【摘要】：隨著我國建筑業(yè)的蓬勃發(fā)展,建筑市場運行逐漸規(guī)范化�！督ㄔO(shè)工程施工合同》是工程建設(shè)發(fā)包人與承包人的行為準(zhǔn)則,其內(nèi)容決定合同當(dāng)事人之間風(fēng)險分配原則�，F(xiàn)實中,承包人經(jīng)過長期的實踐,積累了豐富的合同風(fēng)險管理經(jīng)驗,善于使用施工合同維護自身合法權(quán)益,而發(fā)包人仍舊依賴地位優(yōu)勢卻疏忽于合同風(fēng)險管理,容易導(dǎo)致自身損失。發(fā)包人須注重合同風(fēng)險管理,維護自身權(quán)益。本論文風(fēng)險管理研究是以發(fā)包人為研究對象,以新版《建設(shè)工程施工合同(示范文本)》為研究基礎(chǔ),以風(fēng)險識別、風(fēng)險評價、風(fēng)險應(yīng)對為研究路線。首先文章詳細(xì)剖析新版《建設(shè)工程施工合同(示范文本)》條款,為論文研究奠定理論基礎(chǔ),應(yīng)用風(fēng)險分解結(jié)構(gòu)整合發(fā)包人合同風(fēng)險因素匯總表,形成遞階結(jié)構(gòu),建立基于新版《建設(shè)工程施工合同(示范文本)》的發(fā)包人合同風(fēng)險評價指標(biāo)體系;然后結(jié)合該指標(biāo)體系,應(yīng)用層次分析法與模糊綜合評價法構(gòu)建風(fēng)險模糊綜合評價模型,評價《建設(shè)工程施工合同》整體風(fēng)險水平,并且經(jīng)過實例分析驗證了該模型的實用性;最后本文針對風(fēng)險指標(biāo)提出風(fēng)險應(yīng)對措施,風(fēng)險應(yīng)對措施主要以《建設(shè)工程施工合同(示范文本)》為核心,力求主要通過補充完善合同內(nèi)容以達(dá)到降低發(fā)包人合同風(fēng)險的目的。
[Abstract]:With the vigorous development of the construction industry in China, the construction market is gradually standardized. Construction contract is the code of conduct between the contractor and the contractor, and its content determines the principle of risk distribution among the parties to the contract. After a long period of practice, the contractor has accumulated rich experience in contract risk management, and is good at using construction contracts to safeguard his legitimate rights and interests, while the contractor still relies on the advantages of status but neglects contract risk management. It is easy to lead to own loss. The contractor should pay attention to contract risk management and safeguard his own rights and interests. The research on risk management in this paper is based on the new edition of Construction contract (Model text). This paper takes risk identification, risk evaluation and risk response as the research route. First of all, the article analyzes in detail the terms of the new edition of "Construction contract (Model text)" in order to lay a theoretical foundation for the research of this paper. Applying the risk decomposition structure to integrate the contractor contract risk factors summary table, form the hierarchical structure, establish the contract risk evaluation index system based on the new edition of construction contract (model text), and then combine the index system, The risk fuzzy comprehensive evaluation model is constructed by using AHP and fuzzy comprehensive evaluation method to evaluate the overall risk level of construction contract. The practicability of the model is verified by an example. Finally, this paper puts forward the risk response measures for the risk indicators, the risk response measures are mainly "construction contract (model text)" as the core, mainly through the completion of the contract content to achieve the purpose of reducing the contract risk of the contractor.
