我國(guó)文化產(chǎn)業(yè)行政指導(dǎo)的系統(tǒng)化與規(guī)范化研究

【摘要】:文化產(chǎn)業(yè)是我國(guó)國(guó)民經(jīng)濟(jì)的支柱性產(chǎn)業(yè),也是滿足民眾精神文明需求的重要途徑。而行政指導(dǎo)是對(duì)行政法治的補(bǔ)充和配合,也是對(duì)政企關(guān)系的協(xié)調(diào)與增進(jìn)。善用行政指導(dǎo),對(duì)于我國(guó)文化產(chǎn)業(yè)的全面、協(xié)調(diào)及可持續(xù)的發(fā)展,應(yīng)是不無(wú)助益。行政指導(dǎo)方式靈活多樣,為許多國(guó)家及地區(qū)普遍采用。市場(chǎng)經(jīng)濟(jì)先進(jìn)國(guó)家及地區(qū)實(shí)施行政指導(dǎo)尤其是實(shí)施文化產(chǎn)業(yè)行政指導(dǎo)的經(jīng)驗(yàn)和教訓(xùn),頗堪我們研究和借鑒。本論文作者考究了美、英、法、德、日、韓六大國(guó)家及我國(guó)臺(tái)灣地區(qū)的文化產(chǎn)業(yè)行政指導(dǎo)實(shí)踐,以濟(jì)于我國(guó)文化產(chǎn)業(yè)行政指導(dǎo)的系統(tǒng)化及規(guī)范化。為促成我國(guó)文化產(chǎn)業(yè)行政指導(dǎo)的系統(tǒng)化,必須加強(qiáng)七個(gè)方面的行政指導(dǎo),包括人才培養(yǎng)、集聚經(jīng)營(yíng)、融資、版權(quán)、信息、技術(shù)、應(yīng)急等方面的行政指導(dǎo)。而我國(guó)文化產(chǎn)業(yè)行政指導(dǎo)的規(guī)范化建設(shè),更是當(dāng)務(wù)之急。依筆者看來(lái),為求取我國(guó)文化產(chǎn)業(yè)行政指導(dǎo)的規(guī)范化,必須認(rèn)真考慮下列七個(gè)方面:一是行政指導(dǎo)立法完善,二是行政指導(dǎo)主體規(guī)范化,三是行政指導(dǎo)程序規(guī)范化,四是行政指導(dǎo)保障措施規(guī)范化,五是行政指導(dǎo)救濟(jì)規(guī)范化,六是純正型行政指導(dǎo)法律責(zé)任規(guī)范化,七是非純正型行政指導(dǎo)法律責(zé)任規(guī)范化。
[Abstract]:Cultural industry is the pillar industry of our national economy and an important way to meet the needs of the people's spiritual civilization. The administrative guidance is the complement and cooperation to the administrative rule of law, and also the coordination and enhancement of the relationship between government and enterprises. The proper use of administrative guidance should be helpful to the overall, coordinated and sustainable development of our cultural industry. The way of administrative guidance is flexible and diverse, and is widely used in many countries and regions. The experience and lessons of implementing administrative guidance in advanced countries and regions of market economy, especially in cultural industry, are quite worthy of our study and reference. The author of this paper investigates the administrative guidance practice of cultural industry in six countries, including the United States, Britain, France, Germany, Japan, South Korea and Taiwan, in order to systematize and standardize the administrative guidance of cultural industry in China. In order to systematize the administrative guidance of cultural industry in China, we must strengthen the administrative guidance in seven aspects, including personnel training, agglomeration management, financing, copyright, information, technology, emergency and so on. But our country culture industry administration instruction standardization construction, is the urgent matter. From the author's point of view, in order to standardize the administrative guidance of our cultural industry, we must seriously consider the following seven aspects: first, the perfection of the administrative guidance legislation, the second is the standardization of the main body of the administrative guidance, and the third is the standardization of the administrative guidance procedure. The fourth is the standardization of administrative guidance guarantee measures, the fifth is the standardization of administrative guidance relief, the sixth is the standardization of legal responsibility of pure administrative guidance, and the seventh is the standardization of legal responsibility of non-pure administrative guidance.
