【摘要】:網(wǎng)絡(luò)金融在現(xiàn)代經(jīng)濟(jì)中發(fā)揮著十分重要的作用,其萌芽于互聯(lián)網(wǎng)應(yīng)用的初期階段,早期網(wǎng)絡(luò)金融的特點(diǎn)為金融機(jī)構(gòu)的網(wǎng)絡(luò)化,即借助互聯(lián)網(wǎng)的連接功能實(shí)現(xiàn)各金融機(jī)構(gòu)間的交流與聯(lián)系,在一定程度上突破了時(shí)間和空間的限制,但由于受到網(wǎng)絡(luò)信息技術(shù)、市場(chǎng)及人們對(duì)網(wǎng)絡(luò)金融認(rèn)可度等方面的影響,其發(fā)展程度與發(fā)展速度受到了限制。隨著網(wǎng)絡(luò)金融的不斷進(jìn)步,互聯(lián)網(wǎng)金融業(yè)進(jìn)步了發(fā)展階段,該階段注重互聯(lián)網(wǎng)公司的金融化,大量的利用大數(shù)據(jù)手段,為網(wǎng)絡(luò)金融的發(fā)展注入了更為強(qiáng)大的動(dòng)力。到今天,網(wǎng)絡(luò)金融更為注意平臺(tái)的建設(shè),通過(guò)網(wǎng)絡(luò)金融平臺(tái)的建設(shè),滿足了在越來(lái)越多金融產(chǎn)品推出情況下的集成需要,能夠更好的實(shí)現(xiàn)對(duì)資源的整合,發(fā)揮網(wǎng)絡(luò)金融整體性的特點(diǎn)。我國(guó)的網(wǎng)絡(luò)金融開(kāi)端于招商銀行于1997年設(shè)立的第一家網(wǎng)絡(luò)銀行①。此后,傳統(tǒng)的機(jī)構(gòu)便開(kāi)始利用網(wǎng)絡(luò)信息技術(shù)與網(wǎng)絡(luò)平臺(tái),相繼建立自己的網(wǎng)絡(luò)銀行,開(kāi)展自己的網(wǎng)上業(yè)務(wù),我國(guó)的網(wǎng)絡(luò)金融進(jìn)入了發(fā)展階段。隨著網(wǎng)絡(luò)技術(shù)的日新月異,時(shí)至今日,網(wǎng)絡(luò)金融市場(chǎng)更加的繁榮,其突破了時(shí)空限制,發(fā)揮了透明性、辦公無(wú)紙化、相互間交流更為密切的特點(diǎn),金融產(chǎn)品越來(lái)越多樣,網(wǎng)絡(luò)金融市場(chǎng)越來(lái)越繁榮,在經(jīng)濟(jì)發(fā)展中的作用也更為突出。然而,面對(duì)發(fā)展勢(shì)頭如此強(qiáng)勁的網(wǎng)絡(luò)金融,我國(guó)的網(wǎng)絡(luò)金融監(jiān)管卻存在著問(wèn)題與不足,主要表現(xiàn)在網(wǎng)絡(luò)金融監(jiān)管法律體系不健全,沒(méi)有完整的市場(chǎng)準(zhǔn)入標(biāo)準(zhǔn),金融監(jiān)管人才隊(duì)伍建設(shè)欠缺,無(wú)法適應(yīng)不斷變化著的監(jiān)管市場(chǎng),對(duì)信息的保障與維護(hù)存在隱患,對(duì)消費(fèi)者的合法權(quán)益造成威脅。本文深入分析我國(guó)網(wǎng)絡(luò)金融監(jiān)管現(xiàn)狀,認(rèn)識(shí)到我國(guó)監(jiān)管存在著法律制定落后、監(jiān)管體系不健全、監(jiān)管人才存在缺失等問(wèn)題。通過(guò)對(duì)比國(guó)外的網(wǎng)絡(luò)監(jiān)管經(jīng)驗(yàn),深入的了解先進(jìn)國(guó)家和地區(qū)對(duì)網(wǎng)絡(luò)金融的監(jiān)管制度,及其做出的行之有效的監(jiān)管措施,為我國(guó)網(wǎng)絡(luò)金融監(jiān)管提供借鑒。目前,我國(guó)的網(wǎng)絡(luò)金融發(fā)展還處于起步初級(jí)階段,在很多方面都存在著不足之處,需要國(guó)家監(jiān)管機(jī)構(gòu)完善法律體系,確立市場(chǎng)準(zhǔn)入標(biāo)準(zhǔn),適應(yīng)高速發(fā)展的網(wǎng)絡(luò)金融,給犯罪分子不留可乘之機(jī),更好的保障消費(fèi)者在網(wǎng)絡(luò)交易中的合法權(quán)益,為網(wǎng)絡(luò)金融環(huán)境建立強(qiáng)有力的制度保障。同時(shí),加強(qiáng)人才培養(yǎng)與引進(jìn),高素質(zhì)人才進(jìn)入網(wǎng)絡(luò)監(jiān)管隊(duì)伍,保證整個(gè)監(jiān)管體系運(yùn)行的規(guī)范化、程序化與專(zhuān)業(yè)化。本文分為五個(gè)部分:第一部分,引言。主要闡明了我國(guó)網(wǎng)絡(luò)金融發(fā)展的特點(diǎn)及在對(duì)其具體的監(jiān)管中所存在的問(wèn)題。通過(guò)整理學(xué)者們對(duì)該課題的研究成果,對(duì)我國(guó)網(wǎng)絡(luò)金融監(jiān)管制度的建設(shè)給出自己的建議,進(jìn)一步完善我國(guó)現(xiàn)有的監(jiān)管制度。第二部分,網(wǎng)絡(luò)金融與網(wǎng)絡(luò)金融監(jiān)管的一般了解。首先對(duì)本文所論網(wǎng)絡(luò)金融的概念進(jìn)行界定,詳細(xì)闡明網(wǎng)絡(luò)金融所包含的對(duì)象,從宏觀和微觀的層面詳細(xì)介紹網(wǎng)絡(luò)金融。其次,著重強(qiáng)調(diào)網(wǎng)絡(luò)金融的作用與影響,網(wǎng)絡(luò)金融不斷深化著經(jīng)濟(jì)的發(fā)展模式,推動(dòng)了經(jīng)濟(jì)的虛擬化、無(wú)紙化與國(guó)際化的進(jìn)程,同時(shí)對(duì)傳統(tǒng)的經(jīng)濟(jì)模式也帶來(lái)了沖擊與挑戰(zhàn)。最后分析網(wǎng)絡(luò)金融迅猛發(fā)展所面臨的法律困境。面對(duì)網(wǎng)絡(luò)金融的不斷繁榮,為維護(hù)經(jīng)濟(jì)的整體平穩(wěn)運(yùn)行就需要對(duì)網(wǎng)絡(luò)金融進(jìn)行有效的監(jiān)管,本部分突出強(qiáng)調(diào)網(wǎng)絡(luò)監(jiān)管的概念和所涉及的對(duì)象,在網(wǎng)絡(luò)監(jiān)管中所面對(duì)的各種問(wèn)題及挑戰(zhàn)。如,網(wǎng)絡(luò)金融的虛擬性,金融業(yè)務(wù)的界線模糊化,國(guó)際間交流加強(qiáng)出現(xiàn)的監(jiān)管問(wèn)題。第三部分,我國(guó)網(wǎng)絡(luò)金融監(jiān)管的立法現(xiàn)狀與存在問(wèn)題。面對(duì)網(wǎng)絡(luò)金融的迅猛發(fā)展,我國(guó)監(jiān)管機(jī)構(gòu)對(duì)其監(jiān)管存在著滯后與不足,面對(duì)日趨一體化的金融模式傳統(tǒng)的分業(yè)經(jīng)營(yíng)模式,制約著網(wǎng)絡(luò)金融的監(jiān)管。同時(shí),在監(jiān)管立法方面,滯后性明顯,一直沒(méi)有成體系的法律法規(guī)的出臺(tái),很多金融主體趁虛而入,鉆法律的漏洞,使得整個(gè)網(wǎng)絡(luò)監(jiān)管模式陷入尷尬的境地。第四部分,美國(guó)與歐洲的金融監(jiān)管制度及啟示。我國(guó)監(jiān)管機(jī)構(gòu)在處理監(jiān)管問(wèn)題時(shí)經(jīng)驗(yàn)不足,需要我們學(xué)習(xí)美國(guó)、歐洲等地區(qū)的網(wǎng)絡(luò)監(jiān)管經(jīng)驗(yàn),不斷的增強(qiáng)我國(guó)監(jiān)管機(jī)構(gòu)的理論水平與業(yè)務(wù)水平,特別是在處理一些跨國(guó)性的網(wǎng)絡(luò)監(jiān)管問(wèn)題時(shí)能做到尊重對(duì)方,保證本方利益,實(shí)現(xiàn)共贏。第五部分,我國(guó)網(wǎng)絡(luò)金融監(jiān)管制度完善建議。本部分,明確我國(guó)網(wǎng)絡(luò)金融監(jiān)管的所應(yīng)堅(jiān)持的法律出路,著重強(qiáng)調(diào)法律層面監(jiān)管的重要性。同時(shí),通過(guò)各方面的共同參與,從健全信息管理、完善人事政策、制定激勵(lì)政策、加強(qiáng)國(guó)內(nèi)國(guó)際間交流合作等方面共同為網(wǎng)絡(luò)金融的監(jiān)管實(shí)現(xiàn)公正、公平,合理、合法而努力。
