【摘要】：《網(wǎng)絡(luò)安全法》中關(guān)于數(shù)據(jù)跨境流動的內(nèi)容引起了廣泛的關(guān)注和討論。實際上,許多國家和地區(qū)都對數(shù)據(jù)跨境流動采取了不同程度和形式的規(guī)制。基于此,分析了數(shù)據(jù)跨境流動的緣由,整理、對比和總結(jié)了不同國家、地區(qū)的相關(guān)規(guī)制和企業(yè)的實踐經(jīng)驗。提出企業(yè)可以采取本地化、業(yè)務(wù)調(diào)整等策略來應(yīng)對數(shù)據(jù)跨境流動規(guī)制,建議政府可以通過授權(quán)、分類管理等促進數(shù)據(jù)跨境流動規(guī)制目標(biāo)的實現(xiàn)并降低其對經(jīng)濟的負(fù)面影響。
[Abstract]:The contents of the cybersecurity law on the cross-border flow of data have attracted extensive attention and discussion. In fact, many countries and regions have adopted different degrees and forms of regulation on cross-border data flow. Based on this, this paper analyzes the reason of the cross-border data flow, collates, compares and summarizes the relevant regulations of different countries and regions and the practical experience of enterprises. The paper puts forward that enterprises can adopt localization, business adjustment and other strategies to deal with the regulation of cross-border data flow, and suggests that the government can promote the realization of the regulation goal of cross-border data flow and reduce its negative impact on the economy through authorization, classification management and so on.
