日本勞動(dòng)者的長(zhǎng)時(shí)間勞動(dòng)現(xiàn)狀及特征

【摘要】:本文在以日本勞動(dòng)者長(zhǎng)時(shí)間勞動(dòng)引發(fā)"過(guò)勞死"事件的基礎(chǔ)上,梳理了政府的相關(guān)法律措施。通過(guò)對(duì)不同勞動(dòng)時(shí)間的勞動(dòng)者比率進(jìn)行國(guó)際比較,發(fā)現(xiàn)日本普遍存在以男性長(zhǎng)時(shí)間勞動(dòng),而女性兼職工作為主的二元化現(xiàn)象。通過(guò)政府部門的多項(xiàng)數(shù)據(jù)顯現(xiàn)了日本長(zhǎng)時(shí)間勞動(dòng)及其結(jié)構(gòu)特征的真相。并對(duì)無(wú)償加班,無(wú)薪年假的原因進(jìn)行了闡釋。從勞動(dòng)時(shí)間的角度揭示了日本勞動(dòng)者"過(guò)勞"產(chǎn)生的緣由。并對(duì)相關(guān)的法律規(guī)制問題進(jìn)行了討論分析。
[Abstract]:On the basis of overwork death caused by long time labor of Japanese workers, this paper combs the relevant legal measures of the government. Through the international comparison of the labor ratio of different working hours, it is found that there is a dualistic phenomenon in Japan in which men work for a long time and women work part-time. Data from government departments show the truth about Japan's long-term labor and its structural characteristics. The reasons of unpaid overtime and unpaid annual leave are explained. From the angle of working hours, this paper reveals the reason why Japanese labors "overwork". And related legal regulations are discussed and analyzed.