[Abstract]:Network finance plays a very important role in the modern economy. It sprout in the initial stage of the Internet application. The characteristics of the early network finance are the network of the financial institutions, that is, the communication and connection between various financial institutions can be realized with the help of the Internet connection function, and the limitation of time and space is broken through the degree of certain range, but because of the limitation of the time and space, With the influence of network information technology, market and people's influence on the degree of network financial recognition, the development degree and speed of its development have been restricted. With the continuous progress of network finance, the Internet finance industry has developed the stage of development. This stage pays more attention to the finance of the Internet Co, and a large number of large data means are used for the development of the network finance. Today, the network finance more attention to the construction of the platform, through the construction of the network financial platform, to meet the integration needs of more and more financial products, can better realize the integration of resources, play the characteristics of the network financial integrity. China's network finance begins with China Merchants Bank Since the first network bank set up in 1997, the traditional institutions began to use network information technology and network platform, set up their own network banks and carry out their own online business. China's network finance has entered the stage of development. With the new crescent of network technology, the network financial market is more and more today. Prosperity, it breaks through the limitation of time and space, plays a transparent, paperless, and more intimate communication between each other, the financial products are more and more diverse, the network financial market is more and more prosperous, and the role of the economic development is more prominent. However, in the face of the momentum of development such as this strong network finance, the network financial supervision of our country exists. The problems and deficiencies are mainly manifested in the imperfect legal system of the network financial supervision, the lack of complete market access standards, the lack of the construction of the personnel of financial supervision, the lack of adaptation to the changing supervision market, the hidden dangers of information protection and maintenance, and the threat to the legitimate rights and interests of consumers. This paper analyzes the network of our country in depth. In the current situation of financial supervision, we recognize that there are some problems in China's supervision, such as lagging law, imperfect supervision system, lack of supervision personnel, and so on. Through comparing foreign experience on network supervision, we have a deep understanding of the supervision system of network finance in advanced countries and regions, and the effective supervision measures made for China's network financial supervision. At present, the development of China's network finance is still in the primary stage, and there are many shortcomings in many aspects. It needs the state supervision institutions to perfect the legal system, establish the standard of market access, adapt to the rapid development of the network finance, not leave the criminals to the opportunity, and better guarantee the consumer in the network