【摘要】:我國(guó)保險(xiǎn)市場(chǎng)起步較晚,發(fā)展的水平較低,且保險(xiǎn)合同具有高度的專業(yè)性,消費(fèi)者的保險(xiǎn)知識(shí)普遍較低,保險(xiǎn)消費(fèi)者權(quán)益侵害事件時(shí)有發(fā)生,這已經(jīng)嚴(yán)重影響到保險(xiǎn)業(yè)的聲譽(yù)和生存,如何有效保護(hù)消費(fèi)者利益成了決定保險(xiǎn)業(yè)是否能繼續(xù)健康發(fā)展的關(guān)鍵因素。為了改變保險(xiǎn)消費(fèi)者處于弱勢(shì)地位的局面,很多國(guó)家的相關(guān)立法和監(jiān)管都順應(yīng)了保險(xiǎn)消費(fèi)者權(quán)益保護(hù)的國(guó)際趨勢(shì)。由于近幾年我國(guó)保險(xiǎn)投訴和保險(xiǎn)糾紛案件的頻頻上升,我國(guó)更需要全面建立保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)制。 本文在在借鑒國(guó)際國(guó)內(nèi)學(xué)者現(xiàn)有研究成果上,主要通過理論梳理、現(xiàn)狀研究、原因分析、國(guó)外經(jīng)驗(yàn)比較借鑒等方式,重點(diǎn)研究了我國(guó)保險(xiǎn)消費(fèi)者權(quán)益受損的主要形式及誘因,分析了我國(guó)保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)制存在的不足:在此基礎(chǔ)上,借鑒國(guó)外的經(jīng)驗(yàn),從法律監(jiān)管、內(nèi)部控制、糾紛處理三大維度提出了我國(guó)保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)制構(gòu)建的政策思路。全文共包括五大部分,各章主要研究?jī)?nèi)容及觀點(diǎn)簡(jiǎn)要概述如下: 第1章:導(dǎo)論。這部分在文獻(xiàn)的梳理基礎(chǔ)上,主要介紹了問題提出的背景、研究目的和意義,以及國(guó)內(nèi)外對(duì)相關(guān)問題的研究現(xiàn)狀。 第2章:介紹了我國(guó)保險(xiǎn)消費(fèi)者權(quán)益受損的主要形式及誘因分析。針對(duì)我國(guó)保險(xiǎn)市場(chǎng)中反映出來的較嚴(yán)重問題,分析了保險(xiǎn)消費(fèi)者權(quán)益受損的主要方面及其原因。研究認(rèn)為,保險(xiǎn)消費(fèi)者主要是在知情權(quán)、損害求償權(quán)、公平交易權(quán)三方面的權(quán)益受到損害,而其中最突出的表現(xiàn)是銷售誤導(dǎo)、理賠難、保險(xiǎn)費(fèi)率偏高等。文章還分別分析了產(chǎn)生這些權(quán)益受損問題的誘因,以期為下文對(duì)問題做進(jìn)一步的制度分析奠定基礎(chǔ)。 第3章:我國(guó)保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)制存在的不足。該章在概括分析我國(guó)政府監(jiān)管部門和保險(xiǎn)行業(yè)協(xié)會(huì)近年在保障消費(fèi)者權(quán)益方面所作探索和實(shí)踐基礎(chǔ)上,重點(diǎn)探討了我國(guó)保險(xiǎn)消費(fèi)者權(quán)益保護(hù)制度和機(jī)制存在的不足。研究認(rèn)為,當(dāng)前我國(guó)在保險(xiǎn)消費(fèi)者權(quán)益保護(hù)的法律法規(guī)建設(shè)、保險(xiǎn)監(jiān)管體系、保險(xiǎn)糾紛防范機(jī)制與糾紛解決機(jī)制等四方面存在嚴(yán)重的制度層面不足。 第4章:國(guó)外保險(xiǎn)消費(fèi)者權(quán)益保護(hù)的經(jīng)驗(yàn)研究。這章對(duì)美、英、日三大保險(xiǎn)業(yè)發(fā)達(dá)國(guó)家的對(duì)我國(guó)有啟發(fā)借鑒意義的保險(xiǎn)消費(fèi)者權(quán)益保護(hù)經(jīng)驗(yàn)進(jìn)行了分析。分析認(rèn)為,發(fā)達(dá)國(guó)家在構(gòu)建完善的保險(xiǎn)法律體系、設(shè)立專門的保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)構(gòu)、建立保險(xiǎn)消費(fèi)者投訴處理機(jī)制和強(qiáng)化保險(xiǎn)行業(yè)自律機(jī)制等方面為保險(xiǎn)消費(fèi)者織起了一層層安全保護(hù)網(wǎng)。 第5章:我國(guó)保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)制的對(duì)策建議。