【摘要】:隨著我國改革開放程度進(jìn)一步加深,保險(xiǎn)業(yè)迅猛發(fā)展,分紅保險(xiǎn)產(chǎn)品作為一類新型保險(xiǎn)產(chǎn)品,以其特有的投資和保障功能贏得了廣大保險(xiǎn)消費(fèi)者的青睞,然而在分紅保險(xiǎn)繁榮發(fā)展的背后,銷售誤導(dǎo)問題也不同程度的存在和增加,這也是保險(xiǎn)監(jiān)管機(jī)構(gòu)規(guī)范整頓的重點(diǎn)和難點(diǎn)。這個(gè)問題如果不能及時(shí)有效的得到解決,不僅會(huì)削弱保險(xiǎn)業(yè)的社會(huì)地位和誠信度,也將嚴(yán)重的侵害被保險(xiǎn)人的合法權(quán)益,影響分紅保險(xiǎn)乃至整個(gè)保險(xiǎn)業(yè)的進(jìn)一步發(fā)展和其在社會(huì)中的形象,制約保險(xiǎn)經(jīng)濟(jì)的發(fā)展,同時(shí)長此下去勢(shì)必會(huì)影響我國社會(huì)主義市場(chǎng)經(jīng)濟(jì)發(fā)展和社會(huì)主義和諧社會(huì)的建設(shè)。而有效治理分紅保險(xiǎn)銷售誤導(dǎo)行為,一方面有利于保障投保人和被保險(xiǎn)人的利益,使投保人可以根據(jù)自身情況購買最適合自己的分紅理財(cái)產(chǎn)品,提高客戶對(duì)保險(xiǎn)公司的滿意程度和信任度,從而使其在保險(xiǎn)合同滿期時(shí)有及時(shí)續(xù)保的積極性和主動(dòng)性,,同時(shí)也可以使被保險(xiǎn)人享受投資和保障雙重保險(xiǎn),在獲得保險(xiǎn)保障的同時(shí)更好的滿足其自身的理財(cái)需求;另一方面有利于穩(wěn)定保險(xiǎn)公司的業(yè)務(wù),減少退保問題特別是集中退保、群體退保等問題的發(fā)生,實(shí)現(xiàn)分紅保險(xiǎn)的可持續(xù)發(fā)展。 本文共分為四章,第一章描述了國壽福祿雙喜兩全保險(xiǎn)(分紅型)的銷售誤導(dǎo)案例,該案例雖然只是眾多國壽福祿雙喜兩全保險(xiǎn)(分紅型)銷售誤導(dǎo)案例中的一個(gè)縮影,但極具代表性,同時(shí)也反映出目前保險(xiǎn)市場(chǎng)上分紅保險(xiǎn)的銷售誤導(dǎo)問題還比較嚴(yán)重。第二章對(duì)該案例進(jìn)行分析,主要分析了分紅保險(xiǎn)銷售誤導(dǎo)的表現(xiàn)形式、產(chǎn)生原因,第三章主要闡述分紅保險(xiǎn)銷售誤導(dǎo)帶來的不良影響及治理銷售誤導(dǎo)的困境,第四章針對(duì)分紅保險(xiǎn)銷售誤導(dǎo)產(chǎn)生的原因從保險(xiǎn)人、保險(xiǎn)監(jiān)管部門及相關(guān)法律法規(guī)和社會(huì)監(jiān)督方面提出了系統(tǒng)化治理措施。
[Abstract]:With the deepening of China's reform and opening up and the rapid development of the insurance industry, the bonus insurance products as a new type of insurance products have won the favor of the vast majority of the insurance consumers with their unique investment and security functions. However, behind the prosperity and development of the dividend insurance, the problem of sales misconduct also exists and increases in varying degrees. If the problem is not solved in time and effectively, the insurance regulatory agency will not only weaken the social status and integrity of the insurance industry, but also seriously infringe the legitimate rights and interests of the insured, and affect the further development of the dividend insurance and the whole insurance industry and its image in the society, and restrict the insurance. The development of the economy, at the same time, will certainly affect the development of the socialist market economy and the construction of a socialist harmonious society. The effective governance of the misleading behavior of the sale of red insurance is beneficial to the protection of the interests of the insured and the insured, so that the insured can buy the most suitable dividends for themselves according to their own circumstances. The product, improve the satisfaction degree and trust degree of the customer to the insurance company, so that it has the enthusiasm and initiative in timely renewal when the insurance contract is full, at the same time, it can also make the insured enjoy investment and guarantee double insurance, while obtaining insurance guarantee, it can better meet its own financial needs; on the other hand, it is beneficial to stability. Setting up the business of insurance companies, reducing the problem of surrender, especially centralized surrender, group surrender and other issues, and achieving the sustainable development of bonus insurance.
This article is divided into four chapters. The first chapter describes the case of misleading sales of the double happy double insurance (dividend type). This case is the epitome of the misleading case of a large number of national life Fu and Lu double happiness insurance (dividend type), but it is very representative and reflects the problem of misleading sales in the current insurance market. The second chapter is an analysis of the case, mainly analyzing the forms of the misleading sales of the dividend insurance and the causes. The third chapter mainly expounds the adverse effects caused by the misleading of the dividend insurance sales and the dilemma of managing the misleading sales. The fourth chapter is about the reasons for the misleading of the sale of the red insurance sales from the insurer and the insurance supervision department. The door and related laws and regulations and social supervision put forward systematic measures.
