【摘要】：改革開放以來,社會經(jīng)濟(jì)快速發(fā)展,企業(yè)數(shù)量迅速增長,生產(chǎn)經(jīng)營活動快速膨脹,安全生產(chǎn)工作壓力越來越大,安全生產(chǎn)事故也層出不窮,給國家和人民帶來了重大損失。國家高度重視安全生產(chǎn)工作,不斷出臺新政策,新措施來推動安全生產(chǎn)工作,使得全國安全生產(chǎn)形式逐年好轉(zhuǎn),取得了顯著的成績。安全生產(chǎn)責(zé)任保險(xiǎn)就是其中一項(xiàng)能夠?yàn)槠髽I(yè)和員工提供保障的政策,但是目前安全生產(chǎn)責(zé)任保險(xiǎn)政策還處于試點(diǎn)階段,在國內(nèi)也是剛剛起步,所以在社會上的認(rèn)知度并不高。本文通過對鹽城市2011-2013年安全生產(chǎn)責(zé)任保險(xiǎn)執(zhí)行情況進(jìn)行總結(jié),從全市11個(gè)縣(市、區(qū))抽取96家中小高危企業(yè)進(jìn)行調(diào)查研究,深入分析安全生產(chǎn)責(zé)任保險(xiǎn)開展的成效以及存在的問題,從制度建設(shè)、政府工作、保險(xiǎn)經(jīng)紀(jì)公司功能、保險(xiǎn)公司實(shí)際操作和企業(yè)自身建設(shè)等方面提出政策建議。研究發(fā)現(xiàn),在政府、保險(xiǎn)經(jīng)紀(jì)公司和保險(xiǎn)公司這三個(gè)利益相關(guān)者的協(xié)作推動下,鹽城市安全生產(chǎn)責(zé)任保險(xiǎn)工作的運(yùn)行機(jī)制已初步建立；安全生產(chǎn)責(zé)任保險(xiǎn)不僅豐富了鹽城市安全生產(chǎn)的監(jiān)管手段,確實(shí)提高了企業(yè)和職工的保障度,也使得部分企業(yè)感受到了安全生產(chǎn)責(zé)任保險(xiǎn)的甜頭；然而安全生產(chǎn)責(zé)任保險(xiǎn)還存在(1)在制度建設(shè)上面缺少法律支撐,沒有強(qiáng)制力,(2)政府、保險(xiǎn)經(jīng)紀(jì)公司和保險(xiǎn)公司的宣傳推廣力度仍然不夠,(3)保險(xiǎn)經(jīng)紀(jì)公司和保險(xiǎn)公司提供的服務(wù)與之前承若仍有差距,(4)部分企業(yè)對安全生產(chǎn)責(zé)任保險(xiǎn)的認(rèn)識不足,感受不到安全生產(chǎn)責(zé)任保險(xiǎn)的好處等問題。最后,本文提出了要從法律層面來完善制度建設(shè),讓安全生產(chǎn)責(zé)任保險(xiǎn)政策有法可依,加強(qiáng)政府的組織領(lǐng)導(dǎo)和監(jiān)督管理,保險(xiǎn)經(jīng)紀(jì)公司和保險(xiǎn)公司要發(fā)揮自身專業(yè)特長,強(qiáng)化對企業(yè)的服務(wù)能力,同時(shí)企業(yè)也不能等、不能靠,要強(qiáng)化和提升自身的安全生產(chǎn)和保障能力的建設(shè)。
[Abstract]:Since the reform and opening up, the rapid development of social economy, the rapid growth of the number of enterprises, the rapid expansion of production and management activities, the pressure of work safety is increasing, and accidents of production safety have emerged in endlessly, which has brought great losses to the country and the people. The state attaches great importance to the work of safety in production and has continuously issued new policies and measures to promote the work of safety in production, which makes the form of production safety in the country improve year by year and has made remarkable achievements. Production safety liability insurance is one of the policies that can provide protection for enterprises and employees, but at present, the production safety liability insurance policy is still in the pilot stage, and it is just beginning in China, so the recognition in the society is not high. Based on the summary of the implementation of liability insurance for production safety in Yancheng City from 2011 to 2013, 96 small high risk enterprises were selected from 11 counties (cities and districts) in the city for investigation and research. This paper analyzes deeply the effect and existing problems of liability insurance in production safety, and puts forward some policy suggestions from the aspects of system construction, government work, the function of insurance broker company, the actual operation of insurance company and the construction of enterprise itself. It is found that under the cooperation of the government, insurance brokerage company and insurance company, the operational mechanism of Yancheng City's work of safe production liability insurance has been preliminarily established. Production safety liability insurance not only enriches the supervision means of production safety in Yancheng city, but also improves the security degree of enterprises and workers, and makes some enterprises feel the sweetness of production safety liability insurance. However, liability insurance for production safety still exists) there is a lack of legal support in the construction of the system, and there is no enforcement power. The publicity and promotion efforts of insurance brokerage companies and insurance companies are still not enough. 3) the services provided by insurance brokers and insurance companies are still far from those previously accepted. 4) some enterprises do not have enough understanding of liability insurance for production safety. Can not feel the benefits of production safety liability insurance and other issues. Finally, this article proposes to perfect the system construction from the legal level, let the production safety liability insurance policy have the legal basis, strengthen the government's organization leadership and supervision and management, the insurance broker company and the insurance company should give play to their own specialty. At the same time, enterprises can not wait for, can not rely on, to strengthen and enhance their own safety production and security capacity construction.
