【摘要】：本文根據(jù)中國(guó)籃協(xié)發(fā)展實(shí)際情況,運(yùn)用文獻(xiàn)資料法、邏輯分析法等研究方法,對(duì)中國(guó)籃球協(xié)會(huì)紀(jì)律處罰制度進(jìn)行研究。旨在分析出當(dāng)前中國(guó)籃協(xié)紀(jì)律處罰制度存在的問(wèn)題,從而針對(duì)性提出相關(guān)建議。中國(guó)籃協(xié)紀(jì)律處罰制度,主要散落在《中國(guó)籃協(xié)章程》等相關(guān)規(guī)范性文件中,文件對(duì)籃協(xié)內(nèi)部有處罰權(quán)的機(jī)構(gòu)、救濟(jì)機(jī)構(gòu)做出規(guī)定。筆者經(jīng)過(guò)調(diào)查,總結(jié)歸納出籃協(xié)紀(jì)律處罰程序。中國(guó)籃協(xié)紀(jì)律處罰制度主要存在三個(gè)問(wèn)題:處罰制度內(nèi)容缺失;處罰程序需要加入聽證制度;處罰執(zhí)行時(shí)尺度不一。存在這些問(wèn)題的原因在于:籃協(xié)相對(duì)人權(quán)利義務(wù)不對(duì)等;籃球領(lǐng)域內(nèi)良好的自治模式不成熟;缺乏依法治體環(huán)境。參考國(guó)內(nèi)外體育組織管理經(jīng)驗(yàn),籃協(xié)需要借鑒之處在于:美職籃的管理經(jīng)驗(yàn)和仲裁經(jīng)驗(yàn);英足總聽證制度設(shè)置實(shí)施經(jīng)驗(yàn)和處罰程序;中國(guó)足協(xié)專項(xiàng)委員會(huì)建設(shè)經(jīng)驗(yàn)和聽證制度實(shí)施。筆者建議:為完善中國(guó)籃協(xié)紀(jì)律處罰制度,籃協(xié)各方利益代表應(yīng)參與處罰制度制定;處罰程序做出完善;處罰機(jī)制做出統(tǒng)一;提供司法救濟(jì)途徑;建設(shè)我國(guó)的體育仲裁機(jī)構(gòu)。
[Abstract]:According to the actual situation of the development of China Basketball Association, this paper studies the disciplinary punishment system of the Chinese Basketball Association by using the methods of literature, logic analysis and other research methods. The purpose of this paper is to analyze the problems existing in the disciplinary system of China Basketball Association and put forward relevant suggestions. The discipline and punishment system of China Basketball Association is mainly scattered in the relevant normative documents such as the articles of Association of China Basketball Association. After investigation, the author summed up the basketball association disciplinary procedures. There are three main problems in the disciplinary punishment system of the Chinese Basketball Association: the lack of the content of the punishment system, the need to join the hearing system in the punishment procedure, and the varying standards of the execution of the punishment. The reasons for these problems are that the relative rights and obligations of basketball association are not equal, the good autonomy mode in basketball field is immature, and the environment of governing body by law is lacking. Referring to the management experience of sports organizations at home and abroad, the Basketball Association needs to learn from the following aspects: the management experience and arbitration experience of the American Professional Basketball team, the implementation experience and punishment procedure of the hearing system set up by the FA; China Football Association special committee construction experience and hearing system implementation. The author suggests that: in order to perfect the disciplinary punishment system of China Basketball Association, representatives of the interests of all parties of the Association should participate in the formulation of the punishment system; the punishment procedure should be perfected; the punishment mechanism should be unified; the way of judicial relief should be provided; and the sports arbitration institution of our country should be built.
