我國(guó)機(jī)動(dòng)車交通事故責(zé)任強(qiáng)制保險(xiǎn)的問題解決方案

【摘要】:機(jī)動(dòng)車交通事故責(zé)任強(qiáng)制保險(xiǎn)作為我國(guó)首個(gè)由國(guó)家法律規(guī)定實(shí)行的強(qiáng)制保險(xiǎn)制度,,在我國(guó)的歷史只有短短6年多的時(shí)間。雖然該制度在快速處理道路交通事故、保障道路交通事故受害人權(quán)益、維護(hù)社會(huì)和諧穩(wěn)定等方面都發(fā)揮了十分積極的作用,但是也應(yīng)看到,其經(jīng)營(yíng)的過程中還存在著各種各樣的問題,嚴(yán)重影響著這項(xiàng)制度發(fā)揮其應(yīng)有的作用。本文結(jié)合我國(guó)經(jīng)營(yíng)交強(qiáng)險(xiǎn)業(yè)務(wù)經(jīng)營(yíng)情況的數(shù)據(jù),深入分析目前機(jī)動(dòng)車交通事故責(zé)任強(qiáng)制保險(xiǎn)制度實(shí)施情況,并針對(duì)實(shí)施過程存在的巨額虧損、費(fèi)用分?jǐn)偛煌该鳌⒔?jīng)營(yíng)模式弊端等問題,結(jié)合國(guó)外相關(guān)經(jīng)驗(yàn)和我國(guó)具體國(guó)情,提出了賦予保險(xiǎn)公司交強(qiáng)險(xiǎn)定價(jià)的權(quán)利、制定建立交強(qiáng)險(xiǎn)指導(dǎo)性費(fèi)率形成機(jī)制、完善道路交通事故社會(huì)救助基金、通過分派和補(bǔ)貼的方式處理高風(fēng)險(xiǎn)業(yè)務(wù)等解決方案,從而達(dá)到優(yōu)化交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式,促進(jìn)交強(qiáng)險(xiǎn)健康發(fā)展的目的。
[Abstract]:As the first compulsory insurance system in our country, the compulsory insurance of motor vehicle traffic accident liability is only in the history of more than 6 years. Although the system has played a very positive role in dealing with road traffic accidents quickly, protecting the rights and interests of victims of road traffic accidents, and maintaining social harmony and stability, it should also be noted. There are still various problems in the process of operation, which seriously affect the system to play its due role. Based on the data of traffic insurance operation in China, this paper deeply analyzes the implementation of the compulsory insurance system for motor vehicle traffic accident liability, and aims at the huge losses existing in the implementation process and the opaque allocation of expenses. Some problems, such as the malpractice of business model, combining with the relevant experience of foreign countries and the specific conditions of our country, are put forward to give insurance companies the right to price traffic insurance, to establish a mechanism for forming guiding rates of traffic insurance, and to perfect the social relief fund for road traffic accidents. In order to optimize the management mode of traffic strong insurance and promote the healthy development of strong traffic insurance, we can deal with the solutions of high-risk business by way of allocation and subsidy.
