電子商務(wù)環(huán)境下消費(fèi)者權(quán)益的法律保護(hù)研究

【摘要】:隨著經(jīng)濟(jì)水平的不斷發(fā)展和生活水平的不斷提高,電子商務(wù)憑借其時(shí)空不受限、商品展示全面、評(píng)價(jià)公開(kāi)性強(qiáng)和交易快捷實(shí)惠的特點(diǎn)為越來(lái)越多消費(fèi)者所選擇。從2000年至今,我國(guó)的電子商務(wù),尤其是C2C模式取得了長(zhǎng)足發(fā)展,在百姓生活中所占的地位逐步提高,也得到了專家、政府的極大關(guān)注。然而,在電子商務(wù)市場(chǎng)規(guī)模蓬勃發(fā)展,參與人數(shù)急劇增加的同時(shí),現(xiàn)行法律漏洞的客觀因素和經(jīng)營(yíng)者主觀因素的綜合作用導(dǎo)致眾多消費(fèi)者遭到侵害,卻難以得到及時(shí)有效的保護(hù)。如何保護(hù)消費(fèi)者權(quán)益的問(wèn)題也自然而然地成為我國(guó)電子商務(wù)的健康發(fā)展面臨的巨大挑戰(zhàn)。本文從理論分析入手,剖析電子商務(wù)環(huán)境下消費(fèi)者權(quán)益保護(hù)的特點(diǎn)。結(jié)合域外先進(jìn)法律制度之規(guī)定,與我國(guó)現(xiàn)行法律進(jìn)行比較,尋找我國(guó)相關(guān)規(guī)定存在的問(wèn)題,并提出完善電子商務(wù)環(huán)境下我國(guó)消費(fèi)者權(quán)益法律保護(hù)的具體措施,以期促進(jìn)我國(guó)電子商務(wù)立法,促進(jìn)電子商務(wù)發(fā)展。本文正文分為四部分。 第一部分討論了電子商務(wù)環(huán)境下的消費(fèi)者權(quán)益保護(hù)的特點(diǎn),主要總結(jié)出了網(wǎng)絡(luò)交易平臺(tái)對(duì)消費(fèi)者要承擔(dān)保護(hù)責(zé)任、消費(fèi)者權(quán)益內(nèi)容有所擴(kuò)張以及傳統(tǒng)救濟(jì)途徑維權(quán)存在困境等三個(gè)要點(diǎn),為后文的分析打下基礎(chǔ)。 在第二部分中分別介紹了美國(guó)模式、日本模式和歐盟模式,抓出三種模式的特點(diǎn)和優(yōu)勢(shì),并著重列舉與電子商務(wù)中的消費(fèi)者權(quán)益保護(hù)最為緊密的規(guī)定。隨后總結(jié)出三種模式加強(qiáng)保護(hù)力度、注重法律協(xié)調(diào)性、尊重當(dāng)事人意思自治的共同特點(diǎn),進(jìn)而得出發(fā)展我國(guó)相關(guān)法律制度的啟示。 本文在第三部分對(duì)電子商務(wù)環(huán)境下我國(guó)消費(fèi)者權(quán)益保護(hù)的現(xiàn)狀進(jìn)行了研究。該部分首先介紹電子商務(wù)消費(fèi)流程,分析其中的潛在風(fēng)險(xiǎn)并列舉現(xiàn)行法律中存在的解決方案,找出目前我國(guó)在消費(fèi)者保護(hù)方面存在的問(wèn)題,即侵害消費(fèi)者權(quán)益行為的客觀成因。此外,本文還通過(guò)成本收益分析法從經(jīng)營(yíng)者的違法成本、經(jīng)營(yíng)成本和收入之比較的角度,分析侵權(quán)行為主觀成因。 在完成上文分析的基礎(chǔ)上,本文從實(shí)體方面提出解決目前問(wèn)題應(yīng)該采取的立法措施,如擴(kuò)大消費(fèi)者權(quán)益范圍、嚴(yán)格交易平臺(tái)責(zé)任等;從程序方面提出了保障法律有效運(yùn)行的具體制度,如建立在線糾紛解決機(jī)制、設(shè)立小額消費(fèi)糾紛法庭和仲裁制度、調(diào)整現(xiàn)有消費(fèi)者權(quán)益保護(hù)組織等方案。最后,文章對(duì)前文分析進(jìn)行總結(jié),就如何建立具有中國(guó)特色的電子商務(wù)環(huán)境下的消費(fèi)者權(quán)益保護(hù)制度提出綜合性結(jié)論,力圖為電子商務(wù)環(huán)境下我國(guó)消費(fèi)者權(quán)益的法律保護(hù)做出貢獻(xiàn)。
[Abstract]:With the development of economic level and the improvement of living standard, more and more consumers choose electronic commerce because of its unlimited time and space, comprehensive display of goods, strong evaluation of openness and quick and affordable transactions. Since 2000, China's e-commerce, especially the C2C model, has made great progress, and the status in the life of the people has been gradually improved, which has also been paid great attention by experts and the government. However, while the scale of the e-commerce market is booming and the number of participants is increasing sharply, the combined effect of the objective factors of the current legal loopholes and the subjective factors of the operators has led to the infringement of many consumers. But it is difficult to get timely and effective protection. How to protect the rights and interests of consumers has naturally become a great challenge to the healthy development of e-commerce in China. This paper analyzes the characteristics of the protection of consumers' rights and interests under the environment of e-commerce. In combination with the provisions of the foreign advanced legal system, this paper makes a comparison with the current laws of our country, finds out the problems existing in the relevant regulations of our country, and puts forward some concrete measures to improve the legal protection of the rights and interests of consumers in the environment of electronic commerce. In order to promote the legislation of e-commerce in China, promote the development of e-commerce. The text of this paper is divided into four parts. The first part discusses the characteristics of the protection of consumers' rights and interests under the environment of electronic commerce, and summarizes that the network trading platform should bear the responsibility of protecting consumers. The expansion of consumer rights and interests and the dilemmas of traditional remedies lay the foundation for the later analysis. In the second part, the American model, the Japanese model and the European model are introduced respectively. The characteristics and advantages of the three models are discussed, and the most closely related provisions to the protection of consumers' rights and interests in electronic commerce are emphatically listed. Then it summarizes the three models to strengthen the protection, pay attention to the coordination of the law, respect the common characteristics of party autonomy, and then draw the enlightenment of the development of the relevant legal system in China. In the third part of this paper, the current situation of consumer protection in e-commerce environment is studied. This part first introduces the process of e-commerce consumption, analyzes the potential risks and enumerates the existing solutions in the current law, and finds out the existing problems in consumer protection in our country, that is, the objective cause of the infringement of consumer rights and interests. In addition, this paper also analyzes the subjective causes of tort from the perspective of the comparison of illegal cost, operating cost and income of the operator through cost-benefit analysis. On the basis of the above analysis, this paper puts forward some legislative measures to solve the current problems, such as expanding the scope of consumers' rights and interests, strictly enforcing the liability of trading platform, and so on. From the aspect of procedure, this paper puts forward specific systems to ensure the effective operation of law, such as establishing online dispute resolution mechanism, setting up small consumption dispute court and arbitration system, adjusting existing consumer rights and interests protection organizations and so on. Finally, the article summarizes the previous analysis, and puts forward a comprehensive conclusion on how to establish the consumer rights and interests protection system under the electronic commerce environment with Chinese characteristics. Try to make a contribution to the legal protection of consumer rights and interests under the environment of e-commerce.
