【摘要】：我國古代運動傷害治理受傳統(tǒng)倫理影響頗深,在"身體發(fā)膚,受之父母"的儒家孝親倫理影響下,相撲、槍棒等易發(fā)生身體傷害的活動多被禁止,法律甚至創(chuàng)設(shè)"戲殺傷罪"規(guī)制此類運動傷害;易發(fā)生溺亡的弄潮、競渡等水上體育因儒家"死而不吊"的生死觀而受到較大限制;在"人為貴"思想的支配下,體育意外事件的責任認定較古代西方更為嚴苛。在這一背景下,我國古典競技體育的生存空間逐步縮小,對抗性體育項目逐步被娛樂休閑型體育項目所替代,這也是造成中西方體育不同發(fā)展走向的重要原因。此外,受草原民族"賠命價"倫理習慣的影響,元代引入燒埋銀制度使運動傷害賠償成為獨立的運行機制,但在"尊卑有序""貴賤有等"的倫理觀支配下,"同命不同價"被賦予身份正義的外衣。
[Abstract]:Ancient sports injury management in China was deeply influenced by traditional ethics. Under the influence of Confucian filial piety ethics, such as sumo wrestling, gun sticks and so on, were often prohibited. The law even created the crime of "play and kill" to regulate such sports injury; Water sports, such as swimming and swimming, are restricted by the Confucian view of life and death, and under the domination of the idea of "man is the most important", the responsibility of sports accidents is more severe than that of the western countries in ancient times. Under this background, the survival space of Chinese classical competitive sports is gradually reduced, and the antagonistic sports are gradually replaced by recreational sports, which is also the important reason for the different development trend of Chinese and western sports. In addition, influenced by the ethical habit of "compensation for life", the Yuan Dynasty introduced the system of burying silver to make the compensation for sports injury an independent operating mechanism, but under the control of the ethical concept of "superiority and order", "noble and inferior", "noble and inferior, and so on", the Yuan Dynasty introduced the system of burning silver to make the compensation for sports injuries become an independent operating mechanism. "the same fate is not the same price" is given the coat of identity justice.
