【摘要】：自由貿(mào)易是國(guó)際發(fā)展的趨勢(shì),美國(guó)、德國(guó)、新加坡等發(fā)達(dá)國(guó)家都設(shè)立了自由貿(mào)易區(qū),這類特殊區(qū)域已經(jīng)成為了區(qū)域經(jīng)濟(jì)一體化的主要形式之一。我國(guó)為了順應(yīng)世界經(jīng)濟(jì)形勢(shì)的變化,在現(xiàn)有保稅區(qū)、綜合保稅區(qū)等4類海關(guān)特殊監(jiān)管區(qū)域基礎(chǔ)上,建立了上海自由貿(mào)易試驗(yàn)區(qū),進(jìn)一步推動(dòng)完善開放型經(jīng)濟(jì)體制機(jī)制。在當(dāng)今法治社會(huì)的條件下,完善的法律制度是科學(xué)合理監(jiān)管的基礎(chǔ)。海關(guān)作為國(guó)家進(jìn)出關(guān)境監(jiān)督管理部門,是上海自由貿(mào)易試驗(yàn)區(qū)在監(jiān)管方面的一個(gè)必不可少的重要行政機(jī)構(gòu)。本文首先對(duì)自由貿(mào)易區(qū)的概念、類型以及我國(guó)自由貿(mào)易區(qū)建設(shè)的探索實(shí)踐進(jìn)行追溯,系統(tǒng)闡述了我國(guó)各類海關(guān)特殊監(jiān)管區(qū)域的功能及海關(guān)監(jiān)管的理論基礎(chǔ)和作用。再結(jié)合上海自由貿(mào)易試驗(yàn)區(qū)的功能定位,闡述了當(dāng)前海關(guān)監(jiān)管的現(xiàn)狀,并重點(diǎn)分析了目前上海自由貿(mào)易試驗(yàn)區(qū)海關(guān)監(jiān)管制度存在的法制建設(shè)不健全、監(jiān)管模式較落后、制度創(chuàng)新不足等問題,對(duì)改革創(chuàng)新進(jìn)行理性思考,針對(duì)存在的問題,借鑒國(guó)外的成功經(jīng)驗(yàn),最終對(duì)上海自由貿(mào)易試驗(yàn)區(qū)海關(guān)監(jiān)管制度提出一些可行的對(duì)策和目標(biāo),以完善海關(guān)監(jiān)管工作。本文提出的對(duì)策和建議具有一定的現(xiàn)實(shí)實(shí)踐意義和參考價(jià)值。
[Abstract]:Free trade is the trend of international development. The United States, Germany, Singapore and other developed countries have set up free trade zones, such special regions have become one of the main forms of regional economic integration. In order to adapt to the changes of the world economic situation, China has established Shanghai Free Trade Test Zone on the basis of four special customs supervision areas, such as the existing bonded area and the Comprehensive bonded Zone, in order to further promote the improvement of the open economic system mechanism. Under the condition of rule of law, perfect legal system is the basis of scientific and reasonable supervision. Customs, as a national supervision and administration department, is an indispensable administrative organization in the supervision of Shanghai Free Trade Test area. In this paper, the concept and types of free trade area and the exploration and practice of the construction of free trade area in China are traced back, and the functions of various special customs supervision areas in China and the theoretical basis and function of customs supervision and control are systematically expounded in this paper. Combined with the functional orientation of Shanghai Free Trade Test area, this paper expounds the current situation of customs supervision, and analyzes emphatically that the legal system of Shanghai Free Trade Test Zone is not perfect and the supervision mode is backward. This paper makes rational thinking on the reform and innovation, draws lessons from the successful experience of foreign countries, and finally puts forward some feasible countermeasures and objectives for the customs supervision system of Shanghai Free Trade Test area. In order to improve the work of customs supervision. The countermeasures and suggestions in this paper have some practical significance and reference value.
