國(guó)有企業(yè)建筑工程施工勞務(wù)分包管理機(jī)制研究

【摘要】:改革開(kāi)放以來(lái),我國(guó)建筑業(yè)在國(guó)民經(jīng)濟(jì)發(fā)展中起到了舉足輕重的作用。但由于目前我國(guó)建筑勞務(wù)市場(chǎng)建設(shè)尚不完善、勞務(wù)分包企業(yè)風(fēng)險(xiǎn)抵抗能力較差、政府建管部門(mén)在實(shí)踐中更多的選擇通過(guò)對(duì)建筑施工企業(yè)的約束來(lái)規(guī)范勞務(wù)分包經(jīng)濟(jì)活動(dòng)等原因,使得如何構(gòu)建有效的建筑施工企業(yè)勞務(wù)分包管理機(jī)制成為亟需解決的問(wèn)題。國(guó)家統(tǒng)計(jì)數(shù)據(jù)顯示,2015年國(guó)有及國(guó)有控股建筑業(yè)企業(yè)以8.4%的企業(yè)數(shù)量、21%的人數(shù),完成了全國(guó)建筑業(yè)30%的產(chǎn)值、26%的施工面積,反映出國(guó)有及國(guó)有控股建筑業(yè)企業(yè)總體上無(wú)論在企業(yè)規(guī)模還是用工效率方面都走在了我國(guó)建筑行業(yè)的前列,為此在現(xiàn)階段通過(guò)對(duì)國(guó)有建筑工程施工企業(yè)的勞務(wù)分包管理機(jī)制進(jìn)行研究的可借鑒意義較強(qiáng),有助于為我國(guó)整個(gè)建筑行業(yè)勞務(wù)分包管理機(jī)制的研究提供一定的參考作用。本論文結(jié)合我國(guó)建筑工程施工行業(yè)的代表企業(yè)—中建三局集團(tuán)有限公司轄屬某三級(jí)分公司的勞務(wù)分包管理機(jī)制進(jìn)行了實(shí)證研究分析,主要完成以下工作:1)簡(jiǎn)要闡述了論文研究的背景、意義、國(guó)內(nèi)外關(guān)于勞務(wù)分包管理機(jī)制方面研究的現(xiàn)狀以及本論文的主要研究思路;2)對(duì)勞務(wù)分包管理機(jī)制的含義進(jìn)行了界定,針對(duì)政府和企業(yè)在勞務(wù)分包管理實(shí)踐中的主要管理機(jī)制內(nèi)容—?jiǎng)趧?wù)分包組織形式、勞務(wù)分包合同審查、勞務(wù)工人工資支付、勞務(wù)分包計(jì)價(jià)等進(jìn)行了較為詳細(xì)的歸納和分析,總結(jié)了目前勞務(wù)分包經(jīng)濟(jì)管理活動(dòng)中常見(jiàn)的糾紛,并分析了本論文研究的必要性;3)結(jié)合中建三局集團(tuán)有限公司轄屬某三級(jí)分公司在實(shí)踐中的企業(yè)層級(jí)和項(xiàng)目部?jī)杉?jí)勞務(wù)分包管理機(jī)制進(jìn)行了詳細(xì)分析,并分別探討了兩級(jí)機(jī)制在現(xiàn)階段勞務(wù)分包糾紛中的實(shí)效性;4)對(duì)本論文的研究結(jié)論進(jìn)行了總結(jié),以期為我國(guó)建筑工程行業(yè)勞務(wù)分包管理機(jī)制的設(shè)計(jì)與發(fā)展提供一定的借鑒作用。
[Abstract]:Since the reform and opening up, China's construction industry has played a pivotal role in the development of the national economy. However, because the construction of construction labor market in our country is not perfect at present, the ability of labor subcontracting enterprises to resist risks is poor, the government construction and management departments choose more to regulate the economic activities of labor subcontracting through the restriction of construction enterprises in practice, and so on. It is urgent to solve the problem of how to construct an effective management mechanism of labor subcontracting in construction enterprises. State statistics show that in 2015, state-owned and state-controlled construction enterprises, with 8.4 percent of the total number of enterprises or 21 percent of the total number of enterprises, completed 30 percent of the output value of the national construction industry and 26 percent of the construction area. It reflects that the state-owned and state-owned holding construction enterprises are in the forefront of the construction industry in our country, both in terms of enterprise size and employment efficiency. Therefore, it is of great significance to study the management mechanism of labor subcontracting in state-owned construction enterprises at the present stage, which is helpful to the study of the management mechanism of labor subcontracting in the whole construction industry of our country. This paper has carried on the empirical research and analysis on the labor subcontracting management mechanism of a three-level branch company under the jurisdiction of China Construction third Bureau Group Co., Ltd, the representative enterprise of the construction industry of our country. The main work below: (1) briefly describes the background, significance, domestic and foreign research on the management mechanism of labor subcontracting, and the main research ideas of this paper; 2) defining the meaning of labor subcontracting management mechanism, aiming at the main management mechanism contents of government and enterprise in the practice of labor subcontracting management, such as the organization form of labor subcontracting, the examination of labor subcontracting contract, the wage payment of labor workers, etc. This paper summarizes the common disputes in the economic management activities of labor subcontracting, and analyzes the necessity of the research in this paper. 3) in combination with the enterprise level and project department level labor subcontracting management mechanism of a third grade branch under the jurisdiction of China Construction third Bureau Group Co., Ltd., is analyzed in detail. The paper also discusses the effectiveness of the two-level mechanism in the labor subcontracting dispute at the present stage) and summarizes the conclusions of this paper in order to provide some reference for the design and development of the labor subcontracting management mechanism in the construction engineering industry of our country.
