【摘要】：為確保農(nóng)地抵押貸款可持續(xù)發(fā)展,必須首先保障抵押權(quán)益;在規(guī)模經(jīng)營抵押農(nóng)地的使用權(quán)收益等于小農(nóng)戶農(nóng)地的經(jīng)營權(quán)收益的前提下,要在農(nóng)地收益中最大化實(shí)現(xiàn)規(guī)模經(jīng)營農(nóng)地抵押權(quán)益,會導(dǎo)致承包農(nóng)戶失去承包財產(chǎn)權(quán)及其權(quán)益(失權(quán)失利)。通過構(gòu)建五權(quán)分置模式并分析三權(quán)分置與五權(quán)分置的權(quán)益匹配關(guān)系、權(quán)益保障優(yōu)先序與權(quán)益量化對應(yīng)模式,發(fā)現(xiàn)它們都不能同時保障承包財產(chǎn)權(quán)益、抵押權(quán)益與使用權(quán)益。為保護(hù)農(nóng)戶承包財產(chǎn)權(quán)益,需要試點(diǎn)被處置規(guī)模經(jīng)營抵押農(nóng)地承包權(quán)與所有權(quán)轉(zhuǎn)讓,優(yōu)化農(nóng)地權(quán)益結(jié)構(gòu):一是允許農(nóng)民向銀行抵押并轉(zhuǎn)讓承包權(quán),獲得承包權(quán)交易收益(保利失權(quán));二是將農(nóng)村集體組織農(nóng)地所有權(quán)短期轉(zhuǎn)讓給承包農(nóng)戶(保權(quán)失利);三是將農(nóng)村集體組織農(nóng)地所有權(quán)短期轉(zhuǎn)讓給承包農(nóng)戶,承包農(nóng)戶獲得承包權(quán)交易收益(保權(quán)保利)。
[Abstract]:In order to ensure the sustainable development of agricultural land mortgage loan, we must first protect the mortgage rights and interests, under the premise that the income of the right to use the mortgaged farmland on a scale is equal to the income of the management right of the agricultural land of small farmers. If we want to maximize the income of farmland and realize the mortgage rights and interests of farmland management on a large scale, it will lead to the loss of contracted property rights and their rights and interests of contracted farmers. Through the construction of the five-right split structure model and the analysis of the matching relationship between the three-right split structure and the five-right split structure, it is found that both of them can not guarantee the rights and interests of contracted property, mortgage rights and use rights at the same time, and the corresponding models of priority order of rights and interests and quantification of rights and interests are found. In order to protect the rights and interests of peasant households contracted property, it is necessary to carry out the contract right and ownership transfer of mortgaged farmland on a pilot disposal scale, and to optimize the structure of farmland rights and interests: first, to allow farmers to mortgage and transfer contract rights to banks, Gains from the transaction of contract rights (loss of the right to interest; second, short-term transfer of ownership of rural collective organization agricultural land to contracted farmers; third, short-term transfer of ownership of rural collective organization agricultural land to contracted farmers; Contract farmers to obtain contract rights trading proceeds (to protect rights and interests).
