【摘要】：自由貿易是國際發(fā)展的趨勢,美國、德國、新加坡等發(fā)達國家都設立了自由貿易區(qū),這類特殊區(qū)域已經成為了區(qū)域經濟一體化的主要形式之一。我國為了順應世界經濟形勢的變化,在現(xiàn)有保稅區(qū)、綜合保稅區(qū)等4類海關特殊監(jiān)管區(qū)域基礎上,建立了上海自由貿易試驗區(qū),進一步推動完善開放型經濟體制機制。在當今法治社會的條件下,完善的法律制度是科學合理監(jiān)管的基礎。海關作為國家進出關境監(jiān)督管理部門,是上海自由貿易試驗區(qū)在監(jiān)管方面的一個必不可少的重要行政機構。本文首先對自由貿易區(qū)的概念、類型以及我國自由貿易區(qū)建設的探索實踐進行追溯,系統(tǒng)闡述了我國各類海關特殊監(jiān)管區(qū)域的功能及海關監(jiān)管的理論基礎和作用。再結合上海自由貿易試驗區(qū)的功能定位,闡述了當前海關監(jiān)管的現(xiàn)狀,并重點分析了目前上海自由貿易試驗區(qū)海關監(jiān)管制度存在的法制建設不健全、監(jiān)管模式較落后、制度創(chuàng)新不足等問題,對改革創(chuàng)新進行理性思考,針對存在的問題,借鑒國外的成功經驗,最終對上海自由貿易試驗區(qū)海關監(jiān)管制度提出一些可行的對策和目標,以完善海關監(jiān)管工作。本文提出的對策和建議具有一定的現(xiàn)實實踐意義和參考價值。
[Abstract]:Free trade is the trend of international development. The United States, Germany, Singapore and other developed countries have set up free trade zones, such special regions have become one of the main forms of regional economic integration. In order to adapt to the changes of the world economic situation, China has established Shanghai Free Trade Test Zone on the basis of four special customs supervision areas, such as the existing bonded area and the Comprehensive bonded Zone, in order to further promote the improvement of the open economic system mechanism. Under the condition of rule of law, perfect legal system is the basis of scientific and reasonable supervision. Customs, as a national supervision and administration department, is an indispensable administrative organization in the supervision of Shanghai Free Trade Test area. In this paper, the concept and types of free trade area and the exploration and practice of the construction of free trade area in China are traced back, and the functions of various special customs supervision areas in China and the theoretical basis and function of customs supervision and control are systematically expounded in this paper. Combined with the functional orientation of Shanghai Free Trade Test area, this paper expounds the current situation of customs supervision, and analyzes emphatically that the legal system of Shanghai Free Trade Test Zone is not perfect and the supervision mode is backward. This paper makes rational thinking on the reform and innovation, draws lessons from the successful experience of foreign countries, and finally puts forward some feasible countermeasures and objectives for the customs supervision system of Shanghai Free Trade Test area. In order to improve the work of customs supervision. The countermeasures and suggestions in this paper have some practical significance and reference value.
