【摘要】:快遞行業(yè)作為一種新興獨(dú)立的行業(yè),是我國市場經(jīng)濟(jì)的重要組成部分,在降低流通成本、支撐電子商務(wù)、服務(wù)生產(chǎn)生活、擴(kuò)大就業(yè)渠道等方面的積極作用日益顯現(xiàn)。然而由于政府對(duì)快遞行業(yè)市場監(jiān)管不力,甚至市場監(jiān)管缺位,我國快遞行業(yè)發(fā)展依然面臨諸多問題。因此如何對(duì)快遞行業(yè)進(jìn)行市場監(jiān)管,是值得我們深思的話題。本論文將深刻探討我國快遞行業(yè)市場監(jiān)管的現(xiàn)狀及困境,并結(jié)合國際上典型國家的市場監(jiān)管經(jīng)驗(yàn),提出完善我國快遞行業(yè)市場監(jiān)管的對(duì)策建議。本論文具體由以下由六部分構(gòu)成:第一章緒論。筆者在緒論中闡述了我國快遞行業(yè)市場監(jiān)管的背景及意義、國內(nèi)外研究現(xiàn)狀、研究思路與方法以及主要?jiǎng)?chuàng)新點(diǎn)與不足之處。第二章我國快遞行業(yè)市場監(jiān)管的理論基礎(chǔ)。首先,介紹了快遞服務(wù)與市場監(jiān)管的涵義;其次,解釋了市場失靈理論、市場風(fēng)險(xiǎn)理論、政府職能理論與政府規(guī)制理論,并且闡述了這些理論在快遞行業(yè)市場監(jiān)管中的應(yīng)用。第三章我國快遞行業(yè)市場監(jiān)管的現(xiàn)狀與困境。第一,筆者從四個(gè)維度分析了我國快遞行業(yè)發(fā)展的概況;其次,筆者通過表格的形式呈現(xiàn)了我國快遞行業(yè)市場監(jiān)管的現(xiàn)狀及總體情況;第三,探討了我國快遞行業(yè)市場監(jiān)管的困境,即市場監(jiān)管標(biāo)準(zhǔn)不明確、監(jiān)管主體不明、監(jiān)管客體參差不齊以及快遞行業(yè)信息不標(biāo)準(zhǔn);最后,分析了我國快遞行業(yè)市場監(jiān)管困境產(chǎn)生的原因,即市場監(jiān)管立法體系不完善、快遞行業(yè)市場監(jiān)管體制不健全、市場準(zhǔn)入與退出監(jiān)管不力與快遞行業(yè)市場信息披露制度不完善。第四章國外快遞行業(yè)市場監(jiān)管典型經(jīng)驗(yàn)與啟示。首先,研究了美國、德國和日本關(guān)于快遞行業(yè)市場監(jiān)管的經(jīng)驗(yàn);其次,總結(jié)出典型國家快遞行業(yè)市場監(jiān)管經(jīng)驗(yàn)對(duì)我國的啟示,即準(zhǔn)確定位監(jiān)管部門、健全快遞行業(yè)法律體系、倡導(dǎo)行業(yè)自律與堅(jiān)持監(jiān)管創(chuàng)新。第五章完善我國快遞行業(yè)市場監(jiān)管的對(duì)策建議。筆者提出了完善我國快遞行業(yè)市場監(jiān)管的對(duì)策建議,即加強(qiáng)快遞市場法制化建設(shè)、建立健全快遞行業(yè)市場監(jiān)管體制、完善快遞行業(yè)市場準(zhǔn)入與準(zhǔn)出的監(jiān)管、規(guī)范快遞行業(yè)市場信息披露制度與推動(dòng)快遞行業(yè)市場監(jiān)管國際合作,以期對(duì)我國當(dāng)前快遞行業(yè)市場監(jiān)管工作提供一定的參考。第六章全文總結(jié)與展望。筆者對(duì)全文進(jìn)行總結(jié),并對(duì)未來我國快遞行業(yè)市場監(jiān)管寄予了深厚的希望。
[Abstract]:As a new and independent industry, express delivery industry is an important part of market economy in our country. It plays an increasingly active role in reducing circulation cost, supporting electronic commerce, serving production and life, expanding employment channels and so on. However, the development of express delivery industry in China still faces many problems due to the lack of government supervision over the express industry and even the absence of market supervision. Therefore how to carry on the market supervision to the express delivery industry, is worth our deep thought topic. This paper will deeply discuss the present situation and predicament of the market supervision of express industry in our country, and combine the experience of market supervision of typical countries in the world, put forward the countermeasures and suggestions to perfect the market supervision of express industry in our country. This thesis is composed of six parts: the first chapter is introduction. In the introduction, the author expounds the background and significance of the market supervision of express delivery industry in China, the current research situation at home and abroad, the research ideas and methods, as well as the main innovation points and deficiencies. The second chapter is the theoretical basis of market supervision of express delivery industry in China. First, it introduces the meaning of express service and market supervision; secondly, explains the theory of market failure, market risk, government function theory and government regulation theory, and expounds the application of these theories in express industry market supervision. The third chapter is the current situation and predicament of the market supervision of express delivery industry in China. First, the author analyzes the development of express industry in China from four dimensions; secondly, the author presents the status quo and overall situation of express industry market supervision through the form of tables. Third, This paper probes into the difficulties of market supervision in express delivery industry in China, that is, the market supervision standard is unclear, the subject of supervision is unclear, the object of supervision is uneven, and the information of express industry is not standard. This paper analyzes the reasons for the difficulties in the market supervision of express industry in China, that is, the imperfect legislative system of market supervision, the imperfect supervision system of express market, the weak supervision of market access and withdrawal and the imperfect disclosure system of market information in express industry. Chapter four: typical experience and enlightenment of foreign express market supervision. First of all, it studies the experience of the express delivery industry market supervision in the United States, Germany and Japan. Secondly, it summarizes the enlightenment of the typical countries' market supervision experience to our country, that is, to accurately locate the supervision department and perfect the express delivery industry legal system. Advocate industry self-discipline and adhere to regulatory innovation. The fifth chapter consummates our country express industry market supervision countermeasure suggestion. The author puts forward the countermeasures and suggestions to perfect the market supervision of express industry in China, that is, to strengthen the legal construction of express delivery market, to establish and perfect the supervision system of express industry market, to perfect the supervision of market access and permission of express industry. Standardizing the market information disclosure system of express delivery industry and promoting international cooperation in market supervision of express industry are expected to provide some reference for the current market supervision of express industry in China. Chapter six summarizes and prospects the full text. The author summarizes the full text, and the future express industry market supervision placed deep hope.
