【摘要】：工傷保險(xiǎn)制度是社會(huì)保險(xiǎn)制度的一項(xiàng)重要組成部分，，有利于勞動(dòng)者在遭受工傷事故及職業(yè)病危害后得到有效的救助。根據(jù)國際社會(huì)保險(xiǎn)協(xié)會(huì)（ISSA）的統(tǒng)計(jì)，迄今為止，世界上已經(jīng)有160多個(gè)國家建立了工傷保險(xiǎn)方面的法律法規(guī)，另外30多個(gè)國家也有關(guān)于工傷事故方面的立法，其中，日本的工傷保險(xiǎn)制度起步較早，理念較為先進(jìn)，體系也較為完善。本文試圖通過比較中日工傷保險(xiǎn)制度的內(nèi)容，分析各項(xiàng)制度安排差異及利弊，針對(duì)目前我國工傷保險(xiǎn)制度存在的重點(diǎn)問題提出相應(yīng)的對(duì)策。 本文首先簡述了研究背景、研究意義、文獻(xiàn)綜述以及研究方法等，其次概述了工傷以及工傷保險(xiǎn)的相關(guān)概念、工傷保險(xiǎn)的特點(diǎn)和原則，然后介紹了我國和日本工傷保險(xiǎn)制度的概況，再次通過比較中日工傷保險(xiǎn)的繳費(fèi)制度，對(duì)覆蓋范圍和費(fèi)率制度進(jìn)行了詳細(xì)的比較分析；通過比較中日工傷保險(xiǎn)的待遇給付制度，對(duì)工傷認(rèn)定和待遇給付進(jìn)行了詳細(xì)的比較分析；通過比較中日工傷保險(xiǎn)管理制度，對(duì)管理機(jī)構(gòu)和工傷保險(xiǎn)基金進(jìn)行了比較分析，最后結(jié)合日本工傷保險(xiǎn)制度的特色經(jīng)驗(yàn)和我國的基本國情，提出完善我國工傷保險(xiǎn)制度的建議。
[Abstract]:Industrial injury insurance system is an important part of social insurance system, which is helpful for workers to get effective relief after suffering from industrial accidents and occupational diseases. According to the statistics of the International Social Insurance Association (ISSA), so far, more than 160 countries in the world have established laws and regulations on industrial injury insurance, and more than 30 countries also have legislation on industrial accidents, among which, Japan's industrial injury insurance system started earlier, more advanced ideas, the system is more perfect. This paper attempts to compare the contents of China and Japan's industrial injury insurance system, analyzes the differences of the system arrangement and its advantages and disadvantages, and puts forward corresponding countermeasures against the key problems existing in the present industrial injury insurance system in China. This paper firstly introduces the research background, significance, literature review and research methods, and then summarizes the related concepts of industrial injury and industrial injury insurance, the characteristics and principles of industrial injury insurance. Then it introduces the general situation of the industrial injury insurance system in China and Japan, and then compares the payment system of the injury insurance between China and Japan, and makes a detailed comparative analysis of the coverage and the rate system, and compares the treatment and payment system of the injury insurance between China and Japan. By comparing the management system of injury insurance between China and Japan, the author makes a comparative analysis on the management organization and the fund of industrial injury insurance. Finally, based on the characteristic experience of Japan's industrial injury insurance system and the basic national conditions of our country, some suggestions are put forward to perfect our country's industrial injury insurance system.
