論網(wǎng)絡(luò)零售平臺(tái)銷(xiāo)假行為及其法律規(guī)制

【摘要】:在中國(guó)網(wǎng)絡(luò)交易快速增長(zhǎng)的時(shí)代背景下,網(wǎng)絡(luò)零售平臺(tái)銷(xiāo)售假貨問(wèn)題日漸突出,并對(duì)消費(fèi)者與被侵權(quán)企業(yè)權(quán)益,甚至網(wǎng)絡(luò)零售產(chǎn)業(yè)等產(chǎn)生巨大的負(fù)面影響。而且網(wǎng)絡(luò)售假發(fā)展至今,其已經(jīng)不僅僅是網(wǎng)絡(luò)技術(shù)、經(jīng)濟(jì)或者管理上的問(wèn)題,業(yè)已成為一個(gè)嚴(yán)重的困擾法律理論界與實(shí)務(wù)界的問(wèn)題。而售假行為的網(wǎng)絡(luò)化,必然要求法律規(guī)制向網(wǎng)絡(luò)領(lǐng)域的延伸。本文選題緊扣現(xiàn)實(shí)問(wèn)題的需要,是法律對(duì)網(wǎng)絡(luò)經(jīng)濟(jì)發(fā)展中存在問(wèn)題的回應(yīng),不僅具有一定理論意義,還有重大的實(shí)踐價(jià)值。本文以網(wǎng)絡(luò)零售平臺(tái)的售假行為為研究對(duì)象,在綜合分析網(wǎng)絡(luò)售假行為成因的基礎(chǔ)上,以網(wǎng)絡(luò)售假行為的直接參與主體與相關(guān)監(jiān)督主體為視角,提出了綜合性的對(duì)策建議。在研究過(guò)程中,既涉及相關(guān)理論熱點(diǎn)問(wèn)題,例如自然人商事主體制度以及知假買(mǎi)假的消費(fèi)者能否獲得懲罰性賠償;又存在某些實(shí)踐領(lǐng)域問(wèn)題,例如新型市場(chǎng)監(jiān)管機(jī)制以及在線糾紛解決機(jī)制在我國(guó)的發(fā)展現(xiàn)狀及存在的不足。本文引言部分主要介紹網(wǎng)絡(luò)售假行為的時(shí)代背景,規(guī)制網(wǎng)絡(luò)售假行為的研究回顧,研究方法以及本文創(chuàng)新與不足;第一章對(duì)是對(duì)相關(guān)法律概念范疇進(jìn)行的分析與界定;第二章與第三章是網(wǎng)絡(luò)售假行為特點(diǎn)、危害及其成因分析,反映出以法律手段規(guī)制網(wǎng)絡(luò)售假的必要性和迫切性;第四章從規(guī)范自然人商事主體制度與平臺(tái)責(zé)任、發(fā)揮消費(fèi)者的監(jiān)督作用、完善新型市場(chǎng)監(jiān)管機(jī)制與在線糾紛解決機(jī)制等五個(gè)方面提出對(duì)策建議;最后是對(duì)全文的總結(jié)。
[Abstract]:The rapid growth in Chinese network trading background, online retail platform selling fake issues have become increasingly prominent, and the consumer and the infringement of enterprise rights have a tremendous negative impact even online retail industry. And selling network development so far, it has not only network technology, economy or management problems, has become a by the legal theory and practice of the serious problem. And the selling behavior of network, extending the inevitable requirement of legal regulation to the field of network. According to the practical problems of the needs in the topic of this paper, the problem is the legal response to the development of network economy, not only has a certain theoretical significance and great practical value. In this paper, selling the behavior of online retail platform as the research object, based on a comprehensive analysis of the network and selling behavior causes, with the network and selling behavior are directly involved in the subject and The relevant supervision perspective, put forward comprehensive countermeasures. In the course of the study, not only relates to the theory about the hot spots, such as the commercial subject system of natural person and buying fake consumers can obtain punitive damages; and there are some problems such as the practice field, new market supervision mechanism and the online dispute resolution mechanism in current development our country and the problems in this paper. The introduction part mainly introduces the background of the network and selling behavior, regulation of network selling behavior research review, research methods and the innovation and deficiencies; Chapter one is to define and analyze the relevant legal concepts; the second chapter and the third chapter is the network and selling behavior, harm and the analysis of its causes, to reflect the necessity of legal means to regulate the network selling and urgency; the fourth chapter from the norms of commercial subject natural person system and platform Responsibility, giving full play to the supervision role of consumers, perfecting the new market supervision mechanism and online dispute resolution mechanism, and putting forward five suggestions, finally, the conclusion of the full text.