論文結(jié)合目前我國(guó)保險(xiǎn)市場(chǎng)的現(xiàn)狀,借鑒國(guó)外經(jīng)驗(yàn),較系統(tǒng)地提出了我國(guó)保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)制的構(gòu)建思路:首先要完善法律法規(guī)保護(hù)機(jī)制,建立起一個(gè)良好的保護(hù)環(huán)境;第二層次是保險(xiǎn)公司的信息披露與外部監(jiān)管相結(jié)合的監(jiān)督機(jī)制,在法律法規(guī)無法有效約束的情況下監(jiān)督機(jī)制要發(fā)揮作用;第三層次是保險(xiǎn)公司公司治理的改進(jìn),以形成法律與監(jiān)管之外的市場(chǎng)制衡力量;第四層次是著眼于保險(xiǎn)代理人的重要影響作用而設(shè)計(jì)的激勵(lì)約束機(jī)制;最后是在糾紛發(fā)生的情況下,消費(fèi)者自身可以選擇的多元化糾紛解決機(jī)制。當(dāng)然以上五個(gè)層面的機(jī)制并不是相互獨(dú)立、各自運(yùn)轉(zhuǎn)的,它們需要相互協(xié)調(diào)合作才能發(fā)揮出保護(hù)保險(xiǎn)消費(fèi)者權(quán)益的最大合力。 文章的主要特色和創(chuàng)新之處在于:第一,本文以時(shí)下保險(xiǎn)界最熱點(diǎn)的話題車險(xiǎn)理賠難、壽險(xiǎn)銷售誤導(dǎo)為背景,圍繞保險(xiǎn)消費(fèi)者權(quán)益保護(hù)這一主題,對(duì)保險(xiǎn)消費(fèi)者權(quán)益受損形式與誘因、我國(guó)保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)制存在的不足等進(jìn)行了較深入分析。結(jié)合國(guó)內(nèi)相關(guān)部門所作的保護(hù)實(shí)踐和國(guó)際經(jīng)驗(yàn),從五個(gè)層面提出了我國(guó)保險(xiǎn)消費(fèi)者權(quán)益保護(hù)機(jī)制的構(gòu)建思路,形成了比較完整的保險(xiǎn)消費(fèi)者權(quán)益保護(hù)框架,這構(gòu)成了本文最大的創(chuàng)新之處;第二,根據(jù)我國(guó)保險(xiǎn)市場(chǎng)的實(shí)際情況,論文創(chuàng)新性地提出了讓保險(xiǎn)消費(fèi)者參與保險(xiǎn)公司治理,為保險(xiǎn)消費(fèi)者權(quán)益保護(hù)的后續(xù)研究開辟了一個(gè)新的方向。文章還存在許多不足之處,對(duì)問題的剖析不盡深入,自身的觀點(diǎn)也存在片面性,特別是對(duì)于最后政策建議部分中保險(xiǎn)公司內(nèi)部治理改善缺乏具體的操作方法,同時(shí),其可操作性也有待進(jìn)一步論證,糾紛解決機(jī)制的設(shè)計(jì)缺乏具體措施。
[Abstract]:The insurance market in China is late, the level of development is low, and the insurance contract has a high degree of professionalism, the insurance knowledge of the consumer is generally low, the insurance consumer's rights and interests are infringed on. This has seriously affected the reputation and survival of the insurance industry. How to effectively protect the interests of the consumer has become a decision whether the insurance industry can continue. In order to change the situation of healthy development, in order to change the situation that the insurance consumers are in a disadvantaged position, the relevant legislation and supervision of many countries have conformed to the international trend of the protection of the rights and interests of the insurance consumers. Because of the frequent rise of the cases of insurance complaints and insurance disputes in China in recent years, our country needs to establish the protection of the protection of the rights and interests of the insurance consumers in an all-round way. Mechanism.
