【摘要】:中國(guó)拍賣行業(yè),尤其是藝術(shù)品交易市場(chǎng),近二、三十年發(fā)展迅速,成為世界上最重要的拍賣市場(chǎng)之一。然而,業(yè)界普遍存在的贗品充斥、"假拍"、"拍假"等行業(yè)亂象,極大地?fù)p傷行業(yè)信譽(yù),引起了社會(huì)各界的普遍關(guān)注。中國(guó)拍賣業(yè)雖然取得了舉世矚目的成績(jī),與歐美發(fā)達(dá)國(guó)家相比,國(guó)內(nèi)拍賣基礎(chǔ)理論的研究、法律法規(guī)的健全、行業(yè)規(guī)范的完善、從業(yè)人員素質(zhì)的提高等等,都還有著很大的提升空間。當(dāng)今世界上,英國(guó)和美國(guó)的拍賣行業(yè)最具有競(jìng)爭(zhēng)力,每年拍賣成交總額和總成交件數(shù)都遙遙領(lǐng)先。法國(guó)在18世紀(jì)之后,曾長(zhǎng)期作為世界的文化中心。在首都巴黎,大量的藝術(shù)運(yùn)動(dòng)和文化思潮此起彼伏,涌現(xiàn)出像伏爾泰、盧梭、福樓拜、雨果、笛卡爾等眾多哲學(xué)、文學(xué)和科學(xué)等各類學(xué)科的先驅(qū)人物,吸引如畢加索、居里夫人等歐洲其他國(guó)家的優(yōu)秀人物聚集。法語(yǔ)文化在全歐洲風(fēng)行,18世紀(jì)末的俄羅斯宮廷,甚至都以其為官方語(yǔ)言。藝術(shù)品市場(chǎng)也尤其發(fā)達(dá),在首都巴黎,尤其聚集了大量的藝術(shù)品交易商、畫廊、藝術(shù)贊助人、收藏家和一流的藝術(shù)創(chuàng)作者。如今,雖然行業(yè)整體大不如前,在市場(chǎng)體量上不及英美,但在年總成交件數(shù)上表現(xiàn)依然亮眼。法國(guó)拍場(chǎng)的平民化、對(duì)拍品的保真承諾等等,都彰顯出法國(guó)拍賣市場(chǎng)獨(dú)特之處。在努力學(xué)習(xí)西方,改革市場(chǎng)經(jīng)濟(jì)體制、發(fā)展中國(guó)現(xiàn)代拍賣行業(yè)的路途上,法國(guó)拍賣行業(yè)的經(jīng)驗(yàn)同樣是值得學(xué)習(xí)借鑒的。巴黎德魯奧拍賣行建成開放于1852年,其前身更可追溯至1800年前后,在超過(guò)一個(gè)半世紀(jì)的時(shí)間里,德魯奧拍賣行經(jīng)歷了無(wú)數(shù)的挑戰(zhàn)。巴黎公社、兩次世界大戰(zhàn)、經(jīng)濟(jì)蕭條時(shí)期以及被歐盟強(qiáng)制要求開放市場(chǎng)競(jìng)爭(zhēng)等等,德魯奧拍賣行都成功地渡過(guò)難關(guān)。歷史發(fā)展悠久,底蘊(yùn)深厚,德魯奧拍賣行堪稱法國(guó)最古老的拍賣行,也是法國(guó)拍賣業(yè)界的代表。本文即從歷史傳統(tǒng)、法制、業(yè)務(wù)操作和數(shù)據(jù)分析這四個(gè)方面對(duì)巴黎德魯奧拍賣行進(jìn)行個(gè)案研究,探索法國(guó)拍賣行業(yè)的特點(diǎn)和趨勢(shì)。在每一章的小節(jié)中,會(huì)對(duì)比中國(guó)拍賣行業(yè)相應(yīng)問(wèn)題,并提出中國(guó)拍賣行業(yè)發(fā)展的思路和對(duì)策。本文不是一篇嚴(yán)格意義上的文化比較型論文,雖然第二章有中法不同文化傳統(tǒng)對(duì)拍賣行業(yè)影響的論述,但本文側(cè)重于巴黎德魯奧拍賣行的個(gè)案研究,對(duì)于中國(guó)拍賣行業(yè)發(fā)展歷史、現(xiàn)狀和建議的部分并不是主要內(nèi)容。對(duì)于國(guó)外拍賣行業(yè)的研究,特別是對(duì)法國(guó)拍賣行業(yè)的研究,目前學(xué)界發(fā)表的論文還很少,而對(duì)單個(gè)拍賣公司或者拍賣行的個(gè)案研究,更是微乎其微。本文作者雖然沒(méi)有獲得過(guò)法律、金融方面的學(xué)位,在法律論述、金融工具運(yùn)用方面十分粗淺,但在相關(guān)領(lǐng)域還沒(méi)有發(fā)表過(guò)任何個(gè)案研究論文的情況下,本文可拋磚引玉,為后來(lái)拍賣行業(yè)的學(xué)術(shù)研究作一參考。
[Abstract]:The auction industry in China, especially the art market, has developed rapidly in the past 20 to 30 years and has become one of the most important auction markets in the world. However, there are widespread fakes in the industry, such as "fake auction", "fake auction" and so on. It has greatly damaged the credibility of the industry and aroused widespread concern from all walks of life. Although the Chinese auction industry has made remarkable achievements, compared with the developed countries in Europe and the United States, the study of the basic theory of domestic auction, the sound of laws and regulations, There is still a lot of room for improvement with the perfection of industry norms and the improvement of the quality of employees. In today's world, the auction industry in the United Kingdom and the United States is the most competitive. France, after 18th century, has long been the cultural center of the world. In the capital, Paris, art movements and cultural trends have sprung