transaction. Legal rights and interests to establish a strong system guarantee for the network financial environment. At the same time, to strengthen the training and introduction of talents, high quality talents enter the network supervision team and ensure the standardization, procedure and specialization of the operation of the whole supervision system. This article is divided into five parts: the first part, introduction, mainly clarifies the characteristics of the development of China's network finance. And in the specific supervision of the existing problems. By sorting out the research results of the subject, we give some suggestions to the construction of China's network financial supervision system, and further improve the existing regulatory system in China. The second part, the general understanding of the network finance and network financial supervision. The concept of finance is defined, the object of network finance is clarified in detail, and network finance is introduced in detail from the macro and micro level. Secondly, the role and influence of network finance are emphasized, the network finance deepens the economic development mode, promotes the economic virtualization, paperless and internationalized process, and the traditional classics The model also brings impact and challenge. Finally, it analyzes the legal dilemma faced by the rapid development of network finance. In the face of the continuous prosperity of network finance, the effective supervision of network finance is needed to maintain the smooth operation of the economy as a whole. This part emphasizes the concept of network supervision and the objects involved in the network supervision, and in the network supervision and regulation. Facing all kinds of problems and challenges. For example, the virtual nature of network finance, the blurring of the boundary of financial business and the supervision of international exchanges. The third part, the current situation and problems of the legislation of China's network financial supervision and regulation. Facing the rapid development of the network finance, the supervision institutions of our country have a lag and lack of supervision. The traditional separate operation mode of the increasingly integrated financial model restricts the supervision of the network finance. At the same time, in the supervision legislation, the lag sex is obvious, and there has not been a system of laws and regulations. Many financial subjects take the advantage of the loopholes in the law, making the whole network supervision mode into an awkward situation. The fourth part, the United States The financial regulatory system and Enlightenment of the country and Europe. Our regulatory agencies are not experienced in dealing with the regulatory issues. We need to learn from the experience of network supervision in the United States and Europe, and constantly enhance the theoretical and operational levels of our regulatory agencies, especially when dealing with a number of transnational network supervision problems. To guarantee the interests of the party and achieve a win-win situation. In the fifth part, China's network financial supervision system is perfect. In this part, the legal way out in China's network financial supervision should be determined, and the importance of supervision in the legal level is emphasized. At the same time, through the joint participation of all aspects, we should improve the information management, improve personnel policy, and formulate incentives. Policies, strengthening domestic and international exchanges and cooperation, and so on, jointly strive for fairness, fairness, rationality and legality in the supervision of network finance.
