【摘要】:電子商務(wù)作為當(dāng)今社會發(fā)展的一種新型市場交易模式,,在現(xiàn)在生活中得應(yīng)用越來越廣泛,電子商務(wù)具有快捷,便利等特點,反映著未來貿(mào)易方式的發(fā)展方向,在其蓬勃發(fā)展的同時,得到了社會的普遍贊同和認(rèn)可。電子商務(wù)市場是現(xiàn)在發(fā)展最快,最具潛力的領(lǐng)域,電子商務(wù)的迅速發(fā)展和應(yīng)用,推動著社會生產(chǎn)力的發(fā)展,是全球經(jīng)濟(jì)增長最具潛力的領(lǐng)域之一。未來貿(mào)易方式因電子科技的發(fā)展而發(fā)生改變,電子商務(wù)代表著未來經(jīng)濟(jì)的發(fā)展方向,電子商務(wù)越來越滲入到現(xiàn)在經(jīng)濟(jì)活動的每一個細(xì)胞中,使得傳統(tǒng)貿(mào)易市場向電子商務(wù)市場轉(zhuǎn)變。改革開放以來,我國經(jīng)濟(jì)快速發(fā)展,經(jīng)營方式也越來越多元化,與國外相比較,國內(nèi)電子商務(wù)發(fā)展起步晚,但是其發(fā)展速度卻很迅速。中國電子商務(wù)的發(fā)展,為國內(nèi)貿(mào)易市場開拓了一條新的發(fā)展道路,電子商務(wù)市場在給社會經(jīng)濟(jì)帶來便利的同時,也帶來了很多問題。電子商務(wù)市場是新型市場,相關(guān)法律法規(guī)不健全,電子商務(wù)行政監(jiān)督手段落后,使得電子商務(wù)發(fā)展過程中,出現(xiàn)很多違法犯罪問題。競爭秩序,競爭機(jī)制混亂,消費者權(quán)益得不到保護(hù),都影響著電子商務(wù)市場的正常發(fā)展,危害電子商務(wù)市場的正常經(jīng)營秩序。建立良好,有序的電子商務(wù)競爭秩序,營造良好的購物環(huán)境,完善電子商務(wù)相關(guān)法律法規(guī)的空缺,是政府相關(guān)部門必須解決的問題。如果讓電子商務(wù)市場的發(fā)展在正確軌道上前行,指引和規(guī)范電子商務(wù)合理有序發(fā)展,政府相關(guān)部門必須擔(dān)負(fù)起相關(guān)責(zé)任。作為政府實施經(jīng)濟(jì)監(jiān)督的重要職能部門之一的工商行政管理部門,具有監(jiān)管社會主義市場的責(zé)任和使命,要全面履行市場監(jiān)督管理和行政執(zhí)法職能,就必須對當(dāng)前電子商務(wù)市場進(jìn)行深刻的研究和討論,監(jiān)管電子商務(wù)市場的運行,是工商行政管理機(jī)關(guān)的責(zé)任與職責(zé)之一。 本文在分析目前我國電子商務(wù)發(fā)展現(xiàn)狀,借鑒歐美國家和國際組織的法律法規(guī)和監(jiān)管措施之上,并通過對國內(nèi)電子商務(wù)市場的功能分析,從工商行政管理部門的職能出發(fā),確定工商行政管理部門在電子商務(wù)市場的位置以及扮演的角色,分別從立法,市場準(zhǔn)入,廣告監(jiān)督及消費者權(quán)利保護(hù)等方面闡述工商行政管理部門應(yīng)改變傳統(tǒng)的監(jiān)管方式,以適應(yīng)對電子商務(wù)市場的有效監(jiān)管,維護(hù)電子商務(wù)市場的公平競爭秩序,創(chuàng)造良好的市場環(huán)境,促進(jìn)其健康有序發(fā)展。希望通過本文的探討,幫助工商管理部門找到自己的定位,改革創(chuàng)新出有效的服務(wù)措施和監(jiān)管方式,更好的推薦電子商務(wù)的積極健康的發(fā)展。
[Abstract]:E-commerce, as a new type of market transaction mode, has been used more and more widely in our daily life. E-commerce has the characteristics of quickness and convenience, which reflects the development direction of the future trade mode. At the same time, it has been widely approved and recognized by the society. The e-commerce market is the fastest growing, the most potential field, the rapid development and application of e-commerce. Promoting the development of social productivity is one of the most potential areas of global economic growth. The future trade mode is changed by the development of electronic science and technology, e-commerce represents the future direction of economic development. E-commerce is increasingly infiltrating into every cell of economic activity, making the traditional trade market turn to e-commerce market. Since the reform and opening up, China's economy has developed rapidly, and the mode of operation has become more and more diversified. Compared with foreign countries, the development of domestic electronic commerce started late, but its development speed is very fast. The development of China's electronic commerce has opened up a new way for the domestic trade market. E-commerce market brings convenience to social economy, but also brings a lot of problems. E-commerce market is a new market, the relevant laws and regulations are not perfect, electronic commerce administrative supervision means lag behind. The process of e-commerce development, there are a lot of illegal and criminal issues. Competition order, competition mechanism chaos, consumer rights and interests can not be protected, all affect the normal development of e-commerce market. Endanger the normal business order of e-commerce market. Establish a good and orderly electronic commerce competition order, create a good shopping environment, improve the vacancy of e-commerce laws and regulations. If the development of e-commerce market is on the right track, guide and standardize the rational and orderly development of e-commerce. As one of the important functional departments of the government to implement economic supervision, the administrative department for industry and commerce has the responsibility and mission of supervising the socialist market. In order to fully perform the functions of market supervision, management and administrative law enforcement, it is necessary to conduct profound research and discussion on the current electronic commerce market and supervise the operation of the electronic commerce market. It is one of the responsibilities and responsibilities of the industrial and commercial administrative organs. This paper analyzes the current development of e-commerce in China, drawing lessons from the European and American countries and international organizations of laws and regulations and regulatory measures, and through the analysis of the functions of the domestic e-commerce market. Starting from the functions of the administrative department for industry and commerce, this paper determines the position and role of the administrative department of industry and commerce in the electronic commerce market, respectively from the perspective of legislation and market access. Advertising supervision and consumer rights protection and other aspects of the administrative departments for industry and commerce should change the traditional way of supervision in order to adapt to the effective supervision of the electronic commerce market and maintain the fair competition order of the electronic commerce market. To create a good market environment to promote its healthy and orderly development. Through this discussion, I hope to help the business administration to find its own position, reform and innovation of effective service measures and regulatory methods. Better recommend the positive and healthy development of e-commerce.
