【摘要】：以專(zhuān)利執(zhí)行保險(xiǎn)為代表的知識(shí)產(chǎn)權(quán)保險(xiǎn),其功能在于分擔(dān)中小企業(yè)維權(quán)過(guò)程中的訴訟成本,降低或分散企業(yè)維權(quán)風(fēng)險(xiǎn)。隨著政府對(duì)專(zhuān)利執(zhí)行保險(xiǎn)推廣力度的加強(qiáng),作為市場(chǎng)創(chuàng)新主體的企業(yè)并未對(duì)該產(chǎn)品表現(xiàn)出濃厚的興趣,使得該保險(xiǎn)遭遇推廣困境。通過(guò)分析發(fā)現(xiàn),專(zhuān)利執(zhí)行保險(xiǎn)的功能局限以及我國(guó)專(zhuān)利質(zhì)量普遍不高,是造成上述困境的主要原因�；诖�,提出完善立法、優(yōu)化專(zhuān)利保險(xiǎn)產(chǎn)品結(jié)構(gòu)、提高專(zhuān)利從業(yè)人員素質(zhì)等政策建議。
[Abstract]:The function of the intellectual property insurance , which is represented by the patent application insurance , is to share the litigation cost , reduce or disperse the risk of the enterprise ' s rights . As the government strengthens the patent execution insurance promotion , the enterprise as the subject of market innovation does not show a strong interest in the product , which makes the insurance encounter the popularization predicament . Based on this , it is the main reason for the above predicament . Based on this , the author puts forward some policy suggestions to perfect the legislation , optimize the structure of the patent insurance product and improve the quality of patent practitioners .
