基于利益相關(guān)者的我國(guó)旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的優(yōu)化研究

【摘要】:旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品是國(guó)家旅游局牽頭推出的旅行社責(zé)任保險(xiǎn)產(chǎn)品,是針對(duì)旅行社專門設(shè)計(jì)的,該產(chǎn)品的推出在很大程度上解決了原旅行社責(zé)任保險(xiǎn)產(chǎn)品存在的問(wèn)題,因此可以作為目前國(guó)內(nèi)旅行社責(zé)任保險(xiǎn)產(chǎn)品的代表。但是作為新生產(chǎn)品,該項(xiàng)目在市場(chǎng)運(yùn)行時(shí)間僅僅3年,在實(shí)際操作中出現(xiàn)了諸多問(wèn)題。目前亟需對(duì)這一示范產(chǎn)品進(jìn)行優(yōu)化,保持其生機(jī)與活力,以免在激烈的市場(chǎng)競(jìng)爭(zhēng)下,不能很好地滿足各相關(guān)方的利益,逐漸喪失其市場(chǎng)份額,最終導(dǎo)致這一項(xiàng)目的失敗。因此作者基于利益相關(guān)者視角,來(lái)研究旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的優(yōu)化,以求對(duì)我國(guó)旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的改進(jìn)和完善提供一定的幫助。 本研究采用文獻(xiàn)檢索、問(wèn)卷調(diào)查、深度訪談與案例比較等研究方法對(duì)我國(guó)旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的存在問(wèn)題進(jìn)行剖析,發(fā)現(xiàn)旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品存在保費(fèi)偏高、結(jié)案率不高、賠償標(biāo)準(zhǔn)不明確、履行承諾不嚴(yán)格、部分地區(qū)存在強(qiáng)制購(gòu)買現(xiàn)象等問(wèn)題;基于利益相關(guān)者理論,結(jié)合典型案例,分別從各利益相關(guān)者視角,提出了我國(guó)旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的優(yōu)化原則、優(yōu)化內(nèi)容及相關(guān)建議。 研究指出旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的優(yōu)化,要堅(jiān)持系統(tǒng)性原則、動(dòng)態(tài)性原則、市場(chǎng)化原則和法制化原則;旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的優(yōu)化要明確責(zé)任、細(xì)化保障范圍;要從行業(yè)特點(diǎn)出發(fā),設(shè)計(jì)靈活的費(fèi)率機(jī)制;要提高運(yùn)行機(jī)制效率、注重服務(wù)和考核;要實(shí)施快付機(jī)制,以提升形象和滿意度。此外,旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的優(yōu)化需要旅行社、保險(xiǎn)經(jīng)紀(jì)公司、共保體公司、調(diào)處中心、旅游主管部門等利益相關(guān)者共同努力來(lái)實(shí)現(xiàn)。 研究針對(duì)旅行社責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品保費(fèi)高、被強(qiáng)制投保等問(wèn)題,認(rèn)為待該統(tǒng)保示范產(chǎn)品運(yùn)行模式成熟后,應(yīng)對(duì)共保體公司和保險(xiǎn)經(jīng)紀(jì)公司逐步建立進(jìn)入和退出機(jī)制。希望通過(guò)推動(dòng)我國(guó)的旅游責(zé)任保險(xiǎn)統(tǒng)保示范產(chǎn)品的優(yōu)化與完善,,使產(chǎn)品在轉(zhuǎn)移旅行社責(zé)任風(fēng)險(xiǎn)、保障旅游者合法權(quán)益,實(shí)現(xiàn)旅游業(yè)又好又快發(fā)展,促進(jìn)政府部門職能轉(zhuǎn)變,維護(hù)社會(huì)穩(wěn)定等方面起到更有效的作用。
[Abstract]:The travel agency liability insurance model product is a travel agency liability insurance product led by the National Tourism Administration. It is specially designed for travel agencies. To a great extent, the introduction of this product solves the problems existing in the original travel agency liability insurance products. Therefore, it can be used as the representative of domestic travel agency liability insurance products. However, as a new product, the project has only run in the market for 3 years, and many problems have appeared in the actual operation. At present, it is urgent to optimize the demonstration product to keep its vigor and vitality so as not to satisfy the interests of all relevant parties and lose its market share gradually under the fierce market competition, and finally lead to the failure of this project. Therefore, based on the stakeholder perspective, the author studies the optimization of the model product of travel agency liability insurance, in order to provide some help to improve and perfect the demonstration product of travel agency liability insurance. In this study, we analyzed the existing problems of the model products of travel agency liability insurance by literature retrieval, questionnaire survey, in-depth interview and case comparison, and found that the insurance premium of travel agency liability insurance model product is on the high side. The case rate is not high, the standard of compensation is not clear, the implementation of commitments is not strict, there are some problems such as forced purchase in some areas; based on stakeholder theory, combined with typical cases, from the perspective of each stakeholder, This paper puts forward the optimization principle, optimization contents and relevant suggestions of the model product of travel agency liability insurance in China. The study points out that to optimize the model products of travel agency liability insurance, we should adhere to the systematic principle, the dynamic principle, the market-oriented principle and the legal principle, and the optimization of the model product of travel agency liability insurance should be clear about the responsibility and refine the scope of guarantee. It is necessary to design a flexible rate mechanism according to the characteristics of the industry, to improve the efficiency of the operation mechanism, to pay attention to service and assessment, and to implement the quick payment mechanism to enhance the image and satisfaction. In addition, the optimization of the model product of travel agency liability insurance needs the joint efforts of travel agency, insurance broker, co-insurance company, mediation center, tourism department and other stakeholders. In view of the problems of travel agency liability insurance, such as high premium and compulsory insurance, it is considered that when the operation mode of the model product is mature, the entry and exit mechanism should be established step by co-guarantee company and insurance broker company. It is hoped that by promoting the optimization and improvement of the demonstration products of tourism liability insurance in China, the products will transfer the risk of travel agency liability, protect the legitimate rights and interests of tourists, realize the sound and rapid development of tourism, and promote the transformation of the functions of government departments. Maintain social stability and other aspects play a more effective role.
