保定市建筑業(yè)農(nóng)民工工傷勞動糾紛問題研究

【摘要】:隨著我國經(jīng)濟的迅速發(fā)展和城市化進程的加快,農(nóng)民工流動也逐步加快,引發(fā)了全國范圍的民工潮。但作為弱勢群體,農(nóng)民工在實際的建筑項目勞動過程中常常因為工傷傷害、社會保障等一系列問題產(chǎn)生矛盾。在處理矛盾糾紛的過程中,農(nóng)民工還經(jīng)常會遇到種種困難,影響到他們維護自身的合法權(quán)益;谝陨咸攸c,迫切需要提出一套能夠適應當前農(nóng)民工爭議特點的,切實可行,資方和政府以及社會團體相互配合的預防與解決方案。 本文從爭議預防、糾紛調(diào)解的角度,在對大量保定市建筑項目農(nóng)民工勞動爭議案件實例進行實證研究的基礎(chǔ)上,分析得出建筑行業(yè)農(nóng)民工勞動爭議的主要類型主要有工傷認定、等級鑒定和工傷待遇三個方面。在保定建筑業(yè)處理工傷糾紛主要仍然以用人單位與個人的協(xié)商解決為主,其次是通過勞動仲裁來解決,這也是處理糾紛的一個主要解決方式。通過問卷調(diào)查、現(xiàn)場采訪、電話訪問等形式總結(jié)出影響農(nóng)民工工傷糾紛的主要問題。用人單位與農(nóng)民工大多不簽訂勞動合同,導致勞資雙方的勞動關(guān)系難以確定。農(nóng)民工所從事的工種一般都是高危性質(zhì)的,所以用人單位的規(guī)章制度不完善的話,可能會給工傷事故帶來隱患,那么勞動者發(fā)生的事故是否屬于工傷事故的認定就會比較麻煩。雖然表面上看用人單位參加工傷保險會有損企業(yè)的利益,但是本文通過案例說明了工傷保險參加對企業(yè)的必要性,這不僅是社會責任的體現(xiàn),而且在一定程度上還會減輕用人單位的負擔,給予用人單位和農(nóng)民工雙重的保障。最后本文通過借鑒國內(nèi)外勞動爭議處理機制的經(jīng)驗結(jié)合我國的勞動爭議和法律救濟的現(xiàn)狀,以及目前建筑業(yè)工傷糾紛存在的問題與不足,提出合理有效解決建筑項目農(nóng)民工勞動爭議的基本理念和有效途徑。即通過政府、用人單位以及農(nóng)民工群體三方面的配合本身來降低農(nóng)民工工傷風險的概率,,促進全國農(nóng)民工工傷保險制度的統(tǒng)一。
[Abstract]:With the rapid development of China's economy and the accelerated process of urbanization, the flow of migrant workers has gradually accelerated, causing a nationwide tide of migrant workers. However, as a vulnerable group, migrant workers often have contradictions in a series of problems such as injury and social security in the process of actual construction projects. In the process of dealing with contradictions and disputes, Migrant workers often meet various difficulties and affect their legitimate rights and interests. Based on the above characteristics, it is urgent to put forward a set of prevention and solutions which can adapt to the characteristics of the current disputes of migrant workers, practical and feasible, and cooperate with the government and social groups.
From the angle of dispute prevention and dispute mediation, on the basis of an empirical study of a large number of cases of migrant workers' labor disputes in Baoding construction projects, the main types of labor disputes in the construction industry are mainly industrial injury identification, grade identification and industrial injury in three aspects. In Baoding construction industry to deal with industrial injury disputes. It is mainly solved by the consultation and settlement of the employing unit and individual, followed by labor arbitration, which is also a major solution to the dispute. Through questionnaire survey, field interview, telephone interview and other forms, the main problems that affect migrant workers' industrial injury disputes are summarized. Most of the employers and migrant workers do not sign the labor union. In the same way, labor relations between labor and capital are difficult to determine. The work of migrant workers is generally at high risk. So, if the rules and regulations of the employer are not perfect, it may bring about a hidden danger to the accident. Then, if the worker's accident belongs to the industrial accident, it will be more troublesome. Unit participation in industrial injury insurance will damage the interests of the enterprise, but this article illustrates the necessity of the participation of industrial injury insurance to the enterprise through cases, which is not only the embodiment of social responsibility, but also to a certain extent, it will reduce the burden of the employer and give the employer and the migrant workers a double guarantee. Finally, this article can learn from the labor at home and abroad. The experience of the dispute handling mechanism combined with the status of labor disputes and legal relief in China, and the problems and shortcomings in the current construction industrial injury disputes, and puts forward the basic ideas and effective ways to solve the labor disputes in the construction project reasonably and effectively. That is, the cooperation itself through three aspects of the government, the employers and the migrant workers group. To reduce the probability of industrial injury risk of migrant workers, and promote the unification of industrial injury insurance system for rural migrant workers.
