電子合同錯(cuò)誤下的消費(fèi)者權(quán)益保護(hù)研究

【摘要】:當(dāng)前,由于網(wǎng)購(gòu)的普及,因電子合同錯(cuò)誤所導(dǎo)致的消費(fèi)者權(quán)益受損的案件逐年遞增。有鑒于目前缺乏直接的法律依據(jù),致使實(shí)踐中消費(fèi)者合法權(quán)益得不到有效保障,甚至由此引發(fā)的訴訟案件也無(wú)法得到妥善的解決。消費(fèi)者權(quán)益保護(hù)不僅是世界各國(guó)以及國(guó)際組織所關(guān)注的焦點(diǎn),也是與人民生活水平息息相關(guān)的重要環(huán)節(jié)。倘若在電子商務(wù)的發(fā)展中,消費(fèi)者權(quán)益不能得到很好的維護(hù),那么這一朝陽(yáng)產(chǎn)業(yè)將勢(shì)必走向萎靡。本文分為以下三個(gè)部分進(jìn)行研究:第一部分對(duì)電子合同錯(cuò)誤進(jìn)行了界定并進(jìn)行相關(guān)實(shí)例分析。電子合同錯(cuò)誤應(yīng)當(dāng)是在傳統(tǒng)合同錯(cuò)誤以下,包含著電子信息系統(tǒng)產(chǎn)生的主客觀錯(cuò)誤因素。如果就其致成對(duì)象為條件來(lái)進(jìn)行類型劃分,可以分為平臺(tái)內(nèi)經(jīng)營(yíng)者、信息系統(tǒng)、未經(jīng)授權(quán)者、不可抗力及意外事件、網(wǎng)絡(luò)服務(wù)經(jīng)營(yíng)商所導(dǎo)致的電子合同錯(cuò)誤。本文根據(jù)實(shí)際案例情況,歸納了現(xiàn)實(shí)生活中由不同的致成對(duì)象所造成的消費(fèi)者權(quán)益受損的情形。第二部分針對(duì)第一部分中電子合同錯(cuò)誤情形下的消費(fèi)者權(quán)益受損情況提出目前法律及實(shí)踐中存在的相關(guān)問(wèn)題。立法方面,我國(guó)并沒(méi)有關(guān)于電子合同錯(cuò)誤的相關(guān)立法,在借鑒《合同法》的過(guò)程中,對(duì)于重大誤解的適用問(wèn)題仍存在分歧。另外,在消費(fèi)者權(quán)益賠償方面,對(duì)于其信賴責(zé)任以及締約過(guò)失責(zé)任應(yīng)當(dāng)進(jìn)行區(qū)分,以合理保護(hù)消費(fèi)者利益為前提。最后,由于電子合同錯(cuò)誤致使消費(fèi)者權(quán)益受損時(shí),消費(fèi)者維權(quán)程序方面仍然存在著消費(fèi)者訴訟主體認(rèn)定困難、取證困難等問(wèn)題。第三部分討論對(duì)策性問(wèn)題,以第二部分的法律問(wèn)題為基礎(chǔ),在此基礎(chǔ)上提出解決對(duì)策。對(duì)于重大誤解方面,可以借鑒德國(guó)的錯(cuò)誤制度,確立我國(guó)的意思表示錯(cuò)誤制度,明確重大誤解制度的內(nèi)涵。其次,從規(guī)范錯(cuò)誤損害賠償責(zé)任來(lái)規(guī)范當(dāng)前消費(fèi)者求償中出現(xiàn)的問(wèn)題。最后,通過(guò)舉證責(zé)任倒置等方面的舉措,來(lái)完善消費(fèi)者維權(quán)訴訟程序。
[Abstract]:At present, due to the popularity of online shopping, the cases of consumer rights and interests caused by electronic contract errors have increased year by year. In view of the lack of direct legal basis, the legal rights and interests of consumers in practice can not be effectively guaranteed, and even the resulting litigation cases are not properly solved. The protection of consumer rights and interests is not only It is the focus of the world and international organizations, and it is also an important link with the living standard of the people. If the consumer's rights and interests can not be maintained well in the development of electronic commerce, the sunrise industry will be bound to decline. This article is divided into the following three parts: the first part is on the electronic integration. The error of the same error is defined and analyzed. The error of the electronic contract should be under the traditional contract error, including the subjective and objective error factors produced by the electronic information system. If the type is divided on the condition of the target, it can be divided into the operator, the information system, the unauthorized person, the force majeure and the intention. External events, electronic contract errors caused by network service operators. This article, based on actual cases, sums up the situation of consumer rights and interests caused by different targets in real life. The second part puts forward the current law and the actual situation of the loss of the rights and interests of the consumers in the first part of the electronic contract. On the legislative aspect, there is no relevant legislation on the error of electronic contracts in our country. In the course of reference to the contract law, there are still differences in the application of the major misunderstandings. In addition, in the respect of the compensation for the rights and interests of consumers, the liability for trust and the liability for negligence in contracting parties should be distinguished in order to protect and eliminate them. In the third part, the third part discusses the problem of countermeasures, based on the legal problems in second parts, and puts forward the Countermeasures on the basis of this. In the aspect of big misunderstanding, we can learn from the wrong system in Germany, establish the wrong system of meaning in our country and clarify the connotation of the system of major misunderstanding. Secondly, standardize the problems arising from the current consumer claims from the standard error damage compensation responsibility. Finally, through the measures of the inversion of the burden of proof, we can improve the litigation procedure of the consumer rights protection.
