中山市食品生產(chǎn)加工環(huán)節(jié)政府監(jiān)管問題研究

【摘要】:中山市地處廣東珠三角經(jīng)濟(jì)發(fā)展區(qū)域。20世紀(jì)90年代以后,隨著市場(chǎng)規(guī)模的擴(kuò)大和人民生活水平的提高,食品生產(chǎn)加工企業(yè)迅速發(fā)展,有效地滿足了人民群眾日益豐富的食品需求和促進(jìn)了中山的經(jīng)濟(jì)發(fā)展。全面分析中山市食品生產(chǎn)加工環(huán)節(jié)安全管理存在的問題,結(jié)合現(xiàn)行法制框架和中山市的地域特點(diǎn),在政府監(jiān)管體制層面提出可行的建議和措施,構(gòu)建全程食品安全監(jiān)管的長(zhǎng)效機(jī)制,進(jìn)一步提升本地區(qū)的食品質(zhì)量安全水平具有重要的意義,這也是本文的主要研究?jī)?nèi)容。 論文共有六章構(gòu)成。 第一章,導(dǎo)論。本章主要闡明了研究主旨、研究的理論價(jià)值和現(xiàn)實(shí)意義,并進(jìn)行相關(guān)的國(guó)內(nèi)外文獻(xiàn)綜述和概念的界定和厘清,進(jìn)而說明本文的研究方法、邏輯框架和可能的創(chuàng)新之處;第二章,食品安全監(jiān)管的理論基礎(chǔ)。作為本文研究的基礎(chǔ)性鋪墊,分析了食品安全的成因及政府監(jiān)管創(chuàng)新的必要性;第三章,中山市食品生產(chǎn)加工環(huán)節(jié)食品安全的現(xiàn)狀。闡述了中山市食品生產(chǎn)加工環(huán)節(jié)食品安全的發(fā)展現(xiàn)狀和存在的問題以及政府的監(jiān)管現(xiàn)狀與存在的問題,監(jiān)管存在的問題主要表現(xiàn)在監(jiān)管不到位、鄉(xiāng)(鎮(zhèn))政府監(jiān)管責(zé)任落實(shí)不到、檢測(cè)效能無法充分發(fā)揮和執(zhí)法力度不夠;第四章,中山市食品生產(chǎn)加工環(huán)節(jié)政府監(jiān)管存在問題的原因分析。其產(chǎn)生的原因是多方面的,主要有監(jiān)管體制不完善,法律體系不健全;監(jiān)管機(jī)構(gòu)不健全,監(jiān)管人員業(yè)務(wù)水平差;監(jiān)管與執(zhí)法分離,運(yùn)轉(zhuǎn)機(jī)制不靈活;日常巡查效率低,監(jiān)管方法不科學(xué);食品質(zhì)量信息發(fā)布不及時(shí),食品安全宣傳不深入;第五章,國(guó)內(nèi)外食品安全監(jiān)管模式及借鑒。主要分析了美國(guó)、日本、歐盟的監(jiān)管模式和特點(diǎn)以及對(duì)我國(guó)食品安全監(jiān)管的啟示。第六章,加強(qiáng)中山市食品生產(chǎn)加工環(huán)節(jié)食品安全的建議。承接上述各章的分析,本章認(rèn)為做好食品生產(chǎn)加工環(huán)節(jié)食品安全監(jiān)管應(yīng)該健全法律體系,完善監(jiān)管體制;健全監(jiān)管機(jī)構(gòu),提升監(jiān)管人員業(yè)務(wù)水平;統(tǒng)一監(jiān)管與執(zhí)法職能,,建立良性運(yùn)轉(zhuǎn)機(jī)制;提高日常巡查效率,建立科學(xué)監(jiān)管方法;及時(shí)發(fā)布食品質(zhì)量信息,深入宣傳食品安全。
[Abstract]:Zhongshan City is located in the economic development area of Guangdong Pearl River Delta. After the 1990s, with the expansion of market scale and the improvement of people's living standard, food production and processing enterprises developed rapidly. Effectively meet the increasing food demand of the people and promote the economic development of Zhongshan. This paper comprehensively analyzes the problems existing in the safety management of food production and processing links in Zhongshan City, combining with the current legal framework and the regional characteristics of Zhongshan City, puts forward feasible suggestions and measures at the level of government supervision system. It is of great significance to establish a long-term mechanism of food safety supervision in the whole process and to further improve the food quality and safety level in this area, which is also the main research content of this paper. The thesis consists of six chapters. Chapter one, introduction. This chapter mainly expounds the research purport, the theoretical value and the practical significance of the research, and carries on the related domestic and foreign literature review and the definition and the clarification of the concept, then explains the research method, the logical frame and the possible innovation of this paper; The second chapter is the theoretical basis of food safety supervision. As the foundation of this study, this paper analyzes the causes of food safety and the necessity of the innovation of government supervision. Chapter three, the current situation of food safety in food production and processing in Zhongshan City. This paper expounds the present situation and existing problems of food safety in food production and processing in Zhongshan City, as well as the present situation and existing problems of government supervision. The main problems in supervision are that the supervision is not in place. Township (town) government supervision responsibility can not be implemented, detection efficiency can not fully play and law enforcement is not enough; Chapter IV, Zhongshan City food production and processing links of government supervision problems analysis. There are many reasons for it, such as imperfect supervision system, imperfect legal system, imperfect supervision organization, poor professional level of supervisors, separation between supervision and law enforcement, and inflexible operation mechanism. The daily inspection efficiency is low, the supervision method is not scientific; the food quality information is not released in time, the food safety propaganda is not thorough; the fifth chapter, the domestic and foreign food safety supervision pattern and the reference. This paper mainly analyzes the regulatory patterns and characteristics of the United States, Japan and the European Union, as well as the implications for China's food safety regulation. The sixth chapter, strengthen Zhongshan City food production and processing link food safety suggestion. According to the analysis of the above chapters, this chapter holds that the supervision of food safety in food production and processing should improve the legal system, perfect the supervision system, improve the supervision organization and enhance the professional level of the supervisors. To unify the function of supervision and law enforcement, to establish a sound operating mechanism, to improve the efficiency of daily inspection, to establish a scientific method of supervision, to issue timely information on food quality, and to publicize food safety in depth.
