【摘要】：高風(fēng)險(xiǎn)體育旅游項(xiàng)目是旅游項(xiàng)目的特別種類,《旅游法》規(guī)定對(duì)高風(fēng)險(xiǎn)體育旅游項(xiàng)目設(shè)置行政許可,是為了政府部門有效監(jiān)管。但我國(guó)現(xiàn)行法律中規(guī)定有"高危險(xiǎn)性體育運(yùn)動(dòng)項(xiàng)目"以及"高風(fēng)險(xiǎn)旅游項(xiàng)目",從它們的基本含義來(lái)判斷,這兩類項(xiàng)目都可納入"高風(fēng)險(xiǎn)性體育旅游項(xiàng)目"。高風(fēng)險(xiǎn)性體育旅游項(xiàng)目行政許可范圍是國(guó)家法律明確規(guī)定的行政許可的事項(xiàng)范圍,這個(gè)事項(xiàng)范圍即是由特定主體依法定程序確定的"高風(fēng)險(xiǎn)體育旅游項(xiàng)目"的項(xiàng)目。在我國(guó)法律法規(guī)規(guī)定不健全的情況下,我們建議應(yīng)由國(guó)家體育總局、國(guó)家旅游局聯(lián)合其他國(guó)家機(jī)關(guān)定期發(fā)布高風(fēng)險(xiǎn)體育旅游項(xiàng)目目錄,保障高風(fēng)險(xiǎn)體育旅游項(xiàng)目行政許可范圍有法可依。
[Abstract]:High-risk sports tourism is a special type of tourism projects. The "Tourism Law" stipulates that the establishment of administrative licenses for high-risk sports tourism projects is for the effective supervision of government departments. However, there are "high risk sports events" and "high risk tourism items" in the current law of our country. Judging from their basic meanings, these two kinds of items can be included in "high risk sports tourism items". The scope of administrative license of high risk sports tourism project is the scope of administrative license, which is defined by the national law, which is the item of "high risk sports tourism item" determined by the specific subject according to the legal procedure. In the absence of sound laws and regulations in our country, we suggest that the State Administration of Sports, the State Tourism Administration and other State organs should regularly issue the catalogue of high-risk sports tourism projects. Protection of high-risk sports tourism projects administrative licensing scope can be governed by the law.
