【摘要】:以第三方平臺為核心的電子商務(wù)交易模式的產(chǎn)生與發(fā)展改變了消費者選購產(chǎn)品與服務(wù)的方式。這種交易模式集成交易信息,提供配套服務(wù),提高了社會經(jīng)濟活動的效率,促進了我國經(jīng)濟的繁榮發(fā)展。但與此同時,網(wǎng)絡(luò)交易中知識產(chǎn)權(quán)侵權(quán)的屢禁不止讓平臺內(nèi)交易主體處于不健康的競爭環(huán)境中,制約了平臺的發(fā)展,影響平臺內(nèi)交易活動的正常進行。目前,我國第三方電子商務(wù)平臺已形成各自知識產(chǎn)權(quán)管理體制,但缺乏產(chǎn)業(yè)戰(zhàn)略管理意識,不同利益相關(guān)者在知識產(chǎn)權(quán)管理中的定位不明晰,同時存在知識產(chǎn)權(quán)侵權(quán)行為隱蔽且復(fù)雜等現(xiàn)實問題。在此背景下,商業(yè)生態(tài)系統(tǒng)理論可以有效幫助知識產(chǎn)權(quán)管理者厘清平臺型電子商務(wù)活動中各主體的作用和地位、責(zé)任與義務(wù),分析不同主體在知識產(chǎn)權(quán)管理過程中的不同行為對系統(tǒng)演化路徑的影響,為解決第三方電子商務(wù)平臺知識產(chǎn)權(quán)管理的理論問題與現(xiàn)實困境提供了思路。本文以第三方電子商務(wù)平臺知識產(chǎn)權(quán)管理生態(tài)系統(tǒng)為研究對象,分析其構(gòu)成要素、運行機制,并使用演化博弈模型分析生態(tài)系統(tǒng)中主要種群行為選擇,對系統(tǒng)演化趨勢進行了動態(tài)分析,結(jié)合阿里巴巴集團知識產(chǎn)權(quán)管理生態(tài)系統(tǒng)實例,提出針對平臺知識產(chǎn)權(quán)管理生態(tài)系統(tǒng)優(yōu)化的具體建議。第三方電子商務(wù)平臺知識產(chǎn)權(quán)管理生態(tài)系統(tǒng)中,平臺商作為主導(dǎo)種群起協(xié)同監(jiān)管作用,關(guān)鍵種群(站內(nèi)經(jīng)營者與消費者)與支撐種群(政府機構(gòu)、行業(yè)協(xié)會等)起協(xié)同作用。通過演化博弈模型的分析可知,為引導(dǎo)經(jīng)營者減少知識產(chǎn)權(quán)侵權(quán)行為進行適度競爭,促成該系統(tǒng)向穩(wěn)定路徑演化,應(yīng)通過流程化的知識產(chǎn)權(quán)管理降低監(jiān)管成本,增加侵權(quán)成本、減少消費者投訴成本。阿里巴巴集團在知識產(chǎn)權(quán)管理實踐中注重了自身管理體系建設(shè)以及與其余種群的協(xié)同管理,但仍存在與支撐種群合作不暢、關(guān)鍵種群侵權(quán)方式多樣使監(jiān)管成本較高等現(xiàn)實問題。在商業(yè)生態(tài)系統(tǒng)理論指導(dǎo)下,第三方電子商務(wù)平臺應(yīng)堅持種群協(xié)同管理的基本原則,適應(yīng)平臺不同發(fā)展階段,規(guī)劃知識產(chǎn)權(quán)管理策略,建立多層次知識產(chǎn)權(quán)管理合作模式,構(gòu)建行業(yè)協(xié)會知識產(chǎn)權(quán)管理體系,推動第三方電子商務(wù)平臺知識產(chǎn)權(quán)管理生態(tài)系統(tǒng)的良性發(fā)展。
[Abstract]:The emergence and development of e-commerce transaction model with third-party platform as the core has changed the way that consumers choose and purchase products and services. This transaction model integrates transaction information and provides supporting services. It improves the efficiency of social and economic activities and promotes the economic prosperity of our country. But at the same time, the repeated prohibition of intellectual property rights infringement in network transactions not only makes the trading subjects in the platform in an unhealthy competitive environment. Restricted the development of the platform, affecting the normal conduct of the platform transactions. At present, the third-party e-commerce platforms in China have formed their respective intellectual property management system, but the lack of industrial strategic management awareness. The location of different stakeholders in intellectual property management is not clear, while there are hidden and complex intellectual property rights violations and other practical problems. In this context. Business ecosystem theory can effectively help intellectual property managers to clarify the role and status, responsibilities and obligations of various subjects in platform e-commerce activities. This paper analyzes the influence of different behaviors of different agents in the process of intellectual property management on the evolution path of the system. In order to solve the theoretical problems and practical difficulties of intellectual property management of third-party e-commerce platform, this paper takes the intellectual property management ecosystem of third-party e-commerce platform as the research object, and analyzes its constituent elements. Operating mechanism, and using evolutionary game model to analyze the main population behavior in the ecosystem, dynamic analysis of the system evolution trend, combined with the Alibaba Group intellectual property management ecosystem example. In the third party e-commerce platform intellectual property management ecosystem, platform vendors as the dominant species play a role in collaborative supervision. Key populations (operators and consumers in stations) and supporting populations (government agencies, industry associations, etc.) play a synergistic role. In order to guide the operators to reduce the intellectual property infringement for moderate competition and promote the evolution of the system to a stable path, we should reduce the supervision cost and increase the tort cost through the process of intellectual property management. To reduce the cost of consumer complaints. Alibaba Group pays attention to the construction of its own management system and cooperative management with the other stocks in the practice of intellectual property management, but there is still a lack of cooperation with the supporting stocks. Under the guidance of the commercial ecosystem theory, the third-party e-commerce platform should adhere to the basic principle of cooperative management of stocks. Adapt to the different stages of development of the platform, plan the intellectual property management strategy, establish multi-level cooperation model of intellectual property management, and construct the intellectual property management system of industry association. Promote the healthy development of intellectual property management ecosystem of third-party e-commerce platform.
