【摘要】：信用合作社是社員以互助互利為目的、以合作方式共同聯(lián)合組成的自有、自營(yíng)、自享的資金互助組織,是經(jīng)濟(jì)弱者按照合作制原則在金融領(lǐng)域的自助聯(lián)合。信用合作社發(fā)源于德國(guó),其制度經(jīng)由知識(shí)分子的廣泛傳播和民間組織的深入實(shí)踐,成為民國(guó)政府發(fā)展合作事業(yè)、挽救農(nóng)村經(jīng)濟(jì)的基本路徑。德國(guó)綜合統(tǒng)一的《合作社法》直接影響著民國(guó)合作社立法,并構(gòu)成了民國(guó)《合作社法》的藍(lán)本。對(duì)德國(guó)信用合作社思想、制度以及立法技術(shù)在我國(guó)的傳播和運(yùn)用進(jìn)行系統(tǒng)的梳理、檢討,正本清源,有助于正確認(rèn)識(shí)信用合作社的本質(zhì)屬性,彰顯信用合作社機(jī)能,完善我國(guó)合作社立法并有效落實(shí)國(guó)家惠農(nóng)政策。
[Abstract]:The credit cooperative is a mutual fund organization composed by the mutual aid and mutual benefit of the members and the cooperative way. It is the self-help union of the weak in the financial field according to the principle of cooperative system. The credit cooperative originated in Germany, and its system has become the basic way for the government of the Republic of China to develop cooperation and save the rural economy through the widespread dissemination of intellectuals and the deep practice of civil organizations. Germany's comprehensive and unified Cooperative Law directly affects the Republic of China's cooperative legislation and forms the blueprint of the Republic of China's Cooperative Law. This paper systematically combs and reviews the dissemination and application of German credit cooperative thought, system and legislative technology in our country, which is helpful to correctly understand the essential attribute of credit cooperative and to highlight the function of credit cooperative. Improve our cooperative legislation and effectively implement the national agricultural policy.
