我國食品安全基層監(jiān)管對策研究

【摘要】:隨著我國市場經(jīng)濟的不斷發(fā)展,人們的生活水平不斷提高。但是與此背道而馳的是,我國的食品安全問題卻層出不窮,成為影響我國食品行業(yè)發(fā)展的一大瓶頸。也讓公眾對政府的公信力及管理能力產(chǎn)生了嚴重質(zhì)疑。而在政府監(jiān)管模式上,受歷年來的食品安全體制影響及法律與現(xiàn)有體制的沖突,食品安全監(jiān)管部門(特別是基層食品安全監(jiān)管部門)權(quán)責不清、職能交叉、多頭執(zhí)法、推諉扯皮等問題頻出。2013年,國務(wù)院機構(gòu)改革方案針對食品安全監(jiān)管部門的職能進行了調(diào)整,國務(wù)院發(fā)布了地方改革完善食品藥品監(jiān)管體制的指導(dǎo)意見。全國各地(市)也先后對當?shù)厥称钒踩O(jiān)管體制進行了探索調(diào)整。筆者通過分析現(xiàn)有基層食品安全監(jiān)管體制調(diào)整所取得的成效,借鑒美國、日本、歐盟與加拿大等發(fā)達國家較為完善的食品安全監(jiān)管體系與法律制度,對如何完善當前我國基層食品安全監(jiān)管提出建議,從而改善我國食品安全監(jiān)管現(xiàn)狀,重樹公民食品安全信心。 文章共分為六個部分。第一部分為緒論,闡釋本文的研究背景、意義,分析國內(nèi)外在食品安全監(jiān)管方面的研究現(xiàn)狀,介紹文章的研究思路與研究方法;第二部分為理論基礎(chǔ),分析文章中的重點概念,闡釋相關(guān)理論綜述,為后文的研究奠定理論基礎(chǔ);第三部分對我國食品安全基層監(jiān)管現(xiàn)狀進行解讀,主要內(nèi)容包括歷史沿革、我國基層食品安全監(jiān)管的成效以及我國食品安全基層監(jiān)管中存在的主要問題;第四部分借鑒國外基層食品安全監(jiān)管經(jīng)驗,包括美國、日本、加拿大以及歐盟等國家和地區(qū)的先進模式,總結(jié)出有利于改善我國基層食品安全監(jiān)管機制的措施;第五部分為完善我國基層食品安全監(jiān)管的對策,主要從完善法律法規(guī)體系、明確監(jiān)管主體的權(quán)限范圍、建立權(quán)威統(tǒng)一的綜合協(xié)調(diào)機構(gòu)、設(shè)置公開透明的全民監(jiān)管平臺以及完善食品安全監(jiān)管的責任追究制度。
[Abstract]:With the development of market economy in our country, people's living standard is improving constantly. But contrary to this, food safety problems in our country emerge in endlessly. It has become a major bottleneck affecting the development of the food industry in China. It also makes the public have serious doubts on the credibility and management ability of the government, and on the mode of government supervision. Affected by the food safety system over the years and the conflict between the law and the existing system, the food safety supervision department (especially the grass-roots food safety supervision department) has not clear powers and responsibilities, and its functions are intersected, and the law enforcement is multi-head. In 2013, the State Council's institutional reform plan adjusted the functions of the food safety regulatory department. The State Council has issued guidelines for local reform and improvement of the food and drug regulatory system. Through the analysis of the existing grass-roots food safety regulatory system adjustment has been achieved. Reference to the United States, Japan, the European Union and Canada and other developed countries more perfect food safety regulatory system and legal system, how to improve the current grass-roots food safety supervision in China put forward suggestions. In order to improve the current situation of food safety supervision in China, rebuild citizens' confidence in food safety. The article is divided into six parts. The first part is the introduction, explaining the research background and significance of this paper, analyzing the current situation of food safety supervision at home and abroad, introducing the research ideas and research methods of the article; The second part is the theoretical basis, analyzes the key concepts in the article, explains the relevant theoretical review, and lays a theoretical foundation for the later research; The third part interprets the current situation of the grass-roots supervision of food safety in China, the main contents include the history, the effectiveness of the grass-roots supervision of food safety in China and the main problems in the grass-roots supervision of food safety in China. In 4th, the author draws lessons from the experience of basic level food safety supervision in foreign countries, including the advanced models of the United States, Japan, Canada and the European Union, and summarizes the measures conducive to improving the supervision mechanism of food safety at the grass-roots level in China. In 5th part, in order to perfect the countermeasures of our country's basic level food safety supervision, it mainly from consummates the laws and regulations system, clarifies the authority scope of the main body of supervision, establishes the authority unified comprehensive coordination organization. Open and transparent national regulatory platform and improve the accountability system for food safety supervision.
