其驅(qū)動作用不僅表現(xiàn)為提高戰(zhàn)斗力和加快轉(zhuǎn)變戰(zhàn)斗力生成模式,還在于驅(qū)動經(jīng)濟增長。但定量分析表明,當前我國國防知識產(chǎn)權(quán)轉(zhuǎn)化的驅(qū)動效應不明顯,因此需要研究如何對國防知識產(chǎn)權(quán)交易進行治理。2、國防知識產(chǎn)權(quán)交易系統(tǒng)分析研究。國防知識產(chǎn)權(quán)交易方式的實質(zhì)是制度安排,本文詳細分析了國防知識產(chǎn)權(quán)轉(zhuǎn)化的交易主體、交易關(guān)系、交易現(xiàn)狀和制度環(huán)境,提出了國防知識產(chǎn)權(quán)轉(zhuǎn)化的四種交易屬性:保密性、資產(chǎn)專用性、不確定性和交易頻率,其中保密性是國防知識產(chǎn)權(quán)轉(zhuǎn)化交易與其他交易相異的首要屬性。3、國防知識產(chǎn)權(quán)交易的四種治理結(jié)構(gòu)研究。分析表明,為降低國防知識產(chǎn)權(quán)交易的交易成本,治理結(jié)構(gòu)必須與交易屬性相匹配,根據(jù)國防知識產(chǎn)權(quán)交易的交易屬性,將國防知識產(chǎn)權(quán)交易的治理結(jié)構(gòu)劃分為:市場治理、科層治理、雙方治理和三方治理四種,從而創(chuàng)造性地構(gòu)建出多樣化的國防知識產(chǎn)權(quán)交易治理體系。四種治理結(jié)構(gòu)同時存在、各有特點,是相互競爭和相互替代的組織資源配置方式。不同的治理結(jié)構(gòu)不存在本質(zhì)上的優(yōu)劣,只有與國防知識產(chǎn)權(quán)交易的交易屬性相匹配的治理結(jié)構(gòu)才是適用的。針對每種治理結(jié)構(gòu)的特點和不足,本文通過系統(tǒng)分析、案例分析、建立數(shù)理模型、博弈模型等方法,提出了完善的相關(guān)辦法。
