【摘要】：針對(duì)資產(chǎn)管理行業(yè)呈現(xiàn)混業(yè)經(jīng)營的特征,現(xiàn)行分業(yè)機(jī)構(gòu)監(jiān)管存在監(jiān)管真空與監(jiān)管重疊并存、規(guī)則標(biāo)準(zhǔn)不統(tǒng)一等缺陷,國內(nèi)資產(chǎn)管理行業(yè)尚處于發(fā)展初期,亟待監(jiān)管層從頂層設(shè)計(jì)與統(tǒng)一監(jiān)管角度規(guī)范引導(dǎo)資產(chǎn)管理行業(yè)持續(xù)穩(wěn)健發(fā)展。本文總結(jié)了國內(nèi)資產(chǎn)管理行業(yè)運(yùn)行存在業(yè)務(wù)界定不清;監(jiān)管規(guī)則不統(tǒng)一,監(jiān)管協(xié)調(diào)有效性不足;存有隱性剛性兌付;金融基礎(chǔ)設(shè)施落后,監(jiān)管政策環(huán)境不穩(wěn)定四類突出問題。為準(zhǔn)確掌握資產(chǎn)管理業(yè)務(wù)真實(shí)風(fēng)險(xiǎn)組合和資產(chǎn)配置情況,防范監(jiān)管套利,服務(wù)實(shí)體經(jīng)濟(jì),本文建議監(jiān)管機(jī)構(gòu)應(yīng)明確資產(chǎn)管理法律關(guān)系與產(chǎn)品性質(zhì),統(tǒng)一監(jiān)管標(biāo)準(zhǔn)并加強(qiáng)監(jiān)管協(xié)調(diào),引導(dǎo)資產(chǎn)管理產(chǎn)品轉(zhuǎn)型,建立資本補(bǔ)充與風(fēng)險(xiǎn)約束機(jī)制,彌補(bǔ)金融基礎(chǔ)設(shè)施短板,依托"大數(shù)據(jù)"技術(shù)構(gòu)建綜合統(tǒng)計(jì)監(jiān)測體系。
[Abstract]:In view of the characteristics of mixed operation in the asset management industry, there are some defects in the supervision of the separated organizations, such as the coexistence of the supervision vacuum and the overlapping of the supervision, the inconsistent rules and standards, and so on. The domestic asset management industry is still in the early stage of development. It is urgent for the supervision layer to guide the asset management industry to develop steadily and steadily from the top level design and unified supervision angle. This paper concludes that the operation of domestic asset management industry is not clearly defined, the supervision rules are not uniform, and the effectiveness of supervision coordination is insufficient. There are four outstanding problems, such as implicit rigid payment, backward financial infrastructure and unstable regulatory policy environment. In order to accurately grasp the real risk mix and asset allocation of asset management business, prevent regulatory arbitrage and serve the real economy, This paper suggests that the regulatory body should clarify the legal relationship between asset management and the nature of the product, unify the regulatory standards and strengthen the regulatory coordination, guide the transformation of asset management products, establish a capital supplement and risk restraint mechanism, and make up for the financial infrastructure deficiencies. Rely on "big data" technology to build a comprehensive statistical monitoring system.
