【摘要】：我國(guó)主要是一個(gè)農(nóng)業(yè)大國(guó),農(nóng)村中農(nóng)民人口比例占絕大多數(shù)。為了使農(nóng)民切身的社會(huì)權(quán)、生命健康權(quán)這兩項(xiàng)最基本的權(quán)利可以得到保障,本文通過參照多數(shù)學(xué)者的研究意見成果,試圖推進(jìn)最新的適應(yīng)我國(guó)新型農(nóng)村合作醫(yī)療制度發(fā)展的最新模式。新型農(nóng)村合作醫(yī)療制度(以下簡(jiǎn)稱“新農(nóng)合”制度)與傳統(tǒng)的農(nóng)村合作醫(yī)療制度相比較主要的突破點(diǎn)在于強(qiáng)化了政府責(zé)任在制度構(gòu)建中的重要作用。在政府實(shí)施監(jiān)管的過程中本文又著重探討在政府職責(zé)監(jiān)管過程中加入法治強(qiáng)制力的重要意義。只有政府責(zé)任在立法模式下有統(tǒng)一具體的執(zhí)行標(biāo)準(zhǔn)才能更加有效的完善新型農(nóng)村合作醫(yī)療制度的運(yùn)行。本文通過研究引入政府責(zé)任的法理基礎(chǔ)闡釋法律強(qiáng)制力在制度執(zhí)行當(dāng)中的重要作用。厘清了引入政府責(zé)任的法理基礎(chǔ)的原因,通過法治強(qiáng)制力與政府職能部門的執(zhí)行力相結(jié)合,探索出最適合我國(guó)新型農(nóng)村合作醫(yī)療制度成熟發(fā)展的長(zhǎng)遠(yuǎn)道路。
[Abstract]:Our country is a big agricultural country mainly, the peasant population proportion in the countryside accounts for the overwhelming majority. In order to ensure the farmers' social rights, the two most basic rights of life and health can be protected. In this paper, we refer to the research results of most scholars. Try to promote the latest new rural cooperative medical system to adapt to the development of the latest model. The main breakthrough point of the new rural cooperative medical system (hereinafter referred to as "the new rural cooperative medical system") compared with the traditional rural cooperative medical care system is to strengthen the important role of the government responsibility in the construction of the system. In the process of government supervision, this paper focuses on the importance of adding the rule of law in the process of government responsibility supervision. Only when the government is responsible in the legislative mode, can it be more effective to perfect the operation of the new rural cooperative medical system. Through the study of the legal basis of the introduction of government responsibility, this paper explains the important role of legal enforcement in the implementation of the system. This paper clarifies the reasons for introducing the legal basis of government responsibility and explores the long-term road that is most suitable for the mature development of the new rural cooperative medical system through the combination of the enforcement of the rule of law and the executive power of the government functional departments.
