【摘要】：中國(guó)有很多的加工貿(mào)易企業(yè),這些加工貿(mào)易企業(yè)存在著貿(mào)易合規(guī)的風(fēng)險(xiǎn),而且隨著社會(huì)經(jīng)濟(jì)的發(fā)展和監(jiān)管制度的完善,貿(mào)易合規(guī)的風(fēng)險(xiǎn)管理變得越來越重要。本文所研究的加工貿(mào)易合規(guī)風(fēng)險(xiǎn)的意義不只對(duì)于一個(gè)具體的加工貿(mào)易企業(yè)-B公司如何規(guī)避風(fēng)險(xiǎn)、降低損失具有指導(dǎo)意義,而且在宏觀上它對(duì)于整個(gè)加工貿(mào)易的長(zhǎng)期健康發(fā)展也具有重要的意義。本文的研究結(jié)合了我國(guó)加工貿(mào)易監(jiān)管的特征、合規(guī)風(fēng)險(xiǎn)的基本理論以及國(guó)內(nèi)外貿(mào)易合規(guī)的現(xiàn)狀,將西方先進(jìn)的風(fēng)險(xiǎn)管理的體系應(yīng)用于當(dāng)下加工貿(mào)易企業(yè)的合規(guī)風(fēng)險(xiǎn)管理。以B公司為案例,從外部環(huán)境和內(nèi)部管理的多個(gè)因素角度分析了貿(mào)易合規(guī)風(fēng)險(xiǎn)產(chǎn)生的原因;同時(shí),還對(duì)我國(guó)加工貿(mào)易企業(yè)常見貿(mào)易合規(guī)問題比如商品編碼、賬冊(cè)管理、物流方案等問題做了詳細(xì)的分析,并給予了相應(yīng)的詳細(xì)的解決方案,希望給予其他企業(yè)以借鑒意義。本文在研究過程中相應(yīng)的采取了問卷調(diào)查、文獻(xiàn)分析法、案例分析等方法。從筆者有效回收的問卷調(diào)查發(fā)現(xiàn),以蘇州地區(qū)為典型代表的我國(guó)加工貿(mào)易企業(yè)對(duì)貿(mào)易合規(guī)的重視程度不夠;許多公司還有努力的空間讓其公司變成海關(guān)更高等級(jí)使其享受到更多的通關(guān)便利;接受調(diào)查的63%的公司前三年因貿(mào)易合規(guī)補(bǔ)稅金額超過人民幣150萬,說明貿(mào)易合規(guī)風(fēng)險(xiǎn)對(duì)企業(yè)運(yùn)營(yíng)成本的影響;自查只有8Y%的企業(yè)對(duì)認(rèn)為對(duì)貿(mào)易合規(guī)相對(duì)了解;僅有21%的公司系統(tǒng)學(xué)習(xí)或者部分學(xué)習(xí)過貿(mào)易合規(guī)知識(shí);95%的公司并沒有相應(yīng)的體系制度來控制貿(mào)易合規(guī)風(fēng)險(xiǎn)。所以我們需要研究分析加工貿(mào)易企業(yè)的貿(mào)易合規(guī)風(fēng)險(xiǎn)來達(dá)到本文的研究目的和意義。本文總結(jié)了適合當(dāng)下我國(guó)加工貿(mào)易企業(yè)貿(mào)易合規(guī)的風(fēng)險(xiǎn)管理原則,即平衡性、預(yù)防性、動(dòng)態(tài)性。從長(zhǎng)期發(fā)展的角度看,企業(yè)除了要借助完善企業(yè)內(nèi)部管理系統(tǒng)之外,還應(yīng)該在宏觀上運(yùn)用風(fēng)險(xiǎn)管理的架構(gòu)和機(jī)制,這樣才能夠在可持續(xù)性發(fā)展的基礎(chǔ)上更好地做好貿(mào)易合規(guī)的風(fēng)險(xiǎn)管理工作。我們認(rèn)為貿(mào)易合規(guī)的風(fēng)險(xiǎn)控制和管理需要長(zhǎng)期的機(jī)制來維持,本文試探性的給出了從風(fēng)險(xiǎn)學(xué)習(xí)、風(fēng)險(xiǎn)籌劃、風(fēng)險(xiǎn)規(guī)避和風(fēng)險(xiǎn)承擔(dān)的角度讓風(fēng)險(xiǎn)從運(yùn)行機(jī)制上被管理和控制。
[Abstract]:There are many processing trade enterprises in China, these enterprises have the risk of trade compliance, and with the development of social economy and the improvement of regulatory system, the risk management of trade compliance becomes more and more important. The significance of the compliance risk of processing trade studied in this paper is not only instructive for a specific processing trade company-B company how to avoid the risk and reduce the loss. It is also of great significance to the long-term and healthy development of the whole processing trade. This paper combines the characteristics of China's processing trade supervision, the basic theory of compliance risk and the current situation of domestic and foreign trade compliance, and applies the advanced risk management system of western countries to the compliance risk management of processing trade enterprises. Taking Company B as a case, this paper analyzes the causes of trade compliance risk from the perspective of external environment and internal management. At the same time, it also analyzes the common trade compliance problems of processing trade enterprises in China, such as commodity coding, account book management. The logistics scheme and other problems are analyzed in detail, and the corresponding detailed solutions are given, hoping to give reference to other enterprises. In the course of the research, this paper adopts the methods of questionnaire, literature analysis, case analysis and so on. From the questionnaire survey, we find that the Chinese processing trade enterprises, which are typical of Suzhou area, pay less attention to the trade compliance. Many companies still have room to make their companies a higher level of customs and enjoy more clearance facilities; 63 percent of companies surveyed paid more than 1.5 million yuan for trade compliance in the first three years. The impact of trade compliance risk on the operating cost of the enterprise was explained, and only 8Y% of the enterprises considered that they had a relative understanding of trade compliance. Only 21% of companies have learned or partially learned about trade compliance. 95% of companies do not have a system to control trade compliance risks. Therefore, we need to study and analyze the trade compliance risk of processing trade enterprises to achieve the purpose and significance of this paper. This paper summarizes the principles of risk management, which are balanced, preventive and dynamic, which are suitable for the current trade compliance of processing trade enterprises in China. From the perspective of long-term development, in addition to improving the internal management system of enterprises, enterprises should also make use of the framework and mechanism of risk management at the macro level. In this way, trade compliance risk management can be better done on the basis of sustainable development. We believe that the risk control and management of trade compliance need long-term mechanism to maintain. This paper tentatively gives the point of view of risk learning, risk planning, risk aversion and risk taking so that risk can be managed and controlled from the operational mechanism.
