【摘要】：隨著國際貿(mào)易的發(fā)展,越來越多的國家通過實(shí)行反傾銷措施來保護(hù)其國內(nèi)產(chǎn)業(yè)。但是,有些國家為了達(dá)到保護(hù)其本國貿(mào)易的目的而濫用反傾銷措施,進(jìn)而形成了新的貿(mào)易壁壘。為了扼制這種現(xiàn)象,在烏拉圭回合談判制定的《反傾銷協(xié)議》中,第11條確定了日落復(fù)審條款,希望通過該制度給反傾銷措施的實(shí)施期限加以限制。日落復(fù)審是指在反傾銷措施在實(shí)施一段時(shí)間后,由主管機(jī)關(guān)依據(jù)國內(nèi)產(chǎn)業(yè)申請(qǐng)或者自行發(fā)起審查是否具有繼續(xù)實(shí)施反傾銷措施的制度。但是,由于該條款是各締約方妥協(xié)的結(jié)果,該條款本質(zhì)上具有妥協(xié)性及文字的模糊性,導(dǎo)致有些國家在制定日落復(fù)審制度時(shí)偏離了WTO《反傾銷協(xié)議》日落復(fù)審條款的初衷。實(shí)踐中有些國家經(jīng)常濫用自由裁量權(quán),致使反傾銷措施的期限被不合理地延長。因此,在多哈回合談判中,日落復(fù)審條款的修訂也成為了重要議題之一。而對(duì)于我國來說,由于我國反傾銷法律體系尚需完善,健全日落復(fù)審制度已經(jīng)成為我國反傾銷法律和實(shí)務(wù)研究中的一個(gè)重要領(lǐng)域。同時(shí)應(yīng)對(duì)外國對(duì)我國頻繁發(fā)起的反傾銷日落復(fù)審,已成為亟待解決的現(xiàn)實(shí)問題。本文通過對(duì)WTO《反傾銷協(xié)議》日落復(fù)審條款的分析,對(duì)完善該條款提出建議,并對(duì)我國反傾銷立法的完善及如何應(yīng)對(duì)國外對(duì)我國企業(yè)反傾銷日落復(fù)審提出建議。
[Abstract]:With the development of international trade, more and more countries adopt anti-dumping measures to protect their domestic industries. However, some countries abuse anti-dumping measures in order to protect their own trade. In order to curb this phenomenon, Article 11 of the Anti-dumping Agreement negotiated in the Uruguay Round established the sunset review clause. It is hoped that the duration of the implementation of anti-dumping measures will be limited through this system. Sunset review means that after the anti-dumping measures have been in force for some time, The competent authority, on the basis of an application by domestic industry or on its own initiative, shall examine whether there is a system for the continuation of the application of anti-dumping measures. However, since the provision is the result of compromise by the parties, it is inherently compromise and ambiguous in its wording, This has led some countries to deviate from the original intention of the sunset review clause of the WTO Anti-Dumping Agreement when developing the sunset review system. In practice, some countries often abuse their discretion, which results in the unreasonable extension of the duration of anti-dumping measures. In the Doha Round of negotiations, the revision of sunset review clause has also become one of the important issues. For our country, the anti-dumping legal system still needs to be improved. Perfecting the sunset review system has become an important field in the study of anti-dumping law and practice in China. At the same time, it is necessary to deal with the frequent anti-dumping sunset review initiated by foreign countries. It has become a practical problem to be solved urgently. Through the analysis of the sunset review clause of WTO Anti-dumping Agreement, this paper puts forward some suggestions on how to perfect this clause. It also puts forward some suggestions on how to perfect the anti-dumping legislation of our country and how to deal with the review of anti-dumping sunset of Chinese enterprises abroad.
