論我國(guó)強(qiáng)制巨災(zāi)保險(xiǎn)法律制度的構(gòu)建

【摘要】:我國(guó)保險(xiǎn)監(jiān)督管理委員會(huì)曾經(jīng)于06年時(shí)開(kāi)始《關(guān)于建立和完善巨災(zāi)保險(xiǎn)制度的工作方案》的起草工作,旨在提出建立巨災(zāi)保險(xiǎn)制度的計(jì)劃方案,但是該方案的實(shí)施卻一直被擱淺。直到2008年,當(dāng)我國(guó)發(fā)生汶川地震和南方重大雨雪災(zāi)害之后,我國(guó)關(guān)于加快巨災(zāi)保險(xiǎn)法律制度的呼聲才日漸增高。而后,保監(jiān)會(huì)主席項(xiàng)俊波于2012年冬公開(kāi)表示,我國(guó)巨災(zāi)保險(xiǎn)體系要加快進(jìn)程,且要建立適合我國(guó)的體系。巨災(zāi)保險(xiǎn)制度,在許多國(guó)家不僅理論而且實(shí)踐上都已經(jīng)很成熟,我國(guó)的理論研究也有了一些成果。本文以此為背景,整理總結(jié)自己對(duì)我國(guó)建立強(qiáng)制巨災(zāi)保險(xiǎn)法律制度的構(gòu)建設(shè)想,希望能夠?qū)窈笤撝贫鹊慕⑵鸬揭欢ㄗ饔。全文分三部分進(jìn)行論證,切入點(diǎn)為制度模式之選擇。本文第一部分主要是寫我國(guó)應(yīng)當(dāng)選擇何種巨災(zāi)保險(xiǎn)之模式。通過(guò)對(duì)國(guó)際上現(xiàn)存的三種模式進(jìn)行比較,得出強(qiáng)制巨災(zāi)保險(xiǎn)的優(yōu)勢(shì)所在,并對(duì)我國(guó)采取強(qiáng)制巨災(zāi)保險(xiǎn)模式的現(xiàn)實(shí)需要和現(xiàn)實(shí)基礎(chǔ)進(jìn)行論證。本文第二部分主要是寫我國(guó)應(yīng)當(dāng)遵循哪些強(qiáng)制指導(dǎo)原則來(lái)建立強(qiáng)制符合我國(guó)國(guó)情的巨災(zāi)保險(xiǎn)制度。我國(guó)已經(jīng)建立了幾類強(qiáng)制保險(xiǎn),通過(guò)對(duì)其總結(jié)及對(duì)保險(xiǎn)原則的結(jié)合,詳細(xì)論述適合我國(guó)強(qiáng)制巨災(zāi)保險(xiǎn)之指導(dǎo)原則。本文的第三部分主要是寫我國(guó)強(qiáng)制巨災(zāi)保險(xiǎn)法律關(guān)系之構(gòu)成要素。該部分從我國(guó)強(qiáng)制巨災(zāi)保險(xiǎn)法律關(guān)系的主體、客體和內(nèi)容上對(duì)我國(guó)巨災(zāi)保險(xiǎn)的承保、投保和權(quán)利義務(wù)分配等問(wèn)題進(jìn)行構(gòu)建,從而明晰我國(guó)應(yīng)當(dāng)如何展開(kāi)巨災(zāi)保險(xiǎn)制度的構(gòu)建工作。本文的切入點(diǎn)為強(qiáng)制模式,通過(guò)論證我國(guó)適合建立強(qiáng)制型巨災(zāi)保險(xiǎn)法律制度開(kāi)始說(shuō)明,并更為詳細(xì)的論述我國(guó)強(qiáng)制巨災(zāi)保險(xiǎn)法律制度的法律關(guān)系應(yīng)當(dāng)作何構(gòu)建?紤]到我國(guó)的國(guó)情,反觀我國(guó)在過(guò)去對(duì)于巨災(zāi)的救助實(shí)踐,未來(lái)對(duì)該法律制度的建立必然存在很大困難。但是,筆者相信我國(guó)既然已經(jīng)在建立多種強(qiáng)制保險(xiǎn)和社會(huì)保險(xiǎn)領(lǐng)域作出了可喜成果,在強(qiáng)制巨災(zāi)保險(xiǎn)這一法律制度的構(gòu)建上必然能夠起到借鑒作用,該制度的建立必然是大勢(shì)所趨。
[Abstract]:In 2006, China's Insurance Supervision and Administration Commission began the drafting of the "work Plan on establishing and perfecting the catastrophe Insurance system" in order to put forward a plan for the establishment of a catastrophe insurance system. But the implementation of the program has been stranded. Until 2008, after the Wenchuan earthquake and the heavy rain and snow disaster in southern China, the voice of speeding up the legal system of catastrophe insurance in our country increased day by day. Then Xiang Junbo, chairman of the CIRC, said publicly in the winter of 2012 that China's catastrophe insurance system should speed up the process and establish a system suitable for our country. Catastrophe insurance system in many countries not only in theory but also in practice has been very mature, our theoretical research has also made some achievements. Based on this background, this paper summarizes my assumption of establishing a legal system of compulsory catastrophe insurance in China, hoping to play a certain role in the establishment of this system in the future. The thesis is divided into three parts, and the starting point is the choice of system mode. The first part of this paper is mainly about which catastrophe insurance mode China should choose. Through the comparison of the three existing models in the world, the advantages of compulsory catastrophe insurance are obtained, and the practical needs and practical basis of adopting the compulsory catastrophe insurance mode in China are demonstrated. The second part of this paper is mainly about which compulsory guiding principles should be followed to establish the compulsory catastrophe insurance system in accordance with the situation of our country. Several kinds of compulsory insurance have been established in our country. Through summing up them and combining the insurance principles, the guiding principles suitable for China's compulsory catastrophe insurance are discussed in detail. The third part of this paper is mainly about the elements of the legal relationship of compulsory catastrophe insurance in China. This part constructs the subject, object and content of the legal relationship of compulsory catastrophe insurance in China. In order to clarify how our country should carry out the construction of catastrophe insurance system. The starting point of this paper is the compulsory mode, through the demonstration that our country is suitable to establish the compulsory catastrophe insurance legal system, and discusses in more detail how the legal relationship of our country compulsory catastrophe insurance legal system should be constructed. Considering the situation of our country, it is inevitable that the establishment of this legal system will be very difficult in the future. However, the author believes that since China has already made gratifying achievements in the field of establishing a variety of compulsory insurance and social insurance, it will certainly be able to play a reference role in the construction of the legal system of compulsory catastrophe insurance. The establishment of the system is bound to be the trend of the times.