up, such as Voltaire and Rousseau. Flaubert, Hugo, Descartes and many other pioneers in various disciplines of philosophy, literature and science attracted people such as Picasso. Good people from other European countries such as Madame Curie gathered. French culture became popular throughout Europe and even the Russian court in the late 18th century used it as the official language. The art market was especially developed, in the capital, Paris. In particular, there are a large number of art dealers, galleries, art patrons, collectors and first-rate art creators. Today, although the industry as a whole is not as big as before, it is not as large as Britain and the United States in terms of market size. However, the performance of the total number of transactions in the year is still bright. The popularization of the French auction field, the promise of fidelity to the lot, and so on, all show the uniqueness of the French auction market. They are trying to learn from the West and reform the market economic system. On the way to modern auction in China, the experience of the French auction industry is also worth learning. The Paris de Ruo auction house opened in 1852, and its predecessor dates back to 1800, for more than a century and a half. The Druo auction house has experienced numerous challenges. The Paris Commune, the two World Wars, the Depression and the open market competition forced by the European Union have successfully weathered the difficulties. The Druo auction house is the oldest auction house in France and a representative of the French auction industry. This paper makes a case study of the Paris Druo auction house from four aspects: historical tradition, legal system, business operation and data analysis. This paper explores the characteristics and trends of the auction industry in France. In the section of each chapter, the corresponding problems of the auction industry in China are discussed, and the ideas and countermeasures for the development of the auction industry in China are put forward. This paper is not a cultural comparative paper in the strict sense. Although the second chapter discusses the influence of different cultures and traditions of China and France on the auction industry, this paper focuses on the case study of Druo auction house in Paris, and on the history of the development of the auction industry in China. The current situation and suggestions are not the main contents. For the research of the foreign auction industry, especially the French auction industry, there are few papers published by academic circles at present, but the case studies on individual auction companies or auction houses. Although the author has not received a degree in law, finance, or the use of financial instruments, he has not published any case studies in related fields. This article can offer a reference for the academic research of auction industry.