On the basis of the existing research achievements of international and domestic scholars, the main forms and causes of the damage of the rights and interests of the insurance consumers in China are mainly studied through the theoretical carding, the current situation research, the reason analysis and the foreign experience, and the deficiency of the protection mechanism of the insurance consumer in China is analyzed. On this basis, From the experience of foreign countries, from the three dimensions of legal supervision, internal control and dispute handling, we put forward the policy ideas for the construction of the protection mechanism of China's insurance consumers' rights and interests. The full text includes five parts, and the main contents and views of each chapter are briefly summarized as follows:
The first chapter: introduction. On the basis of combing the literature, this part mainly introduces the background of the question, the purpose and significance of the research, and the research status of the related issues at home and abroad.
The second chapter introduces the main forms and causes of the damage to the rights and interests of the insurance consumers in our country. In view of the serious problems reflected in the insurance market in China, the main aspects and reasons for the damage of the rights and interests of the insurance consumers are analyzed. The research holds that the insurance consumers are mainly in the right to know, the right to claim damages, and the three aspects of the fair trade right. The most prominent manifestation of the rights and interests is the misleading of sales, the difficult claim and the high premium rate. The article also analyzes the reasons for the damage of these rights and interests, in order to lay the foundation for the further institutional analysis of the following problems.
The third chapter: the deficiency of the protection mechanism of China's insurance consumer rights and interests. On the basis of summarizing and analyzing the exploration and practice of our government supervision department and the insurance industry association in the protection of the rights and interests of consumers in recent years, this chapter focuses on the shortcomings of the system and mechanism of the protection of the rights and interests of the insurance consumers in our country. There are four serious deficiencies in the system level in the construction of the laws and regulations of the protection of the rights and interests of the insurance consumers, the insurance supervision system, the prevention mechanism of the insurance dispute and the dispute settlement mechanism.
The fourth chapter: An Empirical Study on the protection of the rights and interests of foreign insurance consumers. This chapter analyses the experience of protecting the protection of the rights and interests of the insurance consumers in the three major developed countries of the United States, Britain and Japan. The analysis holds that the developed countries are building a perfect insurance legal system and setting up a special protection machine for the insurance consumer. The establishment of an insurance consumer complaint handling mechanism and strengthening of the insurance industry self-regulation mechanism has created a layer of safety protection network for insurance consumers.
The fifth chapter: the countermeasures and suggestions for the protection mechanism of the insurance consumers' rights and interests of our country. Combining with the present situation of the insurance market in China and drawing on the experience of foreign countries, the paper systematically puts forward the idea of establishing the protection mechanism of the rights and interests of the insurance consumers in our country. First, we should perfect the protection mechanism of laws and regulations, establish a good protection environment; the second level. It is the supervision mechanism that the insurance company combines information disclosure and external supervision. The supervision mechanism should play a role in the situation that the laws and regulations can not be effectively restrained; the third level is the improvement of the corporate governance of the insurance company to form the market balance outside the law and supervision, and the fourth level is an important shadow of the insurance agent. The incentive and constraint mechanism designed by the sound effect is the end of the diversified dispute resolution mechanism that consumers can choose under the circumstances of the dispute. Of course, the above five levels of the mechanism are not independent and operate each other. They need to coordinate and cooperate with each other in order to produce the greatest resultant force to protect the rights and interests of the insurance consumers.
The main features and innovations of this article are as follows: first, this paper, with the most hot topics in the insurance industry, is difficult to compensate for vehicle insurance, mislead the life insurance sales as the background, and focus on the protection of the rights and interests of the insurance consumers, and makes a comparison of the forms and causes of the damage to the rights and interests of the insurance consumers, and the deficiency of the protection mechanism of the insurance consumers in China. In depth analysis, combined with the protection practice and international experience made by the relevant domestic departments, the construction ideas of the protection mechanism for the rights and interests of the insurance consumers in China are put forward from five levels, and a more complete protection framework for the rights and interests of the insurance consumers has been formed, which constitutes the biggest innovation in this article; second, according to the actual situation of the insurance market in China. This paper innovatively proposes that the insurance consumers participate in the management of insurance companies, which has opened up a new direction for the follow-up study of the protection of the rights and interests of the insurance consumers. There are many shortcomings in this article, and the analysis of the problems is not thorough and its own views are one-sided, especially for the insurance companies in the final policy recommendations. The internal governance improvement lacks specific operation methods, and its operability needs further demonstration. The design of dispute settlement mechanism lacks specific measures.
