淺論電子商務(wù)中消費(fèi)者隱私權(quán)的保護(hù)

【摘要】: 電子商務(wù)作為一種嶄新的商務(wù)模式,是未來經(jīng)濟(jì)發(fā)展的巨大推動(dòng)力,將成為二十一世紀(jì)世界經(jīng)濟(jì)活動(dòng)的核心。但是,網(wǎng)絡(luò)的開放性給個(gè)人隱私權(quán),特別是消費(fèi)者的隱私權(quán)造成極大的困難。隱私權(quán)保護(hù)問題已成為困擾電子商務(wù)發(fā)展的重要障礙。傳統(tǒng)商務(wù)中的許多法律制度不能完全適用電子商務(wù)的要求,特別是我國法律上對(duì)隱私權(quán)保護(hù)存在諸多的問題和不足,阻礙了我國的個(gè)人隱私權(quán)保護(hù)的發(fā)展進(jìn)程,阻礙了我國電子商務(wù)的發(fā)展。本文主要闡述電子商務(wù)中消費(fèi)者隱私權(quán)的涵義、特征,介紹各國保護(hù)的主要模式,重點(diǎn)是介紹美國的行業(yè)自律模式和歐盟的立法保護(hù)模式,詳細(xì)分析我國保護(hù)的法律現(xiàn)狀,指出我國電子商務(wù)中消費(fèi)者隱私權(quán)保護(hù)存在的問題和不足,提出對(duì)完善我國的電子商務(wù)中消費(fèi)者隱私權(quán)保護(hù)幾點(diǎn)建議,最后闡述了電子商務(wù)中消費(fèi)者隱私權(quán)的特殊保護(hù)問題。希望通過本文的論述能對(duì)我國保護(hù)電子商務(wù)中消費(fèi)者隱私權(quán)有所裨益。
[Abstract]:Electronic commerce, as a new business model, will become the core of the world economic activities in the 21 ~ (th) century. However, the openness of the network brings great difficulties to the privacy of individuals, especially consumers. The protection of privacy has become an important obstacle to the development of e-commerce. Many legal systems in traditional commerce can not fully apply to the requirements of electronic commerce. Especially, there are many problems and deficiencies in the protection of privacy in our law, which hinder the development of personal privacy protection in our country. It hinders the development of e-commerce in our country. This paper mainly describes the meaning and characteristics of consumer privacy in electronic commerce, introduces the main modes of protection in various countries, focuses on the industry self-discipline model in the United States and the legislative protection model in the European Union, and analyzes the legal status quo of China's protection in detail. This paper points out the problems and shortcomings of consumer privacy protection in electronic commerce in our country, puts forward some suggestions for perfecting consumer privacy protection in electronic commerce in our country, and finally expounds the special protection problem of consumer privacy right in electronic commerce. It is hoped that this paper will benefit the protection of consumer privacy in e-commerce in China.
