以政策更新破解城市更新中的難題——由香港土地“強(qiáng)制售賣”制度引發(fā)的思考

【摘要】:正土地"強(qiáng)制售賣"是與政府不動產(chǎn)征收并列的概念。不動產(chǎn)征收主要是政府根據(jù)《土地管理法》和《國有土地上房屋征收條例》等法律的規(guī)定,將土地使用權(quán)和建筑物本體所有權(quán)收為國有、并支付相應(yīng)對價的行政行為。而"強(qiáng)制售賣"是一種平等主體之間的交易行為,但與建立在自愿基礎(chǔ)上的一般交易行為不同,它是通過第三方介入,強(qiáng)制不動產(chǎn)權(quán)益主體將該不動產(chǎn)權(quán)益出售給
[Abstract]:The "compulsory sale" of real land is a concept juxtaposed with the expropriation of government real estate. The expropriation of immovable property mainly refers to the administrative act of the government according to the provisions of the Land Management Law and the regulations on the expropriation of Houses on the State-owned Land, which collects the land use right and the proprietorship of the building into the state, and pays the corresponding consideration. "compulsory sale" is a kind of transaction between equal subjects, but different from the general transaction on a voluntary basis, it forces the subject of real estate equity to sell the real estate interest through the intervention of a third party.
