【摘要】：隨著電子商務(wù)和互聯(lián)網(wǎng)的發(fā)展,網(wǎng)絡(luò)帶給人們?cè)S多的便利,但是同時(shí)也有一些不法人士利用網(wǎng)絡(luò)進(jìn)行著違法與犯罪的活動(dòng)。本文通過(guò)一個(gè)真實(shí)的案例來(lái)引出網(wǎng)絡(luò)詐騙犯罪。首先,簡(jiǎn)單說(shuō)明了淘寶詐騙案基本的案情,并從案件當(dāng)中引出了具有爭(zhēng)議的問(wèn)題,這些問(wèn)題為下文網(wǎng)絡(luò)詐騙作了鋪墊。然后,對(duì)案件具有爭(zhēng)議的問(wèn)題進(jìn)行了分析:主要討論了網(wǎng)絡(luò)詐騙犯罪是否成立犯罪集團(tuán),并概括了這類(lèi)犯罪的特征,提出了筆者關(guān)于網(wǎng)絡(luò)詐騙共同犯罪觀點(diǎn);網(wǎng)絡(luò)詐騙犯罪數(shù)額的具體認(rèn)定問(wèn)題,在分析不同的學(xué)說(shuō)的基礎(chǔ)上,提出了筆者關(guān)于確定網(wǎng)絡(luò)詐騙犯罪數(shù)額的觀點(diǎn);本文通過(guò)對(duì)網(wǎng)絡(luò)犯罪的刑事管轄權(quán)分析結(jié)合屬地管轄論、相對(duì)管轄權(quán)論、網(wǎng)址管轄論等理論,提出合理界定網(wǎng)絡(luò)犯罪案件刑事管轄權(quán)的建議。最后,本文對(duì)案件進(jìn)行了總體的評(píng)析,明確了案件的相關(guān)問(wèn)題,加深了對(duì)網(wǎng)絡(luò)詐騙犯罪的思考,并對(duì)網(wǎng)絡(luò)詐騙犯罪進(jìn)行了完善。
[Abstract]:With the development of electronic commerce and the Internet, the network brings people a lot of convenience, but at the same time, there are some lawless people who use the network to carry on the illegal and criminal activities. This article through a real case to lead to network fraud crime. First of all, it briefly explains the basic case of Taobao fraud, and leads to controversial issues from the case, which pave the way for the following network fraud. Then, this paper analyzes the controversial issues of the case: mainly discusses whether the crime of network fraud is a criminal group, summarizes the characteristics of this kind of crime, and puts forward the author's view on the joint crime of network fraud; On the basis of analyzing different theories, the author puts forward the viewpoint of determining the amount of network fraud crime. The relative jurisdiction theory, the website jurisdiction theory and so on theory, put forward the reasonable definition network crime criminal jurisdiction suggestion. Finally, this paper makes a general analysis of the case, clarifies the relevant problems of the case, deepens the thinking on the crime of network fraud, and perfects the crime of network fraud.
