電子商務(wù)中消費者后悔權(quán)問題的研究

【摘要】:電子商務(wù)作為一種新的經(jīng)濟交易方式,對人們的工作和生活的影響越來越深遠,一方面其具有“三全優(yōu)勢”即“全方位”、“全天候”和“全球性”的優(yōu)勢,另一方面由于電子商務(wù)具有快捷、方便、高效和成本低的特點,因此受到許多消費者和商家的喜愛,從而影響著人們的生活和工作。電子商務(wù)與傳統(tǒng)商務(wù)有著本質(zhì)的區(qū)別,電子商務(wù)最大的特點就是具有虛擬性,這使得消費者與商家之間不必當面進行議價、交易,這也導(dǎo)致了消費者對交易商品的服務(wù)、質(zhì)量等很難有一個更準確地把握。所以,在一定程度上,電子商務(wù)的交易模式給消費者增加了相應(yīng)的交易風(fēng)險,容易引起消費者和商家的糾紛和矛盾。而網(wǎng)上購物具有跨地域消費的特點,導(dǎo)致消費者維權(quán)之困難?v觀國外先進的立法經(jīng)驗,后悔權(quán)制度是維護消費者權(quán)益的一項重要制度,后悔權(quán)制度的存在,不僅體現(xiàn)了民法的意思自治、公平正義、誠實信用原則的本質(zhì),也反映了國家對消費者權(quán)益保護問題的政策傾斜。對處于弱勢地位的消費者合法權(quán)益的保護,后悔權(quán)制度的出現(xiàn),無疑具有“雪中送炭”的價值。2014年3月15日新的《消費者權(quán)益保護法》生效后,盡管有條款規(guī)制了消費者的后悔權(quán),但該條款太過于原則化,在具體操作與實際應(yīng)用上還存在諸多問題。為了保障消費者后悔權(quán)制度的實施,筆者認為有必要構(gòu)建消費者反悔權(quán)制度的具體內(nèi)容。本文明確了后悔權(quán)制度的適用范圍、起算時間、行使期限等。同時還借鑒了國外的立法經(jīng)驗和司法實踐,建立了消費者專門機構(gòu)和相應(yīng)的制度來配合協(xié)調(diào),為電子商務(wù)后悔權(quán)制度在我國的完善提供了一定的參考價值。
[Abstract]:As a new way of economic transaction, E-commerce has more and more far-reaching influence on people's work and life. On the one hand, it has the advantages of "all-around", "all-weather" and "global". On the other hand, because of the characteristics of fast, convenient, efficient and low cost, E-commerce is loved by many consumers and merchants, which affects people's life and work. Electronic commerce and traditional commerce have the essential difference, the biggest characteristic of electronic commerce is that it is fictitious, which makes it unnecessary for consumers and merchants to negotiate and trade in person, which also leads to the service of consumers to traded goods. Quality is difficult to have a more accurate grasp. Therefore, to a certain extent, the transaction mode of electronic commerce increases the corresponding transaction risk to consumers and easily causes disputes and contradictions between consumers and merchants. Online shopping has the characteristics of cross-regional consumption, leading to consumer rights difficulties. Throughout the advanced legislative experience of foreign countries, regret right system is an important system to safeguard the rights and interests of consumers. The existence of regret right system not only embodies the essence of the principle of autonomy of will, fairness and justice of civil law, and the principle of good faith. It also reflects the policy preference of the state on the protection of consumer rights and interests. The protection of the legitimate rights and interests of consumers in a weak position, and the emergence of the right of regret system, undoubtedly have the value of "giving a helping hand in time" .After the new Law on the Protection of Consumer Rights and interests came into effect on March 15, 2014, Although there is a clause that regulates consumers' right of regret, it is too principled, and there are still many problems in concrete operation and practical application. In order to ensure the implementation of consumer right of regret, I think it is necessary to construct the specific content of consumer right of repentance. This paper clarifies the scope of application, starting time, duration of exercise of the right of regret system. At the same time, it also draws lessons from the foreign legislative experience and judicial practice, establishes the consumer specialized organization and the corresponding system to coordinate, has provided the certain reference value for the e-commerce regret right system in our country consummation.